Code § 34-14A-5,14 (1975). The unlicensed builder pled guilty and received 180 days suspended sentence and 24 months probation. The builder was ordered to pay $3,150.00 restitution to the homeowner.

      Eddie Smith, who now operates under the alias *** and sometimes goes by *****, has adopted various names and business identities. This change seems prompted by multiple complaints and a judgment against him under his original name. Despite initially presenting himself as ***, he eventually admitted to his real identity only after investigation.I engaged ***'s services on October 10, 2023, for the removal of two trees, old privacy fence removal, installating a new privacy fence, and installing 136 feet of chain link to segregate the dog area from the pool. Expressing urgency due to the need to board our dogs during the project, I stressed the importance of a swift completion.*** estimated the entire job would take eight to ten days, broken down into specific tasks. This included two days for tree removal, one day for old fence removal, one day for setting posts, one day for picket installation, one day for gates and caps, and two days for chain link installation. The total duration was eight days, with a potential extension to ten days if weather conditions were unfavorable. Based on this timeline, we planned to board our dogs for a maximum of six days.*** quoted a total cost of $9950, requesting an upfront payment of $6500 for materials. I issued a check, with instructions to make it payable to his wife, ****** Smith, who, he claimed, managed financial matters for their joint business. Despite the agreed-upon start date of October 16, work did not commence until October 19. ***'s attendance was sporadic, often starting late in the day and working only a few hours at a time. This pattern persisted throughout the project.After a week, he completed the tree removal and requested the $450 quoted for this specific task. Despite the extended dog boarding period and the delayed fence removal, *** did not complete the work as promised. In response to the prolonged boarding and unfinished fence, he hastily constructed a makeshift pen using field fencing.As of November 2, the privacy fence was still incomplete. *** falsely claimed that I had authorized additional funds, and he called my wife from a number associated with "Genisis Construction," revealing his true identity as Eddie Smith with a questionable past. Following this revelation, I contacted him, threatening legal action. On November 3, he requested more money for picket purchase, explaining that the initial $6500 was partly a deposit and partly for operational costs.Growing increasingly skeptical, I insisted on purchasing materials myself and gave him an additional $400 for operational expenses, accompanied by a detailed agreement specifying payments, outstanding amounts, and a completion deadline of November 10. However, *** worked only five hours the following week, failing to finish the privacy fence by the agreed-upon date.On November 10, he cited rain as an excuse for the delay, and when he did work, it was for a minimal duration. Upon inspection, I discovered numerous issues with the completed fence, including deviations from the original layout, gaps between posts and concrete surfaces, a dangerous lack of adherence to safety standards, and an overall shoddy appearance.As of November 12, a month after the initial payment, *** has received a total of $7300. Despite numerous attempts to contact him, he is now avoiding calls and texts. I am now demanding a refund for the incomplete work and unfulfilled material purchases.In conclusion, Eddie Smith, operating under various aliases like *** and *****, is a dishonest individual with a history of exploiting others. His wife, ****** Smith, who handled the initial payment, appears to be complicit in their dubious practices. Legal action will be pursued against both individuals to seek compensation for the incomplete and substandard work. Prospective clients should exercise caution when dealing with Eddie Smith and his various aliases. He has proven to be a scam artist with a disregard for contractual obligations.

      I hired Mr. Ed Smith on 26 FEB 2021, and paid him $2200 as a down payment. It was dumb to pay so much up front, since he bid $4060 to add a porch over my deck. 8 months later, all he has done is install 2 posts to support a steel beam, and then installed the steel beam, with my help, since he brought the wrong equipment, and not enough people. He has given me a litany of excuses, and told me multiple times that he would return to finish the job. The excuses ranged from his mom being in the hospital with a terminal illness, to his dog being poisoned, to family members suddenly dying, to not being able to find anyone to work. I felt sorry for him, so I kept accepting the delays. Fortunately, having a roof over my porch wasn't an emergency. A couple of times, I told him that I would fire him unless he showed up to finish the job, and that's the only reason he has done the little he has done. I finally told him that I wasn't going to give him any more chances, since I've concluded that he is just a scam artist. P.S. I've read on another site that his company was previously called Home Renovations.

      The owner *** ******** did hire me to construct a back porch. He had
      contacted me twice before for estimates on other projects. He informed
      me that he buys and renovates properties as well as his son and sons
      father in law so we discussed me building a back porch and I told him
      I would build it at cost to show him what I could do and he said he
      would consider using me on future projects. We agreed on a price of
      $4060.00 (he personally wrote in the contract that he would pay for any
      increase in material cost). He gave me a deposit of 2200. He was
      informed that I was a few months behind but we agreed to proceed. We
      had an unusually wet spring which delayed jobs even more. We also
      discussed him pressure washing the deck before we started because he
      had large dogs and there was a lot of dog hair and fecal matter on the
      deck that we would be working on. He said he would clean the deck but he did not. On
      April 21st the owner called me to ask if a steel beam would be stronger
      than a wood beam. Obviously the answer is yes but more expensive. He
      instructed me to go with a steel beam. The steel beam at the time was
      $720.00 compared to around $125.00 for wood. Tuesday May 18th I
      purchased a 24 foot beam. We needed a 19'6 but only 24 was in stock. I had
      to rent a 24 foot trailer ($125,00) and pay 4 men 3 hours ($340.00) to
      delivery it. The beam weighed approx. 550 pounds .I did not get
      reimbursed for the price difference or cost. came back a few days
      later with cutting torch and welder to cut the beam the right size and
      weld the mounting plates (5 hours) 3 men $350.00 & $45.00 for material. June
      4th me and 6 men moved beam from driveway to back deck, we removed
      part of the deck to install 6x6 post ($140.00) onto the concrete slab
      under the deck and install L-Brackets with tapscon screws. ($43.00) Then
      we replaced the deck that was removed. I had to pay each man an extra
      $50.00 because of the working conditions the deck was never
      cleaned. $300.00. Because of the weight of the
      beam '550 pounds, we were not able to lift it in place. Normally
      would have been a 2 man job ( if wood was used) The next day I had to order a
      motor lift, because of covid nothing is in stock. The lift came in 8-10
      days later. ($340 cost) Had to purchase 3/4 ($75.00) plywood to place the lift on
      because the deck boards were rotten in some areas. It took 4 1/2 hours
      to set up and lift the beam in place and secure. 3 men ($315.00) It would
      have been half that time if we would have been left alone to do our
      job. The owner did jump on the ladder and help us push it the last
      couple of inches in place, at that point we had carried it over 80 feet I think we would have been just fine. As far as the owner saying I
      had excuses, I lost count of every time it would rain and we would
      not come and he would fire me. My dog did get into rat poison but I called
      him and said I just had to stop by the vet on the way to his job, was
      an hour late to his job. Don't know why he brought this up? My
      mother did pass away and she spent 77 days in intensive care and coded several
      times so I did miss a lot of work during that time. As for him saying
      HOME RENOVATIONS that's not me. I never heard of this company. As to
      date I have incurred cost of $2793.00 of which only $508.00 was actual
      woodwork which was agreed on. The rest was added because of the steel
      beam that the owner insisted on using but not reimbursing me for cost.
      I have pictures documenting every phase of the work I have spent $593.00
      dollars more than the 2200 that was given as a deposit and have not
      been compensated...

      There is no fecal matter on the deck, and even if there were fecal matter on the deck, that wouldn't affect their work. Also, it is a sound deck that wouldn't affect their work. Pressure cleaning my deck wouldn't help them do their job. His incompetence is what has cost him more money. He didn't bring enough people to do the job correctly, cut the material the wrong size, and brought the wrong equipment, which is why he had to return multiple times. After 9 months, he's done less than 1/5th of the work, for a job that should take less than a 1 week. That is either the epitome of incompetence or of a scam artist. His incompetence that resulted in his extra trips should be his cost. All he's done is put up 2 posts and the steel beam, with my help, otherwise he wouldn't have gotten it installed that day. He hasn't even installed the beams correctly, since it is not laid properly against the wall, because he drilled the holes in the wrong places. I priced the beam at under $400 and the work he's done is not worth much. I estimate that he owes me at least $1000, and that is being generous, considering how poor the workmanship has been.
