I have attempted to reach our client three times and unfortunately,I was unsuccessful at reaching her, although and fortunately, one of our representatives was successful at reaching the client and from my understanding, we are assisting her as best as we can. Unfortunately, our clients account is severely delinquent and its important to know that Calfund LLC and the client, must come together with a mutual agreement to resolve the past due matter. As of today, we have successfully come together with a mutual agreement and are working together to avoid the loan going into further default. Purchased a vehicle from Penske Commercial. Apparently Penske work's with Calfund for financing. The van sold for $20558. I gave a downpayment to Calfund of $8668. Honestly, I dont even know what the original loan amount is because I NEVER got the paperwork that I signed. What Calfund did give me was a letter with a monthly payment amount of $1025 per month. I recalled while signing that the term maybe is over 24 months. That should have been my first red flag. I made the first two (1/2024, 2/2024) monthly payments (then business dropped) and I became late. I made another payment of $1290 to cover the late fees for the 3rd payment (3/2024). However, business got worse and I became even more delinquent. The last payment Calfund collected from me was $1025 in August (for 4/2024 payment?). In between these occurrences, it caused them to call trying to collect the debt and saying $8168 is past due. Also, threats to repo the van and I am going to be arrested. What I simply replied for was the original paperwork and terms remaining balance. I still never got it. It wasn't until I got an auto message from Calfund that triggered me. The email stated I had a remaining balance of $21500. How? What amount am I financing? What happened to the downpayment being applied to the finance purchase price? I know I should have asked that at signing but when I crunched the numbers, they have me paying more than double the payments or a ridiculously high interest rate (<80%). I contacted the company for an explanation who again threatened me to pay the past due amount before they do any investigating on there side. Because "its Calfund policy is we do not have to send any paperwork on past due accounts." At this point I should have paid about $13050 on the truck. I also uploaded a reverse loan calculation which show what crazy interest is on the monthly amount over 2 years to match what maybe is the amount financed.Business Response

"I financed my 18-******* through Calfund and deeply regret it. The truck was priced at $40,000, and I put $20,000 down upfront. I signed a two-year lease agreement with Calfund. Unfortunately, after my dad had a stroke and my grandmother passed away, I faced some difficult times and decided to leave the trucking business. I found a buyer who was ready to pay off the truck in full. However, because I was one month behind on payments, the company refused to provide me with a payoff amount to give to the buyer's bank. ***** and ***** were extremely rude, hanging up on me and saying they didnt believe I could pay off the truck, so they wouldnt provide a payoff amount. When I asked to speak to their managers or supervisors, they insisted they were the only people I could talk to and refused to escalate the issue, hanging up on me again. I repeatedly called back, even having the buyer on the other line ready to pay, but the account managers still refused to give me the payoff amount.Now, the truck is up for repossession, and they've already reported it on my credit as a repossessioneven though the buyer was ready to pay off the loan in full. Calfunds refusal to release the payoff amount has put me in an incredibly difficult situation."Business Response

In the recent past, Calfund worked diligently to assist the customer to avoid any activity on the customers loan. We assisted the customer with an extension and went so far as to offer them another extension to avoid any further activity. Eventually the customer decided to surrender the vehicle due to having the inability to make payments. Unfortunately, it is Calfunds policy to avoid providing a payoff to any past due accounts. If the customer was current, we wouldve been able to assist them. In the case of repossession,the customer is capable of having his buyer pay off this loan, retrieve the vehicle and repair his credit. Im not sure how these people are even still legally in business not just my complaint but all 100s of others are similar situations I have been through if not all considering I have financed multiple trucks through them at this time they are illegally charging me fees on a electronic system that I have no clue what they are and are refusing to explain the fees my ledger they send me does not match the requested amount on there electronic portal they even told me they are not going to explain them send me documentation pay it if its over paid they will add to another acct I am behind right now because they threatened to repo me when I was current with proof because they said they were missing Dec payment when I showed they proof they changed the month as I have read they have done this same thing to others when you try and resolve the problem or get documentation they refuse and start an argument with you I am mentally and emotionally drained from these people they need to show me why there system shows 909.71$ more then what I owe them I am not going to pay something they refuse to explain and there excuse pay it we will Figure out later this is the main issue at this time they even refuse to take my payment saying Im in repo meanwhile I have been trying to pay them but they will not explain charges to meBusiness Response

Greetings,This business has failed to release my titles to my vehicles. For the past 12 weeks I have been attempting to get a straight answer from the his business. I have spoken to a few different people. I have some names and dates if needed. They have since added fictitious fees to the account and when asked about said fees have failed to provide substancian for them. I was told in December 2023 that my titles had been mailed out and to allow additional time due to the holidays. Some employees there are rude and unprofessional. I would like to discuss the account ledgers they provided and to be told what the new additional fees cover since they were added on one of the dates that I called to inquire about my titles and on that date was asked to allow two more weeks for the mailing time. The account ledger they provided for account ***** shows a duplicate charge/double charge for the title fee. When asked why there are two fees charged the young lady ******** ext. 135 stated she was unsure but she would get an answer and I have been waiting since the 3rd week of Feb 2024. I continue to leave messages for her and her boss ****** ext. ********************************** two weeks ago. When I asked about the account ***** additional fees added, she stated that we should work on one account at a time. I asked her to atleast take down my concerns and forward them so that one I was able to speak to someone I could get my entire account/issues addressed and resolved. It shows that they are attempting to collect some $15 fees that have already been remitted/paid. Please PLEASE PLEASE PLEASE HELP!!!! They are causing a financial haurdship for my already crumbling SMALL Business. I am the spouse of a Disabled American Veteran and I am trying to keep us and our small family afloat and need the titles to sell these assets so we do not get any further behind.Business Response

I have been assisting our client to calculate the math in regards to what is owed on both loans. I have agreed to waive a late fee which seems to have been added after the principle balance was paid. We are pending to see if a title fee was duplicated and if so, we will waive this fee as well if proven that it is a duplicate charge. I am rejecting this response because: I am as told in 4/5/2024 that they would be doing some research into my issues(double charge for title fee; Loan *****) and I have not received a call nor email to date. I have left a voicemail for ****************.
I did appreciate **************** stating that they would be removing some penalties/fees that posted to my account after the close out date/timeframe.I am looking forward to speaking to and working with **************** again to finalize this matter and finally receive my titles for my vehicles so my business can move forward.

I paid the amount due per the payoff notice within the time frame on the pay off notice. I have tried unsuccessfully to get information on when the title will be delivered and confirmation of delivery address, however my emails go unanswered. I have an open case with the *********************** of PA and will be putting in a subsequent complaint as this company is an absolute nightmare and should be shut down. They are ripping consumers off, have poor customer service, misleading information, and shoddy business practices.Business Response

Got a email my truck was gonna get repo while in the shop! Never got a letter from Calfund or was offer a chance to pay the amount to become current with my balance and now after picking up my truck and not notifying me I had to call the shop and found out it was picked up got a email months now saying my truck was sold and the remainder balance they need from meBusiness Response

We attempted to reach our client in the past and unfortunately the phone number in our file was disconnected. The repair facility ***************** also stated to us that they could no longer reach the customer and requested that someone recover the vehicle which we had to do or face the consequence of having the repair facility lien sale the vehicle. We attempted to reach our client by email as well although we were unsuccessful. Eventually the vehicle was recovered and a notice of intent letter was mailed to the customer.
After receiving the ******************** compliant I attempted to contact the customer but the phone number is disconnected. I attempted to reach the client with the Daytime Phone Number provided to the BBB complaint and I left the customer a message and sent them an email as well. We have not heard back from them unfortunately.
To best answer the clients questions, the vehicle was recovered due to being abandoned at the repair facility. Once recovered, we notified the client via email & mail for the options of recovery. The vehicle sold 26 days afterwards. Calfund LLC notified the client to the best of their ability. Unfortunately, there is no option to refund the customer any funds. In fact, the customer still owes ****************** LLC the deficiency balance.

Calfund LLC repossessed the truck but didnt send mail to me to inform me that the truck had been repossession and what rights I had to get it back. They went ahead to sell the without informing me of sale date and location. They continued to conceal sale information until I contacted them via email more 6 months later requesting for information about the truck since I had not been contacted on auction date.I still need explanation on why the truck was put into auction without being informed and be given an opportunity to get it back or bid for it at the auction?According to in-house counsel *****, the truck was sold for $10,350.00 only which is $61,000 less than the purchase price. Why was the truck sold at such significantly low price for a 2016 Freightliner Cascadia and less than ******* miles? Who purchase it? Where was auction conducted? The customers request for a copy of his Notice of Intent form for the repossession of the vehicle was mailed on 6/2/2023. We have resent him a copy for his records. Due to his request, we have also sent him a copy of the Bill of Sale for the vehicle. This shows the subtraction of funds towards his loan. On 6/28/2023, a representative for Calfund "***************************", spoke to the client about redeeming the vehicle in which he stated that he would call us back to see if he could pay the redemption fee in which we informed him that without the redemption, Calfund would sell the vehicle at auction. We contacted him several times prior to selling the vehicle and unfortunately we did not receive a return call from him. Finally, on 9/22/2023, 3 months later, the vehicle sold at the auction.
On 2/21/2024, our Legal Representative *********************** spoke to you and explained all of this including the reason for the vehicles sale value. The auto auctions bid on vehicles and unfortunately, we have no control of what a vehicle will sell for at an auto auction. I believe that all of your questions were answered including who purchased the vehicle, which it states on the Bill of Sale. We hope that this resolves in further issues &/or questions.

Calfund breaches an extension of payment by sending the extension having us sign the agreement and emailing it back on October 30,2023 then on October 31,2023 requested updated insurance on the vehicle which was still covered on October 31,2023 Implying the extension agreement was valid when it was their intention to never honor the extension agreement but not advise us of this matter and still try to ACH the bank account as if there was never an agreement signed or discussed.Business Response

After receiving this complaint, I contacted the client and explained that our review process does not provide a rapid turn-around timeline.I explained that there is a lengthy process and I explained that Calfund LLC was still in mid-process to finalize the review of his Extension Request. Unfortunately,due to this, his auto-payment was processed 2 days later. The client advised me that he disputed the payment due to this. I explained to him that this was fine since I was going to assist in speeding up the Extension Process. After further review, we were able to push the Extension Request sooner thus assisting our client with the Extension Approval.Customer Answer
