      I purchased a Condominium at ******* ****************************** one month ago. Snows Management Association Manager *************************** reportedly is overwhelmed, indicated that I have consumed an inordinate amount of the managers time and reported that I sent a barrage of emails. This is not supported by the facts. I have spent appropriately fifteen (15) minutes cumulative at the Office itself and have sent a few emails to *************************** over the course of the past month relating to the Condominium Ownership, discuss some concerns relating to the Association, and my desire to be on the ***** of ********** In my opinion, *************************** communication style is rigid and she is not very friendly. I am aware of other Owners having issues with her as well. I observed *************************** being discourteous to another Owner in a meeting. I am informed by a third party that I cannot call or visit the **************** I do not appreciate the mischaracterization made by *************************** about me. It appears *************************** primary objective is to cater to the ***** of ********* of the Association. There are legitimate reasons for me to visit Snows Management Office: 1). Make Payments on Account and obtain a Receipt. 2). Obtain an Account Ledger for Reconciliation Purposes. 2). Review Association Records that are available to the Membership. The resolution I am requesting is a formal written apology and confirmation I am allowed to visit Snows Management Office. And if not the basis for that decision.       ******* Law Offices, LLC, represents ******* ************************************* in addition to its manager, Snows Management, ****Our law firm was the third party referenced in your complaint who informed Complainant that he can no longer call or visit the managers office. Complainant then filed a retaliatory BBB complaint against Snows Management, ****

      The complaint states in part that Snows Management has a primary objective to cater to the ***** of ********* of the Association. That statement is absolutely true. The manager (and our law firm) work at the pleasure of the board and the board makes final decisions. If an owner disagrees with association policy set by the board, blaming the manager is not appropriate.

      ******* is also entitled to select managers, vendors and volunteer board members without interference by any single owner. If an owner is allowed to harass these representatives, that either drives up costs or hinders and interferes with the associations relationships.

      Since Complainant purchased his condominium a month ago, he has visited the managers office several times, has provided his resume with duplicate transmissions, attended a board meeting to argue for approximately 2.5 hours when told the board decided not to appoint him as a member, mailed additional communications to board members at their home addresses, and called at least one board member at her place of employment.

      We consider this excessive, and we informed Complainant that he must curtail his communications. He is still allowed to communicate with the manager (only) via email (only), but there is no need for him to personally visit the managers office or communicate with individual board members outside of open association meetings. Complainant is also entitled to avail himself of the political process if he wishes to lobby and/or vote for a different board composition at upcoming elections. We have advised the manager to pursue criminal trespass charges, however, if Complainant refuses to comply with our directive to communicate only by email. Complainants response was to threaten filing a bar complaint against me and to file this frivolous BBB complaint against the association manager.

      The decision to curtail communication and threaten sanctions against Complainant was not made by the manager. It was made by the board,based upon our recommendation. Snows Management, ****, was hired by the ******* corporation to carry out its policies, and Complainant is one of 45 owners who may not agree with each and every policy. We therefore hope you will dismiss the complaint and rescind any negative reporting against the management company. It would be unfair to shoot the messenger, or penalize Snows Management, ****, simply for doing its job in excellent fashion.

      I am rejecting this response because: there are inaccuracies and material misrepresentations in the response provided. Irrespective,of the elements of the disagreements. I believe the directive given to me is unfair and is rather harsh. It appears retaliatory action has been taken against me. Snow's Management, **** fails to provide a reasonable justification as to why I am not allowed to call or visit the Office for the following purposes: 


      1).Make in ****************************** Dues Payments on Account and obtain a Receipt.
      2).Obtain an Account Ledger for ************************************************* Records that are available to the ******* Membership.


      I would like Snow's Management, **** to address each of the aforementioned items and why it believes it would not be appropriate for me to visit the office for those purposes.


      I assert my efforts to obtain a position on the ******* ***** of ********* has been made in good faith. All federal, state, local laws, association bylaws, and rules were adhered too. I adamantly dispute the harassment claim as there is no factual basis for this claim under the law and this claim has no merit. I have provided constructive feedback and constructive criticism in areas of improvement. (As have other Owners). I am aware of other Owners having grievances as well both against the Association and its Managing Agent. I understand some feedback made in good faith may cause others to react or respond negatively. However, retaliation against an Owner who merely purchased a unit not that long ago is not appropriate.


      I have a legal right to certain ***************** documents held by Snow's Management,**** This is something that Snow's Management, **** is fully aware of under the law.

      AK Stat 10.20.131
      (a) A corporation shall keep correct and complete books and records of account and shall keep minutes of the proceedings of its members,board of directors and committees having any of the authority of the board of directors; and shall keep at its registered office or principal office in the state a record of the names and addresses of its members entitled to vote.
      (b) All books and records of a corporation may be inspected by any member, or an agent or attorney for the member, for any proper purpose at any reasonable time
      Snow's Management, **** is the Managing Agent and Records Custodian for ******* ******************************* I understand that Snow's Management, **** is paid by ******* *******************************
      I would like Snow's Management, **** as the Managing Agent for the Association to explain in detail how it intends on full compliance with AK Stat 10.20.131(b)if I am banned from its premises?

      This is a rebuttal summary. I would like to work with Snow's Management, **** on resolution of any outstanding issues pertaining to this complaint.

      Complainant asserts necessity of making payments, obtaining account ledgers and reviewing association records. None of these require in-person office visits. In fact, the management office records are entirely digitized, so most records or account ledger requests are best resolved by email.

      As an accommodation to Complainants concerns, however, Snows Management ***** has prevailed upon the association and its counsel to allow in-person visits for purposes of making payments. All parties are hopeful of fostering a more cooperative relationship going forward.

      The associations original response may have been overreacting, although it became concerned when individual board members were contacted at their homes or places of employment. The association continues to view this as intrusive, and it also requests Complainant respect the boards decision once a vote has taken place. Disagreements are expected to be addressed through the political process as outlined in the bylaws, rather than tenacious advocacy which continues after an issue has been decided.

      Most records requests must be submitted to the board for approval, so emails again are the most efficient process to utilize. Snows Management, ***** will do its best to accommodate any owners requests and expectations, provided interactions are respectful and reasonable in frequency/length.
