      On two several occasions within the last couple months i have tried to list for sale some Automotive based neo signs that are exactly like signs that have been sold on BaT by "regular" sellers. In all cases BaT declined to take my advertisement for their auction site, citing generic reasons such as they need to curate content and ensure there is the right mix of products sold, etc, etc. It is clear that BaT has favored relationships with certain sellers that they protect from competition like me who are selling the EXACT same item. Nowhere in their website does it reference a seller being of a certain size, financial status, etc. in order be considered to sell on their site. In fact, the vast majority of their customer base are independent sellers like me. In short, for the category of signage, BaT is clearly obstructing competition to protect certain regular sellers for reason unknown.

In general we are very selective with what parts and memorabilia we list, as it's a smaller subset of our business compared to vehicle auctions and naturally a smaller revenue source. We choose which items to list based on a number of different factors, which does include a seller's known history on the site, the timing of the submission, the overall quality of the piece, and a number of other factors.

      This is not meant to mean that the item is not desirable or that we are playing favorites with sellers. With that in mind, we'll review this submission again and will follow up with you separately to discuss further.

      This dispute involves the misrepresentation of a vehicle I purchased on the Bring a Trailer (BAT) auction site for $86,001. Date of transaction was 8/6/24. ID is #******. The issue is that the car was mispresented by both the seller and consigner Classic Cars West of *******, ** and BAT.I paid a buyer's fee of $4,300 to BAT. When the car arrived, it had undisclosed rust in the left quarter front trialing edge, torn upholstery, paint buffed all the way through on the hood scoop, broken seatbelts that were hidden under the rear seat, and a badly dented gas tank with a crease that was leaking fuel. The trasmission had been replaced with an incorrect transmission for the car. None of this was disclosed. I emailed BAT 8/19/24. On 8/21/24 "Kellan" responded by email from BAT that I should try to contact ******* ******* at Classic Cars West (CCW) first. Mr ******* from CCW emailed me 8/21/24 saying that the pictures on BAT were a "true representation of the car's condition". He refused to do anything else. I then tried to f/u with Kellan or anyone at BAT. I emailed 8/23, 8/24, and 8/27: no response. I called and left messages (No one EVER answers the phone there) at least 12 times. No return call ever. BAT has ghosted me.There is literally NO WAY to contact anyone at BAT ever. I will deal with *** later, but BAT has materially misrepresented this car and should return my buyer's fee of $4,300. BAT already has all the pictures because I sent them to them.

      I listed my vehicle on BAT and paid for the listing and to have photos taken of the vehicle. The auction ended on 18 August with the vehicle being sold. I filled out all the paperwork to have the vehicle transferred using their "verified checkout". The buyer never paid I guess. I can't really tell you because there is no communication from BAT. I received an email stating they have reminded the buyer that they must pay. That's pretty much it. Then I get an email that just says transaction cancelled. I asked about re-listing. Silence. Ghosted. No effort to contact next to last bidder or re-list. No answer to my emails or phone calls. They've kept my listing fee and probably the 5% buyer hold but the vehicle is still parked in my driveway.

      I won this auction and the listing is not as described. The Discovery was not drivable. I contacted *** immediately through email after I spoke to the seller who told me I had to either get the brakes fixed or have it towed before I drove it back home 8-9 hours. Bat did not read my emails which I sent 4 different ones. They did finally email me telling me the seller told them I didn't pay for it yet. I did pay the 370 fee and asked *** to refund it back to me since the Discovery is not safe to drive. The listing didn't say anything about having it towed or brakes needed fixed before I took it on the road. I am having issues with *** responding to my emails

      It is important to note that in the description of this vehicle it clearly states that "The seller reports a soft brake pedal under hard braking." When asked about the buyer driving this vehicle a long distance through mountainous terrain, it is very understandable that they wanted to warn a buyer away from that idea; if a vehicle is known to have braking issues under hard braking, a long-distance trip with multiple long grades would not be advisable, even if the vehicle is drivable in its current condition.

      This information was available throughout the auction, and bidders are expected to read the auction description closely prior to bidding, and we also provide an open comment section and the ability to privately contact the seller in order to ask questions like this before making a commitment to purchase the vehicle.

      Having said all that, purely as a customer service effort we are able to refund your $370 buyer's fee. You should see those funds within 10 business days.

      I recently bid a call from Bring A Trailer site but after winning the bid, I discovered that the car is not a manual transmission that I was looking for and thus told the seller I need to cancel the bid. The seller agreed and the transaction was cancelled. However, Bring A Trailer refused to refund the fee (total: $1045.80) that they charged me from the transaction.

      As we noted when initially discussing this situation with you, the auction format inherently places an onus on the bidder to read the auction description and complete their due diligence prior to bidding. The third sentence of the auction description states "The car is also equipped with... a five-speed Geartronic automatic transaxle." Later, under a photo of the underside of the car, the description states "Power is routed to the front wheels through a five-speed Geartronic automatic transaxle." The automatic transmission is also mentioned in the "BaT Essentials" box near the top of the listing page itself, and the photos of the interior clearly show an automatic shifter.

      Apart from the listing text and photos showing that this example does not have a manual transmission, the auctions are run for at least seven days to allow buyers time to conduct this research, and an open comment section and "contact seller" button are provided to enable bidders to ask questions of the seller. In our correspondence with the seller, it is clear that they did not willingly choose to cancel this sale but instead were forced to when you refused to honor your bids. Per our terms of use, buyer's fees are non-refundable.

      as indicated in the attached email, I informed Bring A Trailer about the cancellation agreement between the seller and I about the mis-understanding of the cars transmission status.  The seller and I did agree we will not complete the transaction and he will list the car again with them so Bring A Trailer is making up stories here.  As I mentioned, it is my first time bidding car from the site and the listing was not easy to determine the actual condition of the car, especially for people who are not car nuts with all these technical terms.  Bring A Trailer should not be so greedy to retain the $1k fee since I didnt not purchase anything.  I have bid items from **** for a long time and I never experienced anything like this.  I request Bring A Trailer to refund the full amount to my credit card.

      as indicated in your message about the listing, it led me to believe that the car is manual because the words Five Speed were used which is typically used for manual transmission car.  I cannot be fault for misleading contents on the listing that caused me to not buy the car.  As I mentioned multiple times, my intention was to purchase a manual car, not automatic.  As a platform providing the transaction should not take advantage of users in such a way that a transaction did not occur due to the listing errors and confusion it created.  Bring A Trailer must refund the fee charged to the buyer in this situation.

      I am writing to file a formal complaint regarding a recent purchase I made through an auction for a vehicle that was represented as a "matching number" and "turn-key" to drive. Unfortunately, my experience with this transaction has been far from satisfactory, and I seek your assistance in resolving the matter.Upon receipt of the vehicle, I discovered several significant issues: The oil level was extremely low upon arrival, necessitating the addition of 3 quarts. The vehicle had multiple problems, including non-functional lights and gauges. I found burned wiring which required immediate attention. Over the course of a month, I invested substantial time and effort in rewiring the car, installing a new radiator, and addressing other minor repairs. Despite these efforts, during the first test drive, the oil level dropped back to the minimum, and the vehicle produced smoke from the exhaust, which my father noticed when I drove off.I attempted to contact the seller for reimbursement of these repairs but received no response. Additionally, I reached out to Bring A Trailer (BAT) twice for assistance; they responded once but failed to follow up on the matter.As the vehicle was intended as a gift for my father, these unresolved issues have rendered it unusable and caused considerable disappointment. I kindly request your intervention to facilitate a resolution, such as reimbursement for the repair costs or assistance in obtaining a satisfactory outcome.Thank you for your attention to this matter.       We won a car on 08/23/2024 at bring a trailer auction. Bring a trailer listing said it was a 5 speeds but the dealer listing ,**************** from **********,said it was a 6 speeds like were looking for.Bring a trailer policy is to get any potential buyer/bidder to do their due dilligence calling the dealer for any additional info or for inspecting the car before bidding and we did.The dealer confirmed it was a 6 speeds 3 days before the end of the auction. We contacted the dealer at the time of the payment and he now told the car was a 5 speed and that the 6 speeds listed was a "clerical error".The 5 speeds was a deal breaker for us and we contacted bring a trailer and the dealer to cancel the sale. Bring a trailer is refusing to credit our credit card back as they refused to take responsibility from thier dealer error. The dealer sold the car before we could solve our issue with bring a trailer and himself. Off course we are disputing the charges and now got the legal machine involved. For any buyer, just know that the buyer is the one that get charge for the auction fees and that bring a trailer WILL DECLINE any responsibility from their dealers ,like fantasu Junction, no matter what! we will never get involve again form this scam and we are not surpise to see so many complaints against their operation. How can they still be in business ? i will avoid to spend time on their very little responsive customer service that always send you the same message about their no refund charge policy with the promise to contact you the next day , and we are still waiting

      Bring a Trailer does not inspect any vehicles listed for sale and we rely upon the information provided to us by sellers in order to write the auction descriptions. In this case, the description on our website, where the auction was being hosted, was correct, despite the apparent error on the seller's own website. The seller also commented multiple times during the live auction about the car having a 5-speed transmission.

      In the rare cases in which problems like this arise post-auction, Bring a Trailer does our best to find a reasonable solution to the problem. In this case, we contacted the vehicle's seller, who denied having told anyone by phone that the car was equipped with a 6-speed transmission. 

      In the rare situations where a vehicle is intentionally misrepresented by a seller, Bring a Trailer is willing to work with buyers to try and reach a reasonable resolution. That does not appear to be the case here, though as a good-faith effort, we are able to refund your BaT buyers' fee of $3,900.00. You should see those funds back in your account within 7-10 business days, depending upon your bank.

      I purchased my truck on Bring a Trailer (BAT) on July 22, 2024. The truck, a 2005 Chevrolet SSR with less than ***** miles, was being sold by a licensed California dealer that has sold numerous vehicles on BAT hence providing them with a significant revenue source from both the multiple listing fees and buyer's fee. The purchase price was $29,500 to the seller plus a $1,475 fee paid by me to BAT. When the truck arrived at my home I only drove it into my garage. When I tried to get out of the vehicle I could not exit the vehicle on the drivers side. My wife had to use the exterior door handle so that I could get out. I contacted the dealer and he acknowledged that he knew of the issue and agreed to reimburse me for the cost to get it repaired. I appreciated his response. I was able to obtain the necessary part and had it repaired on 8/5/24. The cost came to $376 which the seller did send me the funds.The day after the truck arrived was the first chance I had to actually drive it at which time I found out that it did not have a working air conditioner. I immediately informed the seller of the problem but he failed to acknowledge the issue even though he continued to communicate about the door and answered a subsequent question about missing trailer hitch keys.On 8/5/24 I took the truck to an auto repair shop to fix the door issue and to diagnose the air conditioning issue. As it turned out there was no wiring to the air conditioning compressor. Total cost to repair the compressor wiring, which required dropping the subframe came to a total of $991.77. I reported this to the seller on the repair date of 8/5 as $879.95 (I read the invoice incorrectly). Since I received no response by the seller, I reached out to BAT on 8/16 asking for their assistance but they have gone completely silent. BAT requires sellers to list all of a vehicles faults. This truck had "air conditioning components" but not air conditioning. This clearly effected its value

      Funny how the only email they did not receive from me was in respect to this issue.  I've looked at a number of the seller's auctions for other vehicles where the write up states they have air conditioning.  In those auctions, if the air conditioning did not work or only blew hot air, they stated that in the auction write up.  Otherwise they only mentioned that the vehicle had A/C.  Seems to imply that silence means the A/C works unless they state otherwise, particularly since this is a modern vehicle with less than ***** miles.  BAT prepares the write up which is then sent to the seller for their approval.  With over 500 listings from this seller hence my concern that there could be a bias towards protecting the seller, hence my rejection.

      When we write auction listings, we rely upon information provided to us by the seller. You are correct that if we mention an item or accessory, our assumption is that it is operational, and if the seller has told us that it is not, we include that information so that bidders can be aware. We ask sellers during the submission process if they are aware of any problems, needed maintenance, etc., and sellers are also required to approve a draft of their listing before the auction can begin. 

      When issues like this arise post-auction, our customer service team will do their best to find a fair and amicable resolution between the two parties, without bias.

      I would love to accept their response.   However, I cannot in good conscience do so until and unless I actually see some results.  So far it's just me providing documentation, including raising the awareness that I noted in my review of a few of the seller's 500 plus auctions of vehicles that have air conditioning which does not work properly or at all that it's stated in the listing.  In my case they did not include in the listing that the A/C was inoperable.  ***'s response is essentially agreeing with me yet the seller is still listing new auctions while I'm out over $900.

      so I purchased a on Bring Trailer on 7/1/2024 and the dealer selling the was ************* in ****** WI, the car was presented with 16k miles and with no issues, new AC system, run and dive, there were no disclosed issues after I wont the car I paid right away, it took the dealer 3 weeks to ship my car, every time there was an excuse. after i received the car i have learned that the car has several issues, AC not working, the Radio not working, the passenger door lock doesn't work, half the cluster is not functioning, the car misfires and so on, the car has been in ** since 2008 but no copies of any smog certificates or step of any kind that this car complies with US regulations and the list goes on. I have contacted the dealer and no answers, they are just ignoring me, i have also contacted Bring a trailer and no one contacted me yet. total misrepresentation and dishonesty

      Sold a car on Bring a Trailer. BaT uses a third party to complete the sale. It has been 3 days without any communication from this third party. Emails to BaT go unanswered . There is no way to contact the third party. The seller and I agreed to do the balance of the deal without the third party, but *** does not answer mine or his emails so we can tell them this. I called BaT headquarters phone but only got an answering machine. I will no longer use BaT to buy or sell cars in the future because of their lack of service .
