    Fitness 1440 **** has engaged in deceptive business practices, including: 1. False advertising (Promoted no sign-up fees & no contract on website and outdoor signage, but charged fees and imposed contract terms), 2. Forgery (My contract contains signatures and initials that are not mine), 3. Unauthorized charges ($49 charged to my credit card without my consent), and 4. Unfair contract terms such as: Gym can increase dues by 600% without notice (only applied to discounted memberships), 60% of membership dues per late payment, 150% of membership dues per declined payment. As the only 24 hr gym in ****, **, these deceptive practices impact the entire community. Event Timeline:1/4/25: I enrolled in person. The front desk employee (young male, late teens) asked me to sign a digital waiver but refused to show me the contract. ******** agreed to $15 every 2 ********** was charged $25 at enrollment despite gyms claim of no sign-up fees.1/6/25: Received a contract via email from ********************** 2/19/25: Fitness 1440 charged my card $49 2/25/25: Reviewed the contract and found:-My signature and initials were forged. The name and signature are not mine.-Undisclosed terms: $49 annual fee, potential 600% increase in dues, excessive late/declined payment fees.I emailed the owner of Fitness 1440 Erie requesting a refund and cancellation by 2/27/25. I ccd the owner of ************* and *** (a separate business renting space in the gym) where I am also a member. No response.2/28/25: Followed up, extending my request deadline to 3/5/25 3/1/25: At kickboxing class CO KM owner showed me a text from Fitness 1440 owner acknowledging my complaint, admitting an employee improperly signed my contract, and said I am in the right. *** owner claimed he would follow up with the gym manager. I received no direct response.Despite acknowledging the issue internally, Fitness 1440 Erie has failed to provide any resolution or communication directly to me.

    I signed up in October 2023, I was told I could have A three month trial and that there was a 30 day cancellation notice where I just had to cancel 30 days before and would not be billed after I asked this multiple times. I was told I just have to go in 30 days before and cancel my membership and no further charges would be Included. So I canceled December 30 2023 I went in person and they They made it extremely difficult and told me I had to do it online, even though I went in person to the place to get it done, and then when I tried to cancel online, it still showed that I would have recurring payments up until March, I tried contacting the owner to cancel these with no response and called multiple times. I moved back to **** so thats why I cancelled. I disputed them on my credit card which got approved. Fast forward to now May 2024, I get a call from collections and they had somehow sent me to collections for $372 even though I canceled my contract. They did not send me the agreement form until after discussing in person and anything the correct initials arent even listed in the agreement form that they had me sign. The initials are SOF. I asked specifically if there was any contract agreement Because I move for my job and they told me no. On the contract, they didnt even allow me to read the entire thing they just sent it to me afterwards. So now I was auto charged for four months after and sent to collections even though I canceled December 30 of 2023.

    I received an email from the gym Fitness1440, written by *******************, the gym manager on 04/01/2024 stating they would be raising my gym dues to an undisclosed amount at an undisclosed time. Which they are now considering as an implied consent email, which would increase my rates in 30 days from time email was received. My membership was purchased in 2021 when youfit, my previous gym contract and only contracted membership, went out of business. Today, 04/15/2024 at 2:45pm I spoke with a gym manager ****** at Fitness1440, who stated that they would not honor the previous, and only, contract I have on file from my youfit membership. That contract states that the gym can only raise rates on my anniversary (02/28) and that I will have 10 days to inform the gym on my intentions of cancellation. I am reaching out to the BBB wanting to file a formal complaint against Fitness1440, and hoping that you can aid me in cancellation of my membership immediately without any future financial harm as well as assisting with other people who are being wronged by Fitness1440s actions of a breach of contract and unwillingness to honor the previous and only contract on file for gym members like myself.

    Fitness 1440 in ******** closed without notice and our memberships were transferred to Anytime Fitness in ********* without our consent. I have never signed any documentation with Anytime Fitness, I have never been to that location and did not agree to this. I called and the man working, ***********************, told me it was *** fitness even though the business and address are on my bank statement. He stated I needed to email to cancel my membership, I told him I would be indicating in the email that I was not a member for documentation for my bank as I was disputing the charge. He stated that I needed to say I was canceling and when I told him I would be contacting BBB as transferring our accounts to his gym was not a good business practice, he told me he would not help me and to contact *** fitness and "good luck." My larger issue is with Fitness 1440 closing without much notice and transferring ALL members to anytime fitness without consent. Please look into both business's practices. I do not care about the $30, I disputed the charge and canceled my card. However, this all feels really unethical.

    My wife ***** had opened up a Silver and Fit account at a fitness place called U-fit on 11/18/2020 in *******. Silver and Fit is a ******** plan that pays for a health club for Cigna members. During the pandemic this company closed completely. Fitness **** opened up at a different location and evidently purchased the files from U-fit. ***** never went to Fitness 1440. *****, Im guessing continues to pay for their members even if the people dont use it. When Fitness 1440 opened they must have been billing Silver and Fit, for *****. they then stopped taking Silver and Fit on or about March of 2022. At this point they started billing us on our Credit Card for their monthly fee. Me being old and gray, missed it on my statements. So, we have been paying ***** every month since March of 2022. We called their billing service, **** and they confirmed what happened. I talked to the manager at Fitness 1440, ******, and she also said thats what happened and said according to contract it was our responsibility to have canceled the membership. We had no idea that we had a membership at the this club. We were not contacted from the fitness club. Because U-fit had closed we had no idea what was happening. ****** said that ****** and Fit, *****, was supposed to contact us. I know that I messed up not catching it, but we shouldnt have to pay those charges. The credit card company wont do anything saying that services have already been rendered. It isnt right.

    In December of 2020, the gym I had a membership with (YouFit) declared bankruptcy, and sold their memberships to another local gym in the ******* area called Fitness 1440. Part of my membership with Youfit was for childcare. However, fitness 1440 did not offer childcare. I remained on my YouFit membership until October 2021, at which point they made me switch my membership over to fitness 1440. I agreed and signed a new membership, which stated that my monthly dues would come out to $14.40 on a bi-weekly basis. Nowhere within my new contract did it state that I still have childcare, or that I was responsible to pay the $10.15 per month for childcare. Since again, childcare is a service that none of their locations even offer. I had relocated out of ******* in 2022 and decided to Fitness 1440 membership. December 2022 I paid all fee's necessary and cancelled my membership.February 13, 2023 I checked my bank account and saw that Fitness 1440 had charged me $10.15. I contacted the ******* location and spoke to ******. She informed me that was the charge for my daughter. I informed ****** that my daughter is 6 years old and shouldn't have any sort of membership. She looked into it an realized I was from the YouFit buy-out, and then transferred me to the manager (****). **** explained that they'd previously had issues with the accounts that had been sold to them by YouFit, and he'd contact corporate to see what they can do. He said he'd get back to me within 2 days. I was also assured that no more money would be deducted from my account. Since then i've called 4 times with no resolution, and have not received any correspondence from ****. I reached out to ************* who handles their billing, and was told that I would continue being billed until the membership for my daughter is cancelled. However, I have no way on my end to cancel it, and no one at the facilty is of any help. Additionally, they owe me roughly $263.00 for charges on an account that doesnt exist.

    I had an active membership with You Fit. A local gym that I used during to the facilities and proximity to my house. During ******* was unable to attend my gym. After months of getting charged for services I couldn't access and not able to speak to a live person. I finally saw a stop to the charges on my checking account. Once gyms opened again I noticed You Fit hadn't reopened. I signed up for EOS. Late last year I noticed double charges being billed by *** Fitness. So I called and spoke to customer service that said one charge was for EOS another for ****. I was instructed to call. I called **** Fitness and spoke to ******, the manager. He was working to get me a refund but confirmed I was charged for 24 months that I never used. He offered me a 24 month membership if the refund wasn't approved. Weeks went by and holidays passed. I called again and found out ****** was no longer with ****. I spoke to **** who said he was with corporate and said he would be able to get me a refund and was apologetic about everything. Said it would take until the following Monday to get this completed. I called the following Tuesday and had to leave the first of several messages. Now the dodge has begun. Not one call back as I was promised over and over. Last Thursday the 16th of February I stopped in and spoke to **** in person. Now ****** story and attitude has changed. He left to see if he received an email from corporate. Said he couldn't get a refund. I said I would like to speak to corporate and come up with another solution. He refused and said he was the only person to speak to. I said this was unacceptable and asked for another solution. He now offers me 6 months of a membership and said this was the best he could do. I expressed multiple times that I didn't want to attend a gym with less equipment like a pool and steam rooms as well as being further away. As well as a company that never notified me that they took over my contract and started charging me. Ridiculous.
