I had purchased a Mercedes-Benz m-class 2011 at the Tucson used car sales. I paid in full for the price of 9,892.88 they refuse to give me the title. I've tried to work things out with them. I've paid in full. They keep making promises that they will get me the title and they refuse to. They have blocked me and say that they can't because the person that sold me the vehicle no longer works for the company. I can't go to the DMV because it shows that the car is not listed or owned anywhere and have to do an investigation which can take up to 5 years in case the car is actually owned by somebody else and gives them time to claim it. Even though I have paid the car and had a contract with that dealership, it's possible that the car may not actually be owned by either the dealership or by anybody or somebody else. I have found out that the dealership has scammed others either with the same issue or folks paying for a vehicle in full and never receiving a vehicle. I first signed papers in April of 2024 and paid the last payment as of December 2024 making all payments in full per contract. When I try to reach out to the dealership the phone numbers are listed as unavailable or they have blocked my number. When trying to contact personally the representative that sold me the vehicle. When I go in in person they let me know that the person that sold me the car is no longer available and cannot assist me in getting my title resulting in me having to discuss this matter with a detective and a lawyer.Initial Complaint

On August 1st, I went to Tucson Used Auto Sales to purchase a 2004 Ford F250. When I test drove it 2 days prior (July 30), the AC wasn’t working & lacked boost power. They said they would fix said issues. When I came in on August 1st, we had agreed that I would pay $6000 upfront & offered my 1999 Jeep & my fiancée’s 2009 Toyota Matrix. He said I could keep the Matrix until we move out of state in September & pay the remaining $3,000. The dealer & I agreed on the 500miles/15 day implied warranty. When I left with the truck, the 2 issues weren’t fixed. The engine light was on again. I went to auto zone to get it tested. It was a faulty fuel pressure sensor. Then the inter cooler for turbo was cracked. I’ve had to recharge the batteries multiple times. The battery terminal is fried. I called around and got estimates for repairs, I went to 3 different auto parts stores and they all told me the same things. I called the dealer and they asked me to go in at 1pm on August 10 (today). He said he would take it to his maintenance and I just pay for the parts, or the other way around. Or I could get a different truck. According to what I read on the laws with the 500miles/15 day implied warranty, if it’s not a running truck, and warranty is breached, dealer has to pay for the first two repairs. The law 44-1267 Section E states “ If the implied warranty of merchantability described in this section is breached, the purchaser shall give reasonable notice to the seller. Before the purchaser exercises any other remedies under title 47, chapter 2, the seller shall have a reasonable opportunity to repair the vehicle. The purchaser shall pay one-half of the cost of the first two repairs necessary to bring the vehicle in compliance with the warranty. The purchaser's payments are limited to a maximum payment of twenty-five dollars for each repair.” I want the dealer to comply with the implied warranty law or I want my money & 2 vehicles back.Initial Complaint

Fraudulent business . I was busying a car for my son and was told to put $2k down for a deposit. I did that and then the dealership tried to sell the car to someone else after I put the deposit down on the car. Three weeks ago now I went into this dealership to buy a car. I was "Approved" so they stated. I signed paperwork in which I still have. Gave them a deposit of $2500. The car did not leave with me same day as it needed to have 02 sensor repaired according to the dealership. Two weeks later I started being told I wasn't approved then I was, then wasn't, then more documents. As of today jun3, 2024 I was told again I wasn't. I have had a loaner car form them for a total of 5 days not in a row. Once I was told that I was not approved I requested my deposit for that vehicle back and a letter stating I never took possession of the care so the insurance they had me put on it does not charge me. They are refusing to give me a letter, also they are running me around from perosn to person that they don't "have check writing capabilities" gave the number of who does and now is no longer answering my calls, texts and not giving me my deposit back which was told to me 100s of times I would get it back. Now they are no longer answering me to give me this money back. I want my money back so that I can go somewhere else to get a vehicle so that I can get to work. I gave them cash but they can't give me cash back or check, Zelle etc. This was no where stated that I wouldn't get that back as I never took position of that car. Unprofessional and unorganized. After coming in to look at a 2005 nissan titan and putting down a 1000 cash down payment on the 3rd of may 2024 to hold vehicle till i get rest of downpayment (1500) on 17th of may AFTER being told i was approved i learned that they were running my credit on a completely different vehicle a 2006 nissan titan( Mind you i have video recordings and screenshots of all interactions and online pages) When I noticed it and brought it up they claimed the photographer uploaded it on the wrong vehicle page online. I then waited two weeks due to their system being down to be told i was not approved on the actual vehicle because it was a 2005 and the bank doesn't finance vehicles older than 2006. They then tried to sell me the other vehicle that they illegally ran my credit on when i did not even inspect or even drive it i turned it down and asked for my down payment back so he said come in the next day, next day comes around he says wait till next monday due to business owner being out at auction monday comes around and he now says i have to wait till Thursday due to the company being out of business checks.Initial Complaint

On December 8th 2023 I went to finance a car from Tucson Used Autos Sales and got a 2021 Toyota Camry. Ever since I was paying $622 as my monthly payment. On April 11th 2024, a tow truck came to pick up the vehicle without any knowledge or reason as why to. Once i called to make a polive report, thwy wers rhw ones to let me know a tow truck had taken it. The next day I went down to the office to speak with the owner and the sales rep named Cesar and the owner told me they had it bscause the bank didnt authorize the loan due to the vehicle returning as a total loss. I then was told that i could get a new vehicle with the down payment I had given for the Camry as well as the payments that I had already made. I would go into the office and wait for paper work to be done but neither the owner or the sales rep were ever there to help me. Every time I was tbere i would wait from 5-7 hours for either one to show up. After 3 days of the same thing, i asked for my money back on April 19th 2024. On April 22nd 2024 they called me to go pick up my money and belongings frlm the vehicle. When I got there, my husbands passport was missing and an air compressor. I was also told that Instead of receiving my money back that I owed them a total of $74. Once I asked him for paperwork or documentation stating what was subtracted from my down deposit and what was that I ended up owing them he ended up telling me that they were close for the day and couldn't help me with that until the next day which would be April 23rd. Today is April 23rd as I am putting in this report and don't think I can handle any much more of wasting my time by going down and doing nothing but arguing, going back-and-forth with the owner. I did advise him that I would be speaking with in Attorney General and also be putting in the report with the Better Business Bureau and he said that to do what I had to do but that he wasn't going to give me my money back.Business Response

After all the hard work we put on you don’t want to or like to get a cheaper unit we didn’t had no choice to get our loaner back at that point you refused to return it back and we had no choice to repo it from you and charge you the restocking fees by our company policies. The miles you drove alone was over the down payment you put. But we are here to help you give you the down payment credit back not charging you any restocking fees from the loaner toward $20k loan you approved.

I do not agree with anything that was in his response. I do not want to do any business with him after everything that’s happened. I have recordings from phone calls saying the opposite of what he is stating. Never was I told to return the car nor asked to do so. I had believed that my car was stolen I made a police report and then I found out through the sales persons that my car was towed. Again I do not want to purchase a car from that business. I was told we were going to get our money back and after going back and forth for a few days, I then was denied my money back and he stated I owed him. He wanted to charge me 99 cents per mile driven. I then found out that a mile should be charged 25 cents and not 99 cents.
