As of 3/28/2025, after the auction finalized and I was the winning bidder, the seller has decided to not complete the transaction. I have paid BAT the transaction fee and have not completed the purchase by sending the seller any of the money as he was out of town. I want to finalize the transaction but am not being allowed to by the seller. I need to be contacted by BAT ASAP!Business Response

Date of incident February 10th at 4:30pm It was reported to BAT on numerous occasions that a BAT member posted something that was not true and damaging to our seller reputation on BAT and to our licensed used auto dealership's reputation. The below comment. We have asked bat on several occasions to remove the comment. It can be proven that what the commentor "ssterry" has written/posted is not factual. We have flagged the comment. We responded to the comment telling the ************* and ssterry that his comment was not true and libel. BAT removed our comment but left the false comment. So for some reason BAT is protecting ssterry and censoring the truth of the matter by removing our defense comment as the actual victim here. This is the comment we request be removed and the link where the post or comment can be found.COMMENT: "Mr. **** attempted to sell a 1964 Chevelle on BaT as a matching numbers car, and found out the hard way that its easy on this site to get caught in a lie. Its too bad too, it was a very nice car and it would have done great without the embellishments."Business Response

Better Business Bureau:
I have reviewed the response made by the business in reference tocomplaint ID ********, and find that this resolution is satisfactory to me. Note: My dealership would not have cared so much someone blowing hot air in a comment, but what the commentor was insinuating could be construed as a felony crime of fraud with intent to deceive which never happened, and the record proves this. On the contrary, our dealership represented the car correctly and to best of our ability. It was never represented as "numbers matching" and we accepted **** *********** professional opinion on the matter and told ************* just that. The Chevelle in 1964 was not VIN stamped on the block and block was correct JD suffix and correct casting number and dated within 7 weeks of the Chevelle's build date. So while it had the correct numbers as a numbers car or period correct car. We NEVER said it was numbers matching and tried to be very honest and transparent about the car. Thank you BAT for removing the libel comment. We tried to resolve this directly with **** of BAT to no success. Sorry it had to come to a BBB complaint. Regardless, thank you for making it right. Better late than never.********************************************************************************

In January 2025, I won an auction on Bring-a-Trailer's website for a car with a listed mileage of 93k kilometers (58k miles), which is appropriate for the final winning bid of $39,500. I was charged a 5% fee of $1975.00 and I began communicating with the seller. When I flew out to inspect the vehicle in person, I noted that the car had some minor wear consistent with its age, which didn't bother me. However, the seller and I both reviewed the CarVX history report (like Carfax, but for Japanese imports), which revealed the vehicle to actually have 190k kilometers (118k miles) when it was last reported in March 2018. It is fair to assume the car has significantly more mileage by the time it was listed on Bring-a-Trailer. I'm not sure if the seller was being negligent or deliberately deceptive, but I backed away and we agreed to part ways from the sale.A representative for Bring-a-Trailer contacted me and stated that I was obligated to follow through with the transaction for the full amount of $39,500. I politely replied that, because of the misrepresentation of the mileage, I will not be moving forward and would like to discuss refunding my 5% buyer's fee. The representative quickly replied stating that "because of my actions, I put them in a difficult position", that they were working with the seller, and that the CarVX report could be for a different car. But because this car was modified, it was easy to reply with an overwhelming amount of evidence that the seller's car was indeed the same as in the CarVX report.Instead of replying further, my account on **********************-Trailer was quietly restricted and no further communication has been received. As such, I'm still out of pocket for the $1975.00 and hoping for a resolution.I understand that the condition of used vehicles may be considered subjective between parties, but buyers have a reasonable expectation to not be punished for the seller grossly misrepresenting their vehicle's mileage.Business Response

Thank you for reaching out. We are continuing to work on a resolution to this situation and will follow up as soon as possible. In general, it is true that bids are not contingent upon post-auction inspections and prospective bidders are expected to use the 7-day auction period to do the required due diligence prior to bidding.Customer Answer

I am rejecting this response because I have to provide a response to keep the complaint open. This is the end of Week 2 since inquiring about a refund and have yet to receive any meaningful communication - only that they are "working with the seller" from 5 days ago. I've noted that the seller on BaT hasn't created any new listings (they were frequent until then), so it's possible that a resolution is being worked about as BaT says, or perhaps the seller simply abandoned the platform. I'm not sure.
Unfortunately, I believe the next step is filing for a chargeback with my credit card company.

As noted in our earlier correspondence, any due diligence, including acquiring a ***** report, should have been done before placing a bid. Regardless of the validity of the CarVX report, your bid represented a commitment to purchase the car for a specific price, and we expect buyers to honor the commitments they make on the site.
We are continuing to work with the seller on a solution and will update you as soon as possible.

I am rejecting this response because: The seller posted a new auction today, so I'm inclined to believe nothing is actually being 'worked out with the seller', and that Bring-a-Trailer is just punting with the same canned response hoping I eventually disappear. And since the seller is back up and running, I'll be fully transparent Once I told the seller over the phone that I was backing out, without hesitation he told me "just don't reply to Bring-a-Trailer's emails and file a credit card dispute to get your money back". He said it so naturally that I'm convinced it was all part of a scam, and this was just the contingency in the event the buyer found something wrong.
I took a deep dive into Bring-a-Trailer across car forums and found a ton of horror stories similar to mine. Just shady business practice on both the seller and Bring-a-Trailer, and I will certainly steer anybody away from doing business with this website.

I purchased a car via auction on 11/29/24 . Bring a trailer (BAT hereafter) facilitated the auction and through a side company (Drive Caramel) was supposed to do the title transfer. Documentation was provided as requested for title transfer, and they collected fees for this service. However, today 1/3/25 I received notice that they would not be providing this service for me and hindered my ability to get my car registered by delaying the title transfer. I have also paid my state title and taxes through this company, and now my belief is I will have to pay these fees again if registering the vehicle myself.Business Response

We're sorry to hear you had some difficulty with the title transfer for the car you won. We've relayed this information to our partners at Drive Caramel, and they tell us that the fees have been refunded to you and provided you with the correct paperwork so that you can register the car correctly.Initial Complaint

I am a repeat client of BAT, I participated in one of their auctions by one of their dealers The dealer accepted a wire transfer of funds , paid in full. The Florida dealer took more funds for the sales tax, registration and title and issued a 30 temp plate that is expired. No extension template or registration received. I now have an unregistered vehicle. The dealer misrepresented the condition of the car on the listing, I have now invested over $3500 over ****** purchase price plus BAT ****** response from BAT on emails and phone messages. This is a very dishonest company. The internet is full of Bring a Trailer nightmare stories that is exactly what I experienced. The first experience was buying a car in September 2023 that was completely misrepresented. Additionally, I suspected but could not prove there were fake bids to just drive up the price. The last experience was selling a car in September 2024, where the buyer backed out, because I would not send the title and let him pick up the car before paying for it. The companys staff is completely unprofessional and dishonest and rips people off and gets away with it.Business Response
Date: 12/24/2024
We are sorry that you have been dissatisfied with your experiences on BaT. We discussed the vehicle you purchased in 2023 with you and the seller at the time, and we believe that we addressed your concerns adequately.
Regarding your recent selling experience, as we state in several places on the site, we offer a Verified Checkout process that provides a secure escrow and title service for interested buyers. It is the buyer's choice whether to utilize this service or to proceed with a direct peer-to-peer transaction with the seller. In this case, your buyer chose to use Verified Checkout. As part of the escrow service, once the buyer makes payment the seller sends the title for transfer, and upon receipt of the title the purchase funds are released to the seller. This process is explained in detail on our FAQ and in emails sent to sellers following their auction, and our **************** team also attempted to explain this process. *******, the company who we've partnered with to handle Verified Checkout, is a licensed auto dealer and is legally obligated to release funds to the seller upon receipt of the title or shipment of the vehicle.
When you refused to abide by these terms, the buyer understandably grew concerned and would not proceed with the purchase with you directly without the security of our process.
In no way did we "rip people off" or otherwise treat you or the buyer unfairly.

Bring-a-Trailer (BaT) runs an auction site that charged me $7,425 dollar service fee for the winning bid on a car that I intended to purchase for $148,500. BaT charges a 5% fee on the bid to maintain the integrity of their site and keep buyers accountable for placed bids. *** does not own the car, BaT does not sell the car, *** provides a service for a seller to curate their listing information and attract buyers for bidding. BaT edits the listing for clarity and presentation together with the seller. *** expects buyers to verify all information. Buyers expect the seller and BaT to not intentionally misrepresent the ********** my case, BaT is not entitled to their fee because with the seller they misrepresented the car by intentionally not including vital information that the car exceeds the height of the a standard garage door of 7ft. BaT told me this information is completely irrelevant to a substantial group of potential bidders. At 88 inches tall, the car they assisted with the sale is unusable by the majority of the population since most garage doors are 7ft high. They chose not to disclose this information, likely to improve the marketability of the auction listing. BaT claimed that by including other specs like ground clearance and water fording depth that a buyer should have awareness of height concerns. BaT also said the **** in on the buyer since they had 7 days to do their own due diligence. If that were the case then the final listing end should only be viewable by initial buyers. By not clearly starting this vehicle will not fit in a standard garage, buyers like me who came in at the end of the auction to bid only had time to read the listing, look at the bullets, and pictures to make a decision. I canceled the auction transaction due to this missing information by the seller and merchant. No goods were sent by the seller. Had BaT done their job of disclosing this information accurately then I would not have placed a bid to use their service.Business Response
Date: 11/26/2024
As noted in our FAQ, "How BaT Works" page, and elsewhere on the site, bidders are expected to do their own due diligence prior to bidding. That includes ensuring that an oversized vehicle (as this vehicle clearly is) will fit in their garage if desired, if the bidder is able to procure insurance for the vehicle, if the vehicle is able to be titled and registered in their locale, whether a vehicle complies with local emissions and safety requirements, etc. Though we make every effort to ensure that auction listings are written clearly and factually, it is impossible for a vehicle's seller or BaT to anticipate the needs of every potential bidder.
The auctions are run for a minimum of seven days to permit time for this due diligence to occur, and bidders should bid based on the information available to them at that time.

Complaint: 22595006
I am rejecting this response because the business should offer a sensible refund that is fair. The business response stated that the vehicle was clearly an oversized vehicle. However, the listing does not state the vehicle is oversized. It was not obvious to me this vehicle would be considered oversized for a standard height garage of 7ft tall. The specs in the listing states ground clearance and fording depths but these are achievable with vehicles that fit into standard garages (example of the modified Jeep Wrangle I own). By not clearly stating the oversized warning in the listing, this business has harmed the service it provided to me as a bidder. The business should take partial responsibility for marketing this listing to new bidders at the last minute of an auction while excluding the information a bidder would need to quickly consider that this vehicle is oversized. This vehicle does not fit in 80% of garages since a standard height is a maximum of 7ft.
Sincerely,
Zivthan *********Business Response
Date: 11/27/2024
It is not possible for Bring a Trailer to include dimensions on vehicles or be aware of a bidder's specific circumstances, and ultimately is the bidder's responsibility to use the tools available to them to ensure the vehicle meets their needs prior to bidding. Our fees are non-refundable.Customer Answer
Date: 11/27/2024
Complaint: 22595006
I am rejecting this response because, while it may not be feasible to include the exact dimensions of every vehicle in a listing, it is entirely reasonable to clearly state: "This is an oversized vehicle that may not fit in a standard garage opening."
This business appears to operate on the premise that withholding critical information is acceptable, even when such omissions mislead bidders. It is evident that the business has deliberately chosen not to include details in the listing that might negatively impact the vehicle's marketability. Furthermore, the no-refund policy enforced by this business violates California consumer protection laws, particularly when paired with deceptive advertising practices. The following laws underscore this point:
1. False Advertising Law (Business and Professions Code 17500): Prohibits businesses from making false or misleading statements in advertisements, including the misrepresentation of products, services, prices, or endorsements.
2. Unfair Competition Law (Business and Professions Code 17200): Broadly prohibits "unlawful, unfair, or fraudulent" business practices, including deceptive advertising.
3. Consumer Legal Remedies Act (Civil Code 1750): Specifically targets deceptive practices in the sale of goods or services, including omissions of material facts, which are considered a deceptive practice.By enforcing a policy that relies on deceptive advertising, this business is in violation of California law and has no legal right to retain fees for services provided under such circumstances.

As is noted in our Terms of Use (https://bringatrailer.com/terms-of-use/) and Privacy Policy (https://bringatrailer.com/privacy-notice/), when sellers provide information to us (whether that is written, photographs, videos, etc.), they agree that Bring a Trailer has an irrevocable license to reproduce that information. We do not remove auctions once they are live on the site.
Regarding the annotation that the car "sold," that marker is used whenever bidding reaches the agreed-upon reserve amount (or in this case, as this was a no-reserve auction, after the highest bid). Sold in this instance means that the bidding reached the required threshold, regardless of what happened in the peer-to-peer transaction after the fact.

I am rejecting this response because: Reply received is generic, does not address items of concern. Agreement was breached and revoked. All funds paid to BAT were returned to end agreement as per BAT own discretion due to the numerous issues that involved the mis-handling of the auction. Auction was to be removed and not allowed to close. I had commented and made bidders aware of the issues and that auction would be closed, however my comments were removed by BAT. BAT did not carry out the entirety of their responsibility. BAT has ignored removal of images and listing from me and Digital Millennium Copyright Act Services. We urge BBB to review BAT business practices (other complaints, how they handle customers) to the fullest extent and assist with the take down of my vehicle from their website.

We've complied with our obligations regarding the information provided to us by the seller, and any refunds were offered as a customer service endeavor. Any refunds do not invalidate the terms agreed to by the seller when they submitted the car to be auctioned. The auction result reflects that this was a no-reserve auction and therefore the winning bid entitled that bidder to purchase the vehicle. The fact that the seller refused to honor that result does not change the fact that the car bid to that amount on that day. We will not be removing the auction from the website.Customer Answer

Complaint: 22411206
I am rejecting this response because:BAT was the cause of auction failure. Server outages, removal of documents and removal of comments and lack of promised promotion created an urgency to address that BAT refused to address. The breach of contract occurred when these issues occurred and were brought to the attention which BAT immediately refunded further confirming end of agreement.
We are not requesting damages simply to remove listing and images.
BAT has not shown good faith by removing legitimate comments by others and myself for the auction, they promote falsity by stating and advertising the car as SOLD given they know that their platform had issue and certain marketing promised were not fulfilled. The damages that are incurring due to this false listing is substantial. Our next courses of action will be small claims and going for damages.
We are giving BAT via BBB to do the right thing and remove this listing.
We have documented this entire process and have screenshots of their actions as well as refused to respond to DMCA.
BAT please do the right thing here today

In October 2024, I won an auction on the Bring A Trailer website. I read the ad of the car carefully multiple times: my bid was based on the representations made in the ad. After winning the auction, I was provided with the seller's phone number. In discussing the car with him, I learned that one of the representations made about the car's maintenance was patently false. Then I learned that he had made engine modifications to the car which were not listed in the ad. I backed out of the sale and started interaction with Bring A Trailer to have the $1,000 charge made to my credit card credited back to my account. ****************** has refused to credit my account simply saying that they ":were trying to work out a solution with the Seller." I believe the business practices of Bring A Trailer amount to Unfair and Deceptive Business Practices. I realize that a buyer must perform due diligence but I also know that the buyer should be able to trust the representations made by the Seller on the Bring A Trailer site. And in cases where there is patent fraud or deception, the Buyer has an expectation of being made whole by Bring A Trailer. Buyer's beware: Bring A Trailer will NOT protect you for lies, misrepresentations, or omissions made by a Seller on its site.Business Response

I purchased a vehicle through Bring a Trailer and it arrived damaged. Bring a Trailer acknowledged the fault of the seller and refunded part of my buyers fee. I later found additional issues and asked Bring a Trailer to refund the rest of my buyers fee, as the seller did not disclose these issues. Bring a Trailer declined. After further inspection of the vehicle by an independent expert, I am now convinced that the seller I purchased it from (via Bring a Trailer) committed fraud. In my case, there were serious safety issues that the expert advised could have caused a deadly accident. I am looking at $15,000 in repairs and that doesnt cover everything needed to get the car to the condition the seller described on the listing. Instead, its enough to make the car safe to ********** is my issue: Bring a Trailer does not have a review system for buyers to warn others about sellers who turn out to be bad actors. I tried posting my review of the seller on another one of their listings, and Bring a Trailer took it down and emailed me to say that I was violating their commenting guidelines. I was trying to protect other buyers. I would like the rest of my buyers fee refunded, along with an explanation as to whether Bring a Trailer plans to implement a review system for sellers.Business Response

Thank you for reaching out and sorry to hear that you continue to have problems with the vehicle you won at auction.
Though our post-auction support staff did elect to refund half of your buyer's fees earlier this year, given the additional details you've provided here we can process a refund for the balance. You should see those back in your account within 7-10 business days, depending upon your bank.
We have been tossing around the idea of seller reviews or something along those lines for some time. It may be on the horizon in the future, but we've been working on some higher-priority, user-facing improvements in the meantime. Some concerns with user ratings (like all online rating systems) is that it would necessarily skew to the negative, and it would unfairly penalize new sellers who have not had time to build up a reputation. We appreciate your desire to share your experience with this vehicle, though doing so in unrelated auctions by the same seller does not abide by our posted commenting rules.
