      My husband and I had put a deposit on a home began the loan process, within two week we unfortunately suffered hardship and were not going to be able to move forward with the purchase of the home. In addition to this, the documents requested by the underwriter we were not going to be able to provide, which would result in the loan not be granted. We then requested to cancel the transaction and it was assumed due to the loan issue we would be able to have our refund. We have yet to have the refund accepted, or refund issued this cancellation was requested on 8/22/22.

      I entered into a contract to purchase a home from *** Lewis (in *******, **) in April 2021. The home was scheduled for completion in November 2021. I accepted a new job that required relocation to ******, **. In November 2021, I presented the relocation letter to *** Lewis to understand how I would be refunded for my deposit (15k) and upgrades paid (approx 35k). The sales person said she couldn't guarantee what would happen and that they wouldn't even tell me until I signed the cancellation paperwork. I signed the cancellation form on 11/18/21 as I had no other options. I continued to follow up regularly (phone calls, texts, in person) to see the status of my cancellation and when funds would be returned to me. On December 18th I went to the sales office and I was told by the sales agent that the home had been re-sold for more than 100k than I paid. I said that was interesting as I had never received any executed cancellation document. The cancellation document was unsigned by *** Lewis. *** Lewis had sold the home that I was still under contract for. This was on a Saturday that I pointed that out and within hours I had a countersigned cancellation agreement and was told my 15k deposit would be returned. That check was cut on 12/21/21. For the last 2 months, I've sent 50+ emails, texts, voicemails to a variety of people at *** Lewis inquiring about the remainder of my money that they have and have not returned. No-one will return my messages on how/when the money will be returned.

      We returned ************************ initial ******* deposit of $15,000 promptly after her cancellation. However, as is conveyed in the purchase agreement, deposits paid for option upgrades are only refundable pending our ability to cancel them early in production or resell the upgrades to the next homebuyer. If we had to give concessions for options not desired, we would be losing money. ******************** was informed of this by our sales agent. The home has been resold, but due to supply delays is not closing until July '22. Since the delay is not the fault of ********************, it was decided in late February to refund her options deposits in full. Again ******************** was informed of this by our sales agent, who stated she was "relieved." The refund was processed, mailed, and the check cleared the bank on 3/14/22 Check #**** for $35,861.50. We hope this closes the issue and alleviates ************************ concerns.
