    I saw a report on my credit account for collections. I was in no way aware of an unpaid bill and never received letters. (I moved a few times in between) I paid the balance in full and even received a letter stating the balance was paid in full. Today I got a call for the same debt (from no caller Id) and threats to report my debt to my credit. Please advise. This debt has already been paid. I do not want to impact my score.

    The original creditor listed on the account is **************************** Corporation and the open date is October 17, 2017, and the open amount is $16,735.66.
    Cascade Capital Funding, LLC and *************************, **** are two separate companies with no affiliation to one another.

I am writing to bring to your attention a matter of significant concern regarding the recent report of debt stemming from ***************** visit to ********************.To the best of my knowledge, I have not provided consent for the sale of my personal information to any external entity, nor have I engaged in any transactions with your organization. Nevertheless, I have experienced persistent contact and unwarranted threats from your company, resulting in adverse implications on my credit report.It is crucial to note that, according to ***** laws, medical debt can indeed be sent to collections agencies. This is not mine;2.) I have never visited/been treated in that Hospital (they closed doors in 2020)3.) I had my identity stolen in 2015 (attached copy of police report and affidavit) and had to clean up a big mess during 2018-2019. I assume this is a late surfacing hit from same cons 4.)     Cascade Capital, LLC is in violation of my rights under ***** and Federal Law. Specifically the law under Sections ****** of the Texas Civil Practice and Remedies Code, Section ******* of the ***** Finance Code and Title 12, Section ******* of the Code of Federal Regulations. Specifically, Cascade Capital, LLC has failed to disclose if the medical debt is time-barred, whether or not the limitations period has expired and whether or not they are threatening suit. All of these are required under ***** and Federal laws. I am attaching a request for explanation and validation of debt along with the Debt Validation Letter from company to show that Cascade Capital, LLC have erroneously sent me a debt for a medical bill I have no knowledge of and without itemization of the debt. Furthermore, the law requires prior contact from the original debtor that the debt existed within 11 days of the following month. Since the original debtor and Cascade Capital, LLC have failed to inform me that the debt existed prior to filing a collection on my credit report. I am requesting that Cascade Capital, LLC remove the information from all 3 credit bureaus following the resolution of this matter within 30 days.

    I am writing to express my dissatisfaction with the response provided by Cascade Capital Funding, LLC (CCF) to my complaint. Their reply not only fails to address the core issues but also contains factual inaccuracies. I have enclosed detailed explanations supported by exhibits for clarity:

    Exhibit A

    In their response they state that,

    "Cascade Capital Funding, LLC (CCF) is not a data furnisher as defined by the Fair Credit Reporting Act and DOES NOT report accounts or debts to credit reporting agencies." furthermore "CSC and CCF are not data furnishers as defined by the Fair Credit Reporting Act and DO NOT report accounts or debts to credit reporting agencies." 
    The response goes on to state, "CMC records show that ************** has disputed the accounts. Due to **************** disputes, CMC sent a request for verification of debt documents to CCF, and those documents were sent to CMC on January 9, 2024, to send to **************. ************** confirmed receipt of those documents as she attached both to her complaint that was submitted."

    My Position
    In their response, CCF denied being data furnishers under the Fair Credit Reporting Act (****) and claimed they do not report accounts or debts to credit reporting agencies. However, their subsequent actions contradict this assertion. Despite their denial, they sent verification of debt documents to the credit monitoring company (CMC) in response to my dispute, which directly implicates them as data furnishers. Attached credit reports confirm that CMC reported the disputed accounts to all major credit bureaus based on the data furnished by CCF.

    Exhibit B

    The response also failed to address ***** and Federal Law, Section ****** and Section 605, Fair Credit Reporting Act (15 U.S.C. Section 1681c) which states that the statute of limitations on medical debt in ***** is 4 years.  They have identified that I, *************************, am a ***** resident and that the service was incurred in *****. Furthermore, if the services were rendered on 7/06/2019 then the statute of limitations expired on 07/06/2023.  CMC placed the debt on my credit report as of 12/06/2023, well after the statute of limitations had expired. 

    In their response they have identified themselves as a debt purchaser. According to Finance Code Chapter 392, Debt Collection: Sec. 392.307.  COLLECTION OF CERTAIN CONSUMER DEBT BY DEBT BUYERS. the law states:

    " (a)  In this section:
    (1)  "Charged-off debt" means a consumer debt that a creditor has determined to be a loss or expense to the creditor instead of an asset.
    (2)  "Debt buyer" means a person who purchases or otherwise acquires a consumer debt from a creditor or other subsequent owner of the consumer debt, regardless of whether the person collects the consumer debt, hires a third party to collect the consumer debt, or hires an attorney to pursue collection litigation in connection with the consumer debt.  The term does not include:
    (A)  a person who acquires in-default or charged-off debt that is incidental to the purchase of a portfolio that predominantly consists of consumer debt that has not been charged off; or
    (B)  a check services company that acquires the right to collect on a paper or electronic negotiable instrument, including an Automated Clearing House (ACH) authorization to debit an account that has not been processed.
    (b)  Unless otherwise expressly provided, this section prevails to the extent of any conflict between this section and any other law of this state.
    (c)  A debt buyer may not, directly or indirectly, commence an action against or initiate arbitration with a consumer to collect a consumer debt after the expiration of the applicable limitations period provided by Section ******, Civil Practice and Remedies Code, or Section *****, Business & Commerce Code.
    (d)  If an action to collect a consumer debt is barred under Subsection (c), the cause of action is not revived by a payment of the consumer debt, an oral or written reaffirmation of the consumer debt, or any other activity on the consumer debt.

    My Position:

    CCF's response overlooks pertinent ***** and Federal Laws, particularly Section ****** and Section 605 of the ***** According to these statutes, the statute of limitations on medical debt in ***** is four years. As a ***** resident, I am protected by this law. However, CMC placed the debt on my credit report well after the expiration of this limitation period. Moreover, as a debt purchaser, CCF is subject to Finance Code Chapter 392, which prohibits commencing actions against consumers after the limitations period expires. CCF's adverse collections actions on my credit reports post-expiration of the limitations period directly contravene this law.

    Exhibit C

    In their response they also failed to address Section 605, Fair Credit Reporting Act (15 U.S.C. Section 1681c).  This portion of the **** code is as follows: 

    (e)  If a debt buyer is engaged in debt collection for a consumer debt for which an action to collect the debt is barred under Subsection (c), the debt buyer, or a debt collector acting on behalf of the debt buyer, shall provide the following notice in the initial written communication with the consumer relating to the debt collection:
    (1)  if the reporting period for including the consumer debt in a consumer report prepared by a consumer reporting agency has not expired under Section 605, Fair Credit Reporting Act (15 U.S.C. Section 1681c), and the debt buyer furnishes to a consumer reporting agency information regarding the consumer debt, "THE *** LIMITS HOW LONG YOU CAN BE ***D ON A DEBT.  BECAUSE OF THE AGE OF YOUR ***** WE WILL NOT *** YOU FOR IT.  IF YOU DO NOT PAY THE ***** [INSERT NAME OF DEBT BUYER] MAY CONTINUE TO REPORT IT TO CREDIT REPORTING AGENCIES AS UNPAID FOR AS LONG AS THE *** PERMITS THIS REPORTING.  THIS NOTICE IS REQUIRED BY ***.";
    (2)  if the reporting period for including the consumer debt in a consumer report prepared by a consumer reporting agency has not expired under Section 605, Fair Credit Reporting Act (15 U.S.C. Section 1681c), but the debt buyer does not furnish to a consumer reporting agency information regarding the consumer debt, "THE *** LIMITS HOW LONG YOU CAN BE ***D ON A DEBT.  BECAUSE OF THE AGE OF YOUR ***** WE WILL NOT *** YOU FOR IT.  THIS NOTICE IS REQUIRED BY ***."; or
    (3)  if the reporting period for including the consumer debt in a consumer report prepared by a consumer reporting agency has expired under Section 605, Fair Credit Reporting Act (15 U.S.C. Section 1681c), "THE *** LIMITS HOW LONG YOU CAN BE ***D ON A DEBT.  BECAUSE OF THE AGE OF YOUR ***** WE WILL NOT *** YOU FOR IT, AND WE WILL NOT REPORT IT TO ANY CREDIT REPORTING AGENCY.  THIS NOTICE IS REQUIRED BY ***."
    (f)  A notice required under Subsection (e) must be in at least 12-point type that is boldfaced, capitalized, or underlined or otherwise conspicuously set out from the surrounding written material.

    My Position

    Furthermore, CCF, CSC & CMC failed to adhere to Section 605 of the ****, which mandates specific disclosures regarding the age of debt and the consumer's legal rights in debt validation letters. By omitting this information, they violated **** requirements. As a result, the placement of the debt in collections and on my credit report lacks legal basis.

    In light of these violations and factual discrepancies, I urge the immediate removal of the collections from all three credit bureaus. This request is justified by the following reasons:

    1. The collections were placed on my credit report despite being disallowed under **** rules.
    2. As per ***** Law, collections by debt buyers are prohibited after the expiration of four years, which occurred in June 2023.
    3. CCF, CSC & CMC failed to comply with **** regulations by not disclosing my legal rights regarding the debt.

    I expect prompt and appropriate action to rectify this matter.

    I received the reply yesterday from Cascade Capital and sent my response back over last night.  I disagree with their response in full.  They are stating that they did not put the information on my credit reports but were also notified of a dispute from my credit reports which is what prompted the verification of debt letter.  I am requesting that since the debt was not supposed to be place on my credit report that they remove them from all 3 promptly.  Please let me know if you need anything from me to get this resolved. I appreciate your help with this matter.

I ALREADY disputed another collection from Cascade Capital back in March that has since been removed, and I advised the ***************** that I do not and never did owe a debt for this agency, but here we are again with a NEW debt that is not mine that is ruining my credit! PLEASE REMOVE THIS FROM MY CREDIT REPORT! I have never been to and do not owe this debt from whoever or whatever health company this is!
