I purchased a truck from an individual party that had financed with Dakota Financial of ***********. I paid him in cash so he could make the wire transfer *************** they are making me wait 30 to 45 days for the title when the Secretary of State of Illinois says I have 20 days to register the vehicle. My husband financed 2 bobtails with Dakota. No moving permit or legal paperwork was given to him. They expect my husband to go to *** and get a moving permit - which DMV advised that this is something they had to provide to us so we may take the vehicle to inspection. We have been calling and requesting a call back from ******* ********* and she just responds with emails. This company is racist towards Hispanics because they are not helpful if you speak Spanish or limited English. The vehicles have been sitting not generating money for almost a month but they are expecting their first payment already. And by the looks of it the person answering the complaints has an excuse for everything. We are tired of dealing with them and would like to cancel the contract since they are of no help and just money hungry. This is not the way to take people's hard earn money.Business Response

Moving permits or temporary tags are only provided by dealerships that have a valid dealer license or by a local DMV/County Office. Since Dakota Financial LLC is not a dealer, we are unable to provide a moving permit. It is a process to transfer the title from the previous owner to the customer's name. The customer's first payment is set 30 days from funding with that understanding. This deal was funded on 10/24/24 and their first payment is scheduled for 12/5/24. The Dakota title department reached out to the customer as soon as the titles were received from the vendor on 11/12/24 and followed up again on 11/13/24. Lastly, Dakota Financial LLC has many Spanish speaking representatives available to customers and the specific representative that spoke with the customer, ******* *********, speaks Spanish.Initial Complaint

My husband purchased a semi truck from Diamond trucking Dakota is the finance company who approved him for the loan. First year with Truck we put in $13,000 due to DPF system and had transmission work done. We did explain that to Dakota financial they didnt want to wave none of the late fees the truck was in the shop for three months. We did explain that to them. My husband finally paid off the whole Truck. I asked if they can send paperwork showing that the truck is paid off. They are holding the The title on the truck because we have late fees the representative that was helping us made an agreement with my husband that he will pay $200 every two weeks My husband was making the payments. The Customer *** told my husband she was going to wave $1000 off the late fee make him owe only $710. Week of the 13th of this month my husband was supposed to make a $200 payment he call her an told her that the truck was in the shop and he will making the payment this Wednesday 9/25. She put a repossession on the truck that we only owe $710. I called and ask the representative questions about what happened to the agreement that they made? She basically told me since I called The thousand dollars that she waved shes putting it back on the account. I asked her if she can please send me paperwork of all payments that we made on the truck she havent she told me shes not doing it. I checked my husband credited report. Theres no information showing that he even made payments on this truck. Theres no Dakota financial even on his Credit. She basically told me shes the only person that he can talk to theres nobody else that will handle his account every time my husband call and try to get another representative. Nobody would help him. I purchased a commercial vehicle through this financial institution they said they was gonna get vehicle inspected before final purchased got vehicle purchase complete drove for 1 close to 2 tranmission went out after paying ***** down started running late with payment trying to recover from major break down explained the situation over and over why I was late this morning ready for work vehicle been repo which I tried make payment yesterday but lady in who handle delinquent accounts is hard to contact unless she calls you to be rude called to make payment couldn't do so emailed her after couple times calling and me and her had talked earlier on phone and I told her I was gonna make the one payment of 900 dollars and that would only leave me oweing for the payment due from the 15th of June that would have brought me back current after the repairs to now costing me days from work and possibly high recover expenses if able to recover. Dakota Financial doesnt independently inspect the equipment but provide financing based on what the customer and dealership tell us about the state of the equipment. We try to assist our customers through difficult ******************** situations and have worked with this customer over the last 9 months constantly calling and texting to make arrangements for payment. The customer's account is past due and after we made multiple attempts to contact the customer without response, this customers unit was repossessed due to failure to make payment. The customer can contact his assigned ******************** representative for information about recovering the unit.

Dakota Financial is making harassing and life interfering threatening calls to my personal cell phone which I use for work survival. I personally never incurred a debt, loan and/or financial obligation which is connected with Dakota Financial. I talked to Dakota Financial employee who advised calling me not due to any debt I personally incurred, but only due to Dakota Financial belief I may be a relative of ******* *************************. ******* ************************* never used and/or any connection to my phone number. Additionally, I have NO legal obligation for any debt incurred by ******* *************************. Of most significance ******* ************************* is deceased which I advised the Dakota Financial representative. I am writing to formally lodge a complaint against Dakota Financial concerning several serious issues regarding a commercial loan I secured through their institution. I believe that Dakota Financial is engaging in predatory lending practices and has not adhered to the agreed terms of our contract, specifically relating to the use of down payments and the calculation of balloon payments.In November 2022, I entered into a contract with Dakota Financial for a commercial loan. As per the agreement, I made a substantial down payment with the understanding that this amount would be directly applied towards the principal of the loan. However, it has come to my attention that these funds were not processed as agreed, and instead, the full loan amount remains outstanding.Moreover, despite making consistent on-time payments for the past 15 months, the balloon payment that was agreed upon at the conclusion of the contract term has been unjustifiably increased. These practices suggest a lack of transparency and integrity in Dakota Financials dealings and indicate a model of business that could be deemed predatory. This is especially concerning given the financial impact it has on businesses and the potential violation of ethical lending practices.Thank you for your attention to this matter. The Equipment Finance Agreement clearly outlines the terms of the agreement. By signing the agreement, the customer is acknowledging they have read and agree to the terms. Dakota Financial never represented anything other than what is stated in our contract.
The Early Payoff Agreement referenced was specific to The day after making 12 timely payments and prior to the next scheduled due date. The customer failed to payoff in the stipulated timeframe. Instead, the customer requested payoff after his 16th payment and received the standard discount. If the customer had called to discuss the Payoff Letter, we could have considered a special discount.Customer Answer

Thank you for your response and for clarifying the terms of the Equipment Finance Agreement and the conditions regarding early payoff. I appreciate your commitment to transparency, and I acknowledge my oversight in not meeting the stipulated timeframe to qualify for the special early payoff discount.
Upon signing the agreement, I understood and agreed to the terms outlined. However, during the course of these payments, certain circumstances arose that inadvertently delayed my ability to request the early payoff between the 12th and 13th payments. I am writing to respectfully request if we could revisit this discussion, considering my commitment to fulfilling my obligations under our agreement promptly and my track record of making timely payments.
I understand that Dakota Financial values its customer relationships and sometimes considers special discounts under exceptional circumstances. Although I missed the initially stipulated early payoff period, I am hoping we might find a mutually agreeable solution that acknowledges my intent and proactive engagement.
Would it be possible to send another early payoff quote with a fair price? I am eager to resolve this amicably and continue my relationship with Dakota Financial.

I PURCHASED 4 HEAVY DUTY *****S UTILIZING DAKOTA FINANCIAL LLC. DURING THAT TIME I WAS CHARGED FOR FORCED INSURANCE WHEN I HAVE FULL COVERAGE INSURANCE ON ALL OF THE ****** I NOTIFIED DAKOTA MANY TIMES THROUGH E MAIL ALONG WITH PHONE CORRESPONDENCE THAT WE HAVE INSURANCE AND THEY STILL CONTINUED TO CHARGE ME. THIS IN TURN CAUSED MY ACCOUNT TO BE PAST DUE BECAUSE I REFUSED TO PAY FOR INSURANCE THAT I ALREADY HAVE. ON JANUARY 1, 2024, DAKOTA SENT A COMPNAY TO REPO THE *****S. THEY TOOK ALL OF OUR PERSONAL BELONGINGS THAT WERE IN THE ***** AND REFUSED TO GIVE THEM BACK. ONE OF THE *****S THAT WAS TAKEN WAS PAID OFF PRIOR TO THE REPOSSESION OCCURING AND REFUSED TO GIVE US THE ****** THE REPOSESSION COMPANY ALSO DENIED ME THE OPPORTUNITY TO RETRIEVE MY PERSONAL ITEMS FORM THE VEHICLE STATING THAT DAKOTA WAS NOT ALLOWING ME TO RETRIEVE MY BELONGINGS. The customer stopped making payments on all of his accounts, which is why the trucks were repossessed. The customer has 2 accounts with us.
For ID# *****, the last payment paid that cleared was 10/15/2023 which covered their September payment.
For ID# *****, the last payment that cleared was for a partial payment on 12/25/2023.
Customer was unresponsive to our attempts to work out a way for him to get current. The customer was not repossessed due to Forced Placed Insurance. He was being charged for this due to his failure to submit the current COI, as the last information we received from his insurance company was that the policy had been cancelled. Multiple attempts were made to obtain this information from the customer and we never received the updated/current policy.

I have paid my loan at least twice and theyre still collecting money from me $140 every 2 weeks theyve made probably $2500-$3,000 from me for a $900 loan and theyre still telling me that I owe thousands this cant be right and they wont stop taking the money out of my bank account they have made thousands from me and theyre going to continue to make it because they keep taking it on my account and this is not fair. $280 a month is not fair when Ive already paid off the loan many times my family is suffering from the amount of money Im paying out because Im not able to buy my daughter things that she needs.Business Response

I checked my credit report here today on 8/10//2023 Dakota Financial LLC whom I have never had any dealings with put a Hard Inquiry on my credit report. I have never called/contacted this company nor have I ever spoken to anyone who works at this company. I am not sure what is going on but I will be getting to the bottom of this situation.Business Response
