    The Arizona Attorney General's Office v Cox Communications Inc, Cox Communications Arizona LLC, and Cox Arizona Telcom LLC

    The following describes a government action that has been resolved by either a settlement or a decision by a court or administrative agency. If the matter is being appealed, it will be noted below.

    On December 15, 2023, Cox Communications Inc, Cox Communications Arizona LLC, and Cox Arizona Telcom LLC entered into a Consent Decree with the Arizona Attorney General’s Office. The Consent Decree settles allegations that the business regularly raised the bills of price-locked customers through increases in company-imposed fees, such as the broadcast surcharge fee (BSF), regional sports surcharge (RSS), and the carrier cost recovery fee (CCRF); and disguised the price increase as fees. The Consent Decree further alleges the business deceived consumers by falsely implying that the (CCRF) charge was a tax or government fee by listing the fee alongside government taxes, fees, and surcharges. Under terms of the Consent Decree, the business was ordered to accurately and clearly disclose any and all material terms of conditions to consumers at the time of sale; refrain from imposing any unilateral pricing increases on its residential consumers that have locked, set, guaranteed or otherwise fixed monthly pricing; continue offering plans to consumers that do not include BSF, RSS, or CCRF surcharges, and ensure that products and pricing are easily found on the company's website. Under the terms of the Consent Decree the business was ordered to pay $10,000,000 and offer payments/credits to eligible consumers in the total amount of $3,042,494. The Consent Decree was for settlement purposes only and should not be considered as an admission of guilt or finding of violation of the law.
