    We have been dealing with CI's assigned manager for our building (C.C.C. **** ***** ******* ***) **** ** about the resident above us smoking on their balcony in our non-smoking building, and their subsequent noise retaliation and bird **** sweeping onto our balcony since March 16, 2022. I have provided a video of the offender smoking on their balcony to management, as well as detailed handwritten notes about the various offences (smoking, retaliatory banging, and bird **** incidents) with specific dates and times, all to no avail. The offender has hung blankets over their balcony railings to prevent me from recording them again, which in and of itself is a violation of condo rules, which Mr. ** refuses to acknowledge or deal with. He always focuses solely on the smoking, provides impossible solutions which I have already told him are not feasible, and doesn't reply promptly or at all, so we have no idea what is happening. I even had to email the CI COO to get Mr. ** to deal with the smoking again and was not let into the loop about any progress on the matter, just a 15-minute noise tirade from the offender. We are being terrorized in our apartment and CI is not prioritizing this issue at all, telling us only that the offender says they're not smoking, so my two months of painstaking collection of evidence is apparently worthless in their eyes. We don't accept their approach, their casual, condescending emails, nor their absolute lack of results while we are suffering at the hands of this offender. We have also forwarded all of this evidence to the building's Board of Directors to review CI's lack of performance on such basic issues and future with this building. The offender is providing multiple means of bringing them in line, yet nothing is happening while we are constantly being punished. We want this resolved immediately, and I would personally like a written apology from Mr. ** for his lack of interest in our suffering, and his inability to resolve it.

    The tenant has submitted various complaints and we have issued infraction notices to the unit above regarding their breach of the rules. The owner of the unit has also been notified of alleged breaches. We have submitted this issue to our legal counsel at this stage for resolution. Tenant must understand that as the managers of the condominium corporation, we are not the landlords of the unit above and cannot unilaterally evict the tenant. We have to follow a process that is oftentimes lengthy and frustrating. The communications with the complainant have not been casual or condescending. The complainant has also taken photographs and videos of the tenants in the unit above without their permission and should not continue to do this.
