I scheduled with MBC to perform BPD DS procedure as a revision from VSG (which was performed in the **). I was scheduled for January 19, 2024 with Dr. ************************************** I requested BPD DS. The paperwork listed BPD DS. I had requested a surgery report prior to the procedure for my records. The header on this report listed BPD DS. The procedure described was not BPD DS, but instead another procedure, namely that of SADI-S. On May 24, 2024, after 5 weeks of me aggressively seeking clarification, the surgeon confirmed the procedure as SADI-s, and not BPD DS. I was never informed the different procedure was performed. It was never discussed as an option for me. I was not told it was performed and I have no medical basis for it occurring. These procedures are different. MBCs own website offers details regarding the differences. I deliberately sought BPD DS for my unique medical condition. Resolution for this situation is for MBC to deliver on the service of providing me with the medical care requested, paid for, and not performed. I am asking for the correct procedure, that of BPD DS, at no additional cost to me.

I have made multiple attempts by phone, text and email to connect with **** to resolve this matter, but there has been no response. Want to talk to ****, but so far no response to complaint from ****

      Customer response

      07/12/2024

I am rejecting this response because: the first point of contact from MBC to me was on July 11, which means the response from the company to BBB (that they attempted to contact me multiple times) is not accurate. I have replied to MBCs initial request (dated July 11) today (July 12) in hopes of opening a dialogue for resolution.

      Hi ****,

Thank you for your email on Friday. I have connected with the surgeon and the surgeon ****** and they either will be in touch shortly, or should have contacted you already. If there is anything else I can do for you please just respond to my email or here. Hope you have a good day.

I am rejecting this response because: I am pending successful contact from the surgeon. I have seen responses from ********************* that were copy/pasted from the nutritionist, *********************. I have requested further assistance from the office manager, ***********************. I believe we are approaching satisfactory resolution but just need to confirm date and agreement that revision will be performed at no additional cost by me.

I put in for refund on August 7, 2023, and have yet to receive any sort of refund. I have made multiple attempts to contact the company and the only response I get is I will get an update. According to the company this should have only taken 8 to 12 weeks and it has now been five months. I am extremely frustrated especially because I have gotten no update on when this is going to be resolved.

Good afternoon, Mexico Bariatric Center,I want to first say I received the ***************** I could have ever hoped for under the care of Dr. ************************************* and his staff. I would recommend him to anyone. I paid in advance for my gallbladder to be removed but during my preop it was decided that they would not preform that service. I had my surgery on August 2, 2023. I have been waiting since the first part of August 2023 for a refund. I was assured that I would receive the refund of the $1000.00 within 6-8 weeks.Needless to say, in 8 weeks I had not received the refund of the $1000.00. I have made multiple calls, sent text messages as well as emails. My last contact was with ****** (Administrator) via email, and she directed me to ******** (Office Manager) via email. I emailed them both in an email on 11/21/2023 & 11/30/2023 and I have not heard anything back from them. The business department and finance I feel are very unethical and they hope people will get tired of asking for their refund and give up. I feel that this is passed down all the way from the *** ***************. He is founder of this Company and I believe he not only allows but encourages this type of action. He hides behind his other company name Sourcis, Inc. in Virginia. They said they would mail a check but, in the beginning, I was advised if I was owed a refund, it would be refund back how I paid well I paid with my debit card. So why would it not go back on my debit card?Very Disappointed Customer,

I strongly encourage individuals seeking gastric procedures to explore alternative healthcare facilities in Mexico. While successful outcomes are possible with well-executed surgeries and adherence to post-operative programs, my experience with Mexico Bariatric Center (MBC) revealed a concerning level of incompetence and a disregard for patient safety. My scheduled gastric sleeve procedure with MBC was abruptly canceled due to a preexisting medical condition, known to them prior to approval. On the day of surgery, just an hour away from the procedure, a hospital doctor, independent of MBC, revealed that proceeding would endanger my life, as the facility was ill-equipped to handle complications related to my health issues. This contradicted MBC's prior approval, which had been based on a comprehensive report from my cardiologist.Disappointed and perplexed, I later discovered potential financial motivations behind MBC's approval. Following the cancellation, MBC pressured me to sign a cancellation form forfeiting any refund. Refusing, I requested reimbursement for the surgery and travel expenses. MBC's delayed response offered a partial refund, citing incurred expenses for the cancellation, or the option to reschedule with the original approving doctor, contrary to the hospital's recommendation. In subsequent negotiations, I emphasized MBC's negligence, which cost me $9,088.79, and after weeks of unresponsiveness, MBC's final offer, an expedited $4,689 refund contingent on signing a non-disclosure agreement (NDA), raised concerns. I countered with a $7,500 settlement, accepting the NDA MBC initially agreed but, five days after receiving my signed NDA, rescinded the offer, now only willing to refund $5,489.Five weeks post-scheduled surgery, MBC's responses have been insufficient offers, promises broken, and bills for a procedure that never took place. Mexico Bariatric Center's commitment to patient well-being and financial restitution appears sorely lacking.

***************** is attempting to extort us to receive more in a refund than we actually owe him according to our refund policy. We have acquired legal representation in the continued dispute with him.

      Customer response

      02/25/2024

I am rejecting this response because: Despite MBC's response, they continue to avoid accountability for their mishandling of my case. It took them 90 days to address my complaint with the BBB, coincidentally the same amount of time they had to send my complete medical records to the surgical facility in Tijuana, Mexico, before my scheduled surgery. Their failure to forward these records resulted in the cancellation of my surgery. Regarding their claim of extortion – what a stretch. I received a full refund, but only after I initiated chargebacks with my credit card companies and provided evidence to support my claims. MBC even contested these chargebacks, demonstrating a blatant disregard for customer rights. Despite drafting a Non-Disclosure Agreement (NDA) promising a full refund and additional compensation, they failed to honor their commitment. Thanks to the intervention of my banks, I was rightfully reimbursed. I seek no further action from MBC, yet they persist in their attempts to silence me and suppress discussion of their negligent practices. Their request to take down the 'Mexico Bariatric Center nightmares' Facebook group is just another attempt to evade accountability. Consumers deserve transparency and honesty, not intimidation tactics from companies unwilling to address their shortcomings

I had a medical emergency and canceled my surgery prior to my appointment. They illegally deposited a photocopy of my check and now no one will returned my calls and explain anything. They have yet to answer how they could just deposit and falsely deposit something without the check being in their presence. I paid a higher deposit which was my understanding that it would cover additional fees. I want my money back promptly and I need help. Attached is the messages I sent to cancel prior and none of the messages stated the details of the next steps in regards to my money being taken, especially because they didnt have the physical check. I also attached the amount owed back to me.

Surgery booked with Mexico Bariatric Center in TJ. This is an ******** based company out of Folosom **, with a location in TJ, Mexico. Per cancellation policy I was due anything I paid less the deposit. For my particular situation, surgery date was scheduled for 8/18/2022. Cancellation was done 7/30/22. Per their website, if cancellation is done prior to 15 days before ORIGINAL surgery date, 100% refund less deposit deposit paid. I paid a total of ********. ****** was a deposit. I am due ******* and at this point I want all of my money back. Their cancellation states 8/12 weeks for refund. I have been in contact with them, stating that I was going to file fraud charges etc, as 8/12 weeks for a refund is excess. It is approaching 13 weeks and I'm still having to request my money. I was told on Monday 10/24/2022 that my refund was being issued in that "batch" that day. When I reached out to confirm amount being refunded, this establishment tried to keep money that was not entitled to them nor did it abide by their own published cancellation policy. Today 10/25/2022 I had to send this company their own cancellation policy to get the full amount committed back to me. NOW, it's being stated that "upon approval".. I am absolutely entitled to my money back.... This is fraud....

Had prepaid for a surgery with several payments through Zelle. The claim to have received 3 of the 4 payments. I had to pay an extra $500 for this missing payment in order to have surgery. After surgery I had my bank (USAA) do an investigation and they determined the $500 was in fact deposited into their account. I have contacted Mexico Bariatric Center, 5 times constantly being redirected. They wont call their bank- the company says they have looked into to it, but in my opinion they need to call **** of America- they refuse to call themI have called my bank and there is nothing they can do. I have tried calling ***** but they say to talk to company receiving funds and to my bank. I have tried calling **** of ********* and cant get through because I do not have an account. I have many things to prove this $500 payment went through- it was submitted in August 13 2022, and paid August 15 2022.I just want my $500 overpayment back. On the bank statement you will see I sent 2 payments of $1000 on page 5, one payment of $500 on page 6 , and $1000 payment on page 7.

Per this email from our Accountant to the patient dated 10/20/22.    This email is to confirm that we do not have your payment.  I have done a special review of our bank for you four times, and we never got a confirmation email stating we received the payment from you.  Please speak with your bank or Zelle, as we have exhausted our ability to assist you with this matter.

      Customer response

      11/02/2022

I am rejecting this response because:I have proof from my bank you received payment associated with Mexico bariatric centers account, business email. Regardless of a confirmation email, the funds were in fact deposited. I have an official letter from my bank USAA stating that your bank, **** of America, received funds and they even provided a confirmation number. This method and your email had been used successfully with 3 other payments.

a simple phone call to **** of America with my confirmation number could resolve all of this. You had previously said this was above your pay grade to check into this. Someone needs to call **** of America and give them the confirmation number .
