Subject: Complaint Against Checkr for Failure to Block Fraudulent Information as Required by Law Dear BBB,I am filing a formal complaint against Checkr, a background check service, for failing to properly address and remove fraudulent information from my report despite the submission of required identity theft documents, including a police report and an FTC identity theft report.Background of the Complaint:I submitted the necessary documentation, including a police report and FTC identity theft affidavit, to Checkr as proof of fraudulent activity on my background check.According to the Fair Credit Reporting Act (FCRA 605B), Checkr is legally required to block any fraudulent information from my report within 4 business days of receiving a valid police report and identity theft affidavit.Checkr responded with an email stating I should dispute the information via their portal, however, this is not required under the law, as I have already submitted the necessary documents, and they are legally obligated to block this information immediately.Despite this, Checkr has failed to act in a timely manner and has not confirmed that the fraudulent information has been blocked as required by law.What I am seeking:Immediate action to block the fraudulent information from my report as required by FCRA 605B.Confirmation from Checkr that they have complied with the law and deleted the fraudulent information from my report within the 4-business-day timeframe.A formal apology for the inconvenience and a written explanation for their failure to meet the legal requirements.Please assist me in addressing this matter with Checkr and ensuring that they comply with the law. This company operated as a third party, hired by ******** to conduct a background check on me. Instead of doing their due diligence and ensuring that the public records check was actually accurate, they reported someone elses information that had a similar name which caused me to get an adverse action email from my employer (DoorDash). They reported I was a *** offender and was convicted of taking indecent liberties with several minors. The person they confused me with had the suffix ***** they looked completely different from me, was in a different part of the world from me, and had a different address. They reported the first thing they seen. This accusation is embarrassing and false. I disputed it with the company. However they are saying that I wi have to wait an additional 30 days which means I will lose income.Business Response

submitted a background check to Checkr on March 23, 2025, as part of my reactivation with ***** The status has been stuck in ******* for weeks, and the estimated completion date of April 4 has passed with no update or communication from Checkr.I am a returning Uber driver, not a new applicant. **** confirmed the delay is due to Checkr and that they are unable to proceed until the report is completed.I have attempted to contact Checkr multiple times through both their candidate portal and email support, but have received no real responseonly automated messages or deflection. I have not been given a reason for the delay, a timeline, or any meaningful update.This delay has caused direct financial hardship, as I am unable to work or earn income. An immediate update on the current status of my background check;

On April 1, 2025, this company started the background check process on me, and I was informed that the process would end on approximately April 10, 2025; however, I received an email notification that the background process was updated to end between April 17, 2025 and April 22, 2025. I have no criminal record, and the information I submitted to the company is accurate; therefore, it should not take three weeks for this company to perform a background check. I recently applied to become a driver with Lyft and cannot drive until my background check is completed. This is delaying my potential to earn income because Checkr is trying to find information on me that is not there.Business Response

From what I read, Checkr, Inc. checks national databases which would cause unnecessary delays to applicants' reports when I have live in the state of ************ for almost five years.

I drive for **** and once a year they require a background check for their drivers. Unfortunately they use Checkr. My background check was suppose to be finished by Monday 4/7. It is now Thursday 4/10 and it is still not finished. The problem with this company is that they automated everything which means if there is a problem there are no or not enough humans to find out what has happened. When I go on the candidate portal. It has shown no movement on my report for over a week. I know they will say they are waiting on something. They say they are going to email you more information but they never do. If you contact them through their app to inquire about your report you get a bot email in return. In short this company has no way to actually speak to someone. I have been down for 10 days with **** because Checkr cannot do their job. I average about $80 a day so their incompetence has cost me about $800. I need Checkr to do their job! I need to speak to a actual person about what is missing in this report so I can try to track it down myself. The we are waiting for something excuse isn't good enough. What are you waiting for and what are you doing to get it! Please see if you can actually speak to someone on my behalf. Also if they would like to compensate me for all the time I missed due to their incompetence that would be great. At least try to find someone who can give us some answers. Grub Hub, insta cart, fed ex and some other companies use checkr to check my background. Checkr keeps telling everyone my license is suspended. It's not. I have filed several disputes with the companies as well as with checkr numerous times. Each time I also submitted a current copy of my driving record proving my license is in fact valid. The ********************** people keep saying they put what was on the report but they didn't otherwise it wouldn't say my license is suspended. The companies I've applied to tell me I have to dispute it through checkr. They have cost me several jobs. There is no way to speak to a live representative to get this cleared up and now i can't even login to the website. This has been going on since November 2024.Business Response

Everytime I send a complaint along with copy of current driving record they always say the same thing. That what they have put on my report matches the ***. They aren't seeming to understand it's HOW they are wording it. Where it says type they have state ID valid and while that's yes true they are not clarifying that my license is also valid. What it looks like is just my state ID is valid and my license is suspended. All I want them to do is fix that.Business Response

I originally purchased a personal background check as I was starting a new role in December of 2024 with the indication on the website that this would be delivered to me quickly. It's been months now and the last communication I've received was that my report was being delayed until February. February hits, and still no report. I then reach out to support and ask for a refund as my company has run the background check for me and I no longer require this report, only to be met with "I will follow up via email with you." This company literally drags their feet during background checks. It doesnt matter that theyve already repeatedly done background checks on me in the past, and it doesnt matter that I have actively already received a fingerprint card as of this month from the department of justice this company alone doesnt really seem to know what theyre doing and has no answer as to why its taken beyond the estimated date in order to clear the background check that theyre doing when I reach out the individual I reached out to was more interested in trying to argue with me about many background checks I was going to need for the single company I work with then he was in actually resolving the issue of why the background check was taking so long its been at the same final step the entire time and it is genuinely excessive at this pointBusiness Response

Their background checks take excessively long, often attributed to courthouse delays. However, I found that the courthouse hadn't received my request until weeks after CHECKR initiated the process. This indicates internal delays.Communication is poor; reaching a human is impossible. They quote seven business days, then often extend it by another seven with no proactive updates.
