On October 11, 2023, Instant Checkmate LLC into a Stipulated Order for Permanent Injunction, Civil Penalty Judgment, and Other Relief with the Federal Trade Commission. The Order settles allegations that the business participated in deceptive and unfair acts, or practices in the promotion and sale of background reports. Under terms of the Order, the business was ordered to a fair credit reporting act monitoring program, prohibit business activities, prohibit misrepresentations to consumers regarding covered reports, injunction concerning misrepresentations in violation of section 5 of the FTC Act, required disclosures for unexpected material connections, monitoring of endorsers, and must jointly and severally pay a civil penalty in the amount of $5,800,000. The Order was for settlement purposes only and should not be considered as an admission of guilt or finding of violation of the law.
This action is final.
