    Late paperwork on their part slowed the process of me picking up a tractor trailer I bid for with ******* **** auction. I was not able to drive the truck on time as an owner operator with a planned income on $3k-$7k take home income As a result they gave me an extension then did not honor the extension of 3-15-23 and have threatened to repo my truck if $2,500 wasnt paid by the end of today 3-6-23 and keep my $8,500 deposit. The 1st payment of $1,847 should have been after they sent me the registration info like they intended

    We never made any such promise to the customer, as we do not allow ****** extension on payments.  He has also refused to make good on any of his promises to make the payment.  He is also verbally abusive to our staff.  Due to failure to maintain payments, we will be forced to send out for repossession.

    He also failed to complete the title process, which is a stipulation on the lease agreement he signed.  This too has caused a default in the agreement.

    Customer needs to pay past due balance and complete the title process in order to prevent his equipment from being repossessed.

    I bought a truck from *************** in October 2022 for $32,000 and gave a deposit in the amount of $12,800 to Dakota. I called recently to get a payoff amount and theyre telling me I owe $32,000 which is much higher than the amount financed. I wish to get a refund.

    The Finance Agreement the customer signed was for 36 monthly payments of $1,108.00.  The difference between the amount that he borrowed and what he owes is the cost of the financing.  The terms of this agreement are clearly outlined in the contract and terms were also explained to him during the process.  If customer didn't agree with the terms, he could have decided to not sign and we would not have funded the deal.

    We sent out a wire payment for a down payment on vehicle. We asked to be refunded. As we decided to go with another company. Asked for a refund. They refused to refund me back. This fraudulent service and scammers. No service was provided. They exact amount of **** ******* They are used by a third party service named fresh start and commercial fleet financing. Would someone please investigate this company

A Check Request for that refund was submitted to our accounting team that same day. It should have been in our 11/9/2022 check run, as we only run checks on Wednesday's, but it was missed. It is expected to be cut on 11/16/2022 and sent to him via *****. At no time has anyone at Dakota Financial, LLC refused to honor the customer's request for a refund. Did not reach to provide and update. Still no information my refund. This business has a bad reputation for the**** already.     Business Response /* (1000, 8, 2022/10/28) */ Dakota is a commercial asset-based lender who receives credit applications from vendors on the request of financing from their customers, just as most financial institutions. Dakota Financial, LLC does not independently inspect or warranty any equipment a customer asks us to finance for them. All promises made between the customer and their vendor is solely between those parties and are not supported or guaranteed by Dakota Financial, LLC. We rely solely on the signed agreement between the customer and Dakota Financial, LLC. This customer signed multiple Dakota documents that clearly stated Equipment Lease Agreement which outlined the terms of this agreement. Dakota Financial, LLC never represented anything other than what is stated in our contract. We had a verbal review of the contract with the customer on 6/16/2022 before funding the transaction to ensure the customer wanted to move forward with this transaction even though they had not seen or driven the equipment and they were clearly aware of the terms of the contract. At no point on that call did the customer raise any concerns or confusion at that time. The customer contacted our office on 8/30/2022, over 60-days past funding to notify us of mechanical issues with the equipment. We referred them back to their vendor and reminded them that we do not independently inspect the equipment and any disputes are clearly between the customer and their vendor. We offered either a Voluntary Surrender of the equipment as well gave more time to make a decision and the payment that was due at that time. On 9/12/2022, customer informed Dakota Financial, LLC that they would be keeping equipment and set up a payment plan to make one-half monthly payments every Friday, with Tanika, to get them current by 9/30/2022. The customer failed to make those payments and a legal notice was sent to them. This customer is currently in possession of the equipment, 64 days past due and no longer making any attempt to satisfy the terms of the contract. If customer would like to surrender the truck, they simply need to contact our office and we will be happy to give them a location closest to them to return it to. We have offered this to them, but to-date, no action has been taken by the customer to resolve the issues with their account with Dakota Financial, LLC.

    On September 6 which is today at 11:30 ish I was awaking by a phone call from **** at ****** ********** He started off by saying that he was following up with me about bank info I respond by saying I was just getting up out the bed that I will call him back he went on to ask for a date I continue to say I can't give u one at the moment I am getting out of the bed I will call u back after my fourth time he got aggressive over the phone saying he needed a date I ask was something wrong with him or he must don't understand he continued to go on about a date I hung up in his face. **** it's like I'm being ******** by them when it come to doing business with them. Then after things didn't go his way which is after I hung up he text and *********** my saying if I don't make my payment on the 15 of this month that he will put my trucks up for repo until I can provide bank information which is not protocol. I'm tired of the threats about repoing cause he is argue or things didn't go his way. Something should be done about this **** I've been a good paying customer for going on two years now is this how I deserve to be ******** I assume not.

    Business Response /* (1000, 5, 2022/09/07) */ This customer needed to change his banking information, for payment purposes, and made a request with one of our representatives on 8/29/2022 to have him call the customer back on 9/6/2022 to obtain that information. That representative did so on the requested date, during normal business hours, per the customer's instructions. I do apologize if the customer felt that our representative was aggressive. We strive to show respect, even during difficult conversations, to our customers. We fell short in this occurrence and will make sure to improve in the future.

    The contact they sent me in the email does not match the contract on the electronic DocuSign . They switched up the contract and added hidden fees and taxes at the last minute. Also damaged my credit report by doing a hard pull 2 times

If they had signed any contracts through DocuSign, they would have been the same ones we would have sent them once we had countersigned it. They applied for financing in late June 2022 at which time, we pulled their credit. They then applied for credit a second time, through another dealership, more than 30 days later, which meant we had to pull their credit again. All applications state that we do pull a hard inquiry, so the customer was aware of this at time of application. These were two very different pieces of equipment, and we offer the type of agreement that meets our criteria. All Dakota Financial documents clearly outlined the terms of the agreement. Dakota Financial never represented anything other than what is stated in our contract. No customer is pressured to accept our financing, which in this case, the customer decided against moving forward on both separate approvals. This customer can go to any other commercial financial institution to get the financing they are looking for.     I purchased a Semi truck, here in Tennessee. Tennessee has no sales tax on commercial vehicles, if used for commercial purposes, like transportation of general freight. When I was at the sales lot and the salesman was writing up my deal, I said, how much is sales tax ? He said, Tennessee has no sales tax on commercial vehicles. When I went to county clerks office to do application for title, they confirmed that my purchase was sales tax exempt, since I use it commercially. Yet, now Dakota is trying to charge me 106 dollars a month for 3 years, for Tennessee sales tax. I have sent them proof and tried my best to explain this to them, with no results

We explained to **. ******, that without a Tennessee Tax Exemption Certificate, we would be forced to collect the tax that his state requires. We directed him to the Tennessee Department of Revenue for any additional questions or for Tax Exemption application. Dakota Financial is obligated to follow all local, state, and federal tax laws based on the state of residence of our customers. If **. ****** does get approved for the Tennessee Tax Exemption Certificate, all he will need to do is send us a copy and we will then be able to stop collection of the Use Tax. After I talked to numerous people at Dakota, I finally reached someone who explained to me it wasn't sales tax, it is a use tax.     Dakota Financial has taken my down payment of ********* on a Commercial vehicle purchase from Ohio Truck Sales in Sandusky, Oh. They led me to believe that they were financing this truck purchase at the time of purchasing this truck. I gave OTS ******* dollars to hold the truck and I brought a ********* dollar cashiers check from my bank for the down payment on the loan. The list price for this truck was ********** There should've been ********* plus financing owed on the loan. After the truck was bought and brought to my house, I was then led to believe the first year of the "loan" was a lease. I feel like dirty play has taken place to fraudulently steel the ********* dollar down payment and they are getting away with this same practice from other consumers per reviews. I would like for you to investigate Dakota Financial for fraudulent practice against truck driver consumers by stealing our down payments to purchase trucks from Dakota Financial accomplices, ****** Brothers, Ohio Truck Sales and whomever else that does business with this so called finance company. I want my money back and all the payments I've made on this piece of equipment. I did not receive this so called loan document until after the truck was purchased and brought home.     Business Response /* (1000, 5, 2022/06/22) */ Many of the claims made by the consumer are patently false. The customer signed his contract on 8/13/20, and it was funded on 8/24/20. No transaction would ever be finalized and funded without a signed contract in place. It would be impossible for the customer to sign a contract they never received. The customer appears to be upset because his contract is currently in default due to past due payments, abandonment of the asset, unauthorized accrual of fees aqainst the asset. Unfortunately we are not in a position to return any payments made on a contract that is currently in default.
