      I have a collections invoice to pay. Mandarich Law group did well with my requests, including sending me the info I requested on the debt. I contacted Mandarich last week and came up with a couple options for payment plans. Spoke with them today with a plan I agreed to. Then we got to the payment. I use ***** and was told they do not accept this. They tried giving me other options which none work for me. I find it unfair that the next step would be possible garnishment. I have been willing to setup payments with an accredited financial Institution. I believe they should not accept this collection if they will not accept my payment.

      I became aware of an unpaid debt because I am purchasing a home. My lender inquired about it. After reviewing my credit report I learned it was an old Citibank debt my ex husband had agreed to pay but had not. It was listed as being held by Cavalry Portfolio. I called to attempt to pay the debt. **** ******* informed me they no longer held the account and that it was held by ********* Law Group. I was given their contact information and called them on 10/25/2022 speaking to ************. He informed me my case had not been sent before a judge, the balance was $5651.37, and associated fees that brought the balance to $5866.37. I inquired if I could pay in full. We agreed I would pay in full on Friday, 10/28/2022. I needed time to move the funds into the bank account. ********* said that was acceptable and since I was paying in full, he would waive the fees and I would only be charged the actual balance of $5651.37. He further stated he would send an email with a secure link to login and complete required paperwork so that he could stop the court process and send me proof of my payment in full. He stated I had 48 hours in which to do that or cancel my payment. I did not receive an email so I called again on 10/26/2022 and spoke to *****. ***** sent the email which I received. I clicked the link and was asked to create a password. I did so. When I tried to log in and view my documents/secure message, the new password did not work. The password reset link has yielded no results. I still have no written confirmation of our agreement and ***** was not willing to provide any information although he quoted the balance as $5866.37. This all seemed strange to me and I began investigating *********. It appears they are in the habit of misleading communication and "accidental" oversights resulting in overpayment. In my case their tactics are already putting my home loan at risk which will incur a loss to me of monies already paid. I am planning to get an attorney.

In the complaint, ********** alleges that MLG engages in "misleading communication" with consumers so they can receive overpayment. ********** alleges that her home loan is at risk and if her payment is not accepted she will seek an attorney. MLG investigated the allegations and responds as follows: On or about October 25, 2022, ********** called MLG with her request to pay off her account. Our representative informed ********** about her current balance and agreed to draft a stipulation regarding, **********'s request to pay. ********** informed our representative that the funds would not be available in her account until October 28, 2022. Our representative informed ********** that we were able to draft her pay off request and secure the payment on October 28, 2022. ********** then provided her banking information and proceeded to end the call. Attached is a copy of the drafted stipulation dated October 26, 2022. ********** then proceeded to call MLG back on October 26, 2022. ********** stated that she had not received the stipulation agreement and requested it to be sent to her via email. Our representative stated that the stipulation was emailed to her. ********** acknowledged she had received the stipulation and terminated the call. ********** called MLG back on October 27, 2022, stating that we were allowed to process her payment of $5,651.37 and that she needed a letter stating her balance was paid off and that her account was satisfied with the firm. Our representatives explained to ********** that our rules and procedures did not allow for a Zero balance letter to be sent out until the funds have been received and confirmed. The process usually takes about 30 days. ********** stated that she couldn't wait that long because her home loan was in danger. Our representative informed ********** he will do his best in order to send ********** the zero balance letter. ********** gave our representatives permission to call her back in two weeks to follow up with her account. On or about October 28, 2022, ********** called back MLG stating that her payment she had made the day before had not been processed yet. Our representative explained to ********** that it takes a couple of days for the payments to be processed. ********** became upset and demanded a proof that MLG had processed her payment. Our representative explained to ********** that we are not able to provide such proof until her payment has been processed. ********** refused our explanation and began to call us liars and demanded to talk to a manager. Our representative then transferred the call to collections manager **** ******. ********** explained to the consumer what had previously been stated by our other representative. **********'s payment was to be processed and the money will be taken off her account as soon as the payment clears. ********** contacted our accounting department, and they assured him that the money will be taken out with in the next few days. ********** informed ********** what was said by the accounting department and assured her that her payment was processed correctly. ********** thanked ********** and terminated the call. On or about October 31, 2022, ********** called MLG again stating that the payment had not been processed yet and that we were all liars. Our representative informed ********** that her payment was in process. ********** was very upset and demanded to speak to a manager because she had been lied too again. The call was transferred to ************* collection manager. *********** informed ********** that her payment indeed had been processed on October 28, 2022, and that we were waiting on her bank to release the funds. ********** was emotional and stated that if the matter was not resolved she could lose her home. *********** then added accounting representative to the call. The accounting representative assured ********** her payment had been processed and the money should be out of her account soon. ********** did not believe our accounting representative and stated if the money was not taken out from her account soon, she would call back. ********** abruptly terminated the call. The payment was processed later that day. MLG has closed **********'s account as satisfied. MLG does not engage in misleading communication and does not profit from "accidental Oversights". All MLG employees are trained with all financial regulations and procedures in order to accept and process payments. All the information that was given to ********** by our representatives was accurate. **********'s payment was processed, and her account was closed. Thank you.

      I sent payment in-full from an old credit card. The company returned my check, waited a year and are now ********** my payroll check for $770 every to weeks until the goal amount of $4700 is paid. This has left me *************** in a bad situation. I need assistance please!

In the complaint, Mr. ******** alleges MLG returned an attempted payment for the full balance of the account and waited a whole year to garnish his wages. Also Mr. ******** claims he will seek legal action against MLG. MLG investigated the allegations and responds as follows: On or about June 28, 2021, MLG filed a summons and complaint against Mr. ********. On or about July 8, 2021, MLG served this filed summons and complaint to Mr. ******** at his current mailing address. Mr. ******** had 30 days to respond to the complaint as stipulated by the law of the Supreme Court of the State ************** Since Mr. ******** did not respond to the complaint, MLG filed a default judgment against Mr. ********. The judgment was granted by the Supreme Court ************* on or about September 17, 2021. According to Mr. ******** he attempted to pay off this account. MLG received an email from Mr. ******** on or about October 29, 2021. In this email Mr. ******** explained his desire to pay the account. After one of our ********** attorneys reviewed Mr. ********'s offer, MLG attempted to contact Mr. ******** via phone to discuss payment options. MLG representatives called Mr. ******** on two separate occasions on November 1, 2021, and Mr. ******** hung up the phone both times. Since MLG was not able to reach a settlement agreement with Mr. ********, MLG continued the legal process accordingly. On or about May 2, 2022, one of our reports indicated Mr. ********'s place of employment. From that day we started the **************** process on Mr. ********'s wages. We sent Mr. ******** a copy of the memorandum of cost for the writ of execution we were going to file. Mr. ******** was notified with ample time about the pending **************** against him and he chose not to respond to it. Mr. ********'s **************** was served upon his employer on or about July 25, 2022. MLG followed the rules and regulations set forth by the State *************. MLG is attempting to enforce the judgment granted against Mr. ********. On or about September 1, 2022, Mr. ******** called MLG. According to our call recording Mr. ******** was angry due to the garnishment placed on his wages. Our representatives attempted to explain the situation to Mr. ********, but he became more frustrated and started using foul language towards our representative. Our representative attempted to deescalate the situation and Mr. ******** ended up terminating the phone call abruptly. At MLG we attempt to provide the best quality service and provide the respect and attention all of our consumers deserve. Mr. ******** is more than welcome to call us at ************ to attempt to reach an agreement for us to terminate the garnishment against him.       On June 10, 2022 I received a letter from my employer telling me about a garnishment order Case # ************ total gross amount: $3,148.80 Creditor/Attorney: Mandarich Law Group, LLP and start date 06/06/2022. I decided to contact Mandarich and pay off the amount of the garnishment for the total of $3,325.36 this amount was withdrawn on June 16, 2022 by Mandarich Law Group. They were going to fax the release paper to my employer to stop the garnishment. Then, after ten (10) of my complete payment of the debt they were going to fax the release paper. I have called my employer several times and they have not received any paper from the Mandarich Law Group. And from what I have read and researched they are supposed to file some papers with the court of**************: Voluntary dismissal of continuing garnishment., it hasn't been filed by them yet. The first time I spoke to them I paid off the amount stated above and then called with the fax number of my employer in order for them to send the release of garnishment. Then, I waited a few weeks they told it was on process, waited again couple of weeks and they told me they sent the paper to a address in ***********, ******* I don't understand why they sent supposedly the information by mail and to the wrong address since from the beginning it was suppose to be send to my employer Payroll Department Fax number as they explained to me. I don't understand what I can do this is causing me a lot of nervousness and stress. To date, $1,364.21 has been withheld from my check. I don't know if my employer or Mandrich has it. Before they started withholding from the first check I paid the full amount of $3325.36. Therefore, the total amount withheld to date must be returned to me. Thank you. ****************

After paying off her account,************* alleges that MLG continued to garnish her wages.************* states that she has tried to contact both MLG and the court of************** to see if the satisfaction of judgment had been filed.************* claims that to this day, the paperwork has not been filed and her wages are still being garnished.************* wants for her garnished wages to be returned to her and for all the paperwork to be filed. MLG investigated the allegations and responds as follows: On or about May 3, 2022, MLG issued a writ of garnishment against************* and her employer. The wage garnishment was served upon her employer on or about May 27, 2022. On or about June 16, 2022,************* called MLG to set up a payment for her balance in full. Our representative obtained her information and processed the payment accordingly. MLG rules and procedures state that in order to terminate a garnishment, MLG must wait 10 days after receiving payment to process a termination order. On or about June 27, 2022, MLG representatives sent the wage garnishment Voluntary Dismissal notice to************* and her employer in order to terminate the garnishment. MLG also sent out a Satisfaction of Judgment to The************** Court.************* called back MLG on July 7, 2022, our representatives explained to her that the termination had been processed and that all the documents were sent for filing. On August 16, 2022,************* called MLG again stating that she was still being garnished and that she wanted a termination letter to be sent to her employer immediately. Our representative submitted a request and confirmed the fax number that was previously provided to send the Voluntary Dismissal of the garnishment. MLG representatives sent the notice that same day. On August 24,2022,************* called MLG again stating that her wages were still being garnished and that the court has not received the satisfaction of judgment. Our representative apologized and stated that he will have one of our attorneys review the case. Our attorney decided to send another satisfaction of judgment with the court and send more termination letters for her employer. The next day************* called again stating she had not received any termination letter. She confirmed the fax number, and we sent the termination letter while she was on the phone with our representative. MLG confirmed her employer received the garnishment termination letter and stated that the satisfaction of judgment will be filed with the court. MLG apologizes for the delay in the filing of the documents for*************'s case. We instructed her employer to return all the garnished funds to*************. Attached to this response is a copy of Filed Satisfaction of Judgment with the court.       Mandarich Law group sent paper work to appear in court to a fraudulent address in regards to a **** Bank account which I never opened and I was a victim of fraud. They sent this paper work to a fraudulent address and a judgment was placed against me. This law firm was hired by ******* portfolio LLC and I believe they are acting in unethical and maybe even illegal behavior in regards to this suit. I explained to them that I have no connection to the address they had on file or **** Bank or ******* portfolio. I stated that I have all paper work support this information and an investigation to be opened. I was unable to defend myself in court because I was never served anything properly or ever contacted prior in this regard. I asked for another court date and was told that isn't possible. I also know the garnishment of wages should be put on hold while an investigation is being conducted and I was told they cannot do that either. The response from the attorney was that it is not her area of expertise. I need as much help as possible with this matter as I feel that I am being target in a fraud and being bullied by Mandarich law group as well as ******* portfolio. This is not my debt nor have I ever had a **** bank account. When reaching out to **** bank they told me they have zero record linked to my SSN ever having an account with them.

In the complaint, Mr. ****** claims to have been a victim of fraud. Mr. ****** also claims to not have any knowledge or connection to the original creditor ******** and will like for MLG to be held accountable for "Unethical and Illegal practices" MLG investigated the allegations and responds as follows: On or about October 29, 2018, MLG filed a lawsuit against Mr. ****** with the Civil Court ***************** The complaint was filed and served to Mr. ****** on November 9, 2018. MLG was not aware of any claims of fraud or Identity theft, therefore we continued the legal process. MLG filed an Income Execution on or about May 19,2022 due to the inability to reach settlement with Mr. ******. After learning about Mr. ******'s situation, MLG's rules and procedures outline that we must confirm every claim of fraud with a fraud package and a substantiation of debt. Both packages were sent to Mr. ******'s current mailing address. MLG ********************** will continue to investigate Mr. ******'s claim and will proceed accordingly after our investigation is complete. While the investigation is on its course MLG will be in contact with Mr. ****** to resolve this matter amicably. I have reached out to Mandarich law group on multiple occasions in this matter. Each time I requested to speak to a lawyer I had to jump through hoops to receive a call back. In regards to Mandarich law groups stating that they have tried to reach me during these periods in 2018 that as well is inaccurate. I was living ************** at this time and I sent over this lease information to prove that the address they attempted to reach me at was the fraudulent address. I spoke with an attorney named ************ and when I asked about this the response I was told was "it's to late because we already have a judgment against you" even though all proof was sent that I was never contacted in regards to this matter. I also started to ask more questions in regards to this fraud account in question and the response I received for ************ was "I can't answer your questions and You need an attorney" I also asked why the garnishment wasn't being put on hold during the fraud, I was told that's not possible. Unfortunately it was clear that anytime I asked for substantial proof or any detailed answers in regards to this matter I was told they could not answer these questions. The reason Mandarich law group was unaware of any fraudulent activity with this account is because I was only made aware of this account once I found out I was being garnished. I have called ******** and have spoken to multiple departments and there is no record of any account with my name or attached to my social security number.       In 2016 Mandarich Law Group used fake summons and fake court documents to scare me into setting up a payment plan. Then the COVID-19 pandemic happened so I called and asked if I could stop my payment plan until I was in a better position. They agreed and I haven't heard a peep from them for 2 years, the statute of limitations has ended for the debt June 8, 2016 - June 8, 2022. Suddently today I received a "Writ of Garnishment" from Mandarich Law Group, it was out of the blue, haven't received any correspondence nor phone calls in the past 2 years. I have retained an attorney, this business needs to stop their scare tactics (which is illegal) or I will have no choice but to contact the FTC. This debt was disputed on all major credit bureaus and is not listed as a collection nor public record on any of them.

In the complaint, Mr. ******* alleged that MLG used deceptive tactics and served "fake court documents" in order to obtain a payment plan. Then after the payment plan was set COVID-19 pandemic occurred causing the payment plan to be nullified. Mr. ******* alleges that MLG uses illegal scare tactics and has no right to collect because this debt is out of statute of limitations. MLG investigated the allegations and responds as follows: On or about March 16, 2016 MLG filed a law suit against Mr. *******. In the state ********* the statute of limitations is 10 years with a granted judgment. MLG was granted a judgment on Mr. *******'s account on June 8, 2016. Since the judgment was granted by the Circuit Court ********************************************* MLG is well within the statute of limitations to actively collect on Mr. *******'s judgment. The judgment does not expire until June 2026 pursuant to ****** statute. Mr. ******* is confused as to the appropriate measure of time in civil actions and with respect to the judgments that arise therefrom. A stipulation agreement was entered between Mr. ******* and MLG on or about June 16, 2016. It was agreed upon by both parties that Mr. ******* would make monthly payments in order to retire his debt. According to our records Mr. ******* has never made a payment to MLG, thus defaulting on the stipulated agreement. MLG expressed clearly in the stipulated, agreed upon judgment that debtor signed and returned to us in 2016, that the judgment creditor may execute on the judgment in case of the debtor's default in payments. MLG exercised its rights, granted to it by both the debtor's ascent and by ****** law, by garnishing his wages. MLG is compliant with all the rules and regulations set forth by the State of ******. By claiming MLG is involved in "illegal scare tactics" without factual proof Mr. *******'s allegations should not be considered by the **********************. Mandarich Law Group spent more than 10% of the balance for court costs. Why are they coming after me? I get it I owe $1300 from a debt from 2014, I'm not denying the debt, my complain is the means at which MLG picks on people who don't have a lot of money. They went for the ****** MAXIMUM garnishment amount of 25%, now I will not be able to get gas or food for the next 10 paychecks. Why is my case so important for these people to collect on, I would understand if I owed $5,000+, but $1300, the whole court case, it's like these people like tearing down the little guy. Mr. ******* also claims that we are targeting him by claiming the maximum garnishment amount and we are "tearing down the little guy". MLG responds as follows: On or about March 26, 2016, Mr. ******* was served with a summons and complaint by our process server. Attached is a copy of the proof of service that was filed with the Circuit Court of the State of ******. In the proof of service Mr. ******* is named as the recipient of the documents and he accepted them via verbal communication. MLG complied with the rules and regulations set forth by the State of ******, including the ability to file lawsuits and default judgments electronically. As is stablished already, Mr. ******* was notified of the pending lawsuit against him, and he decided not to oppose it. MLG treats all accounts provided by our clients the same. MLG works hard to find amicable solutions for both parties and Mr. ******* was not an exception. We provided ample opportunity for Mr. ******* to reach a settlement and pay his account, unfortunately both parties could not come into an agreement. MLG provides fair opportunities to all the consumers as we all look towards the same goal which is resolve the debt as fair as possible.       This law firm came after me for a debt they claimed I owed. Because I didn't pursue the case in a timely manner a judgement was rendered against me to pay the debt. Garnishment proceedings was filed with my employer which began in May, 2022. I took out a second mortgage to pay the debt in full which was paid in June. By then several garnishment went through. I requested for the Mandarich Law Group to refund my garnished funds and to cease the garnishments all together the last week of June. To date, they have not done either.

In the complaint,*********** claims she paid off her account balance and we did not terminate the garnishment in a timely manner causing her employer to withhold extra funds. MLG investigated the allegations and responds as follows: MLG terminated*********** garnishment July 13th, 2022, with the Fulton County Magistrate Court. MLG also filed a voluntary dismissal of continuing garnishment with the Clayton County Court on July 5th, 2022. Both documents are attached to this response. MLG's rules and procedures outline that we cannot send a garnishment termination letter until ten days after the final payment was received. We received*********** payment on June 20, 2022. We then proceeded to file the garnishment release and dismissal accordingly after the stipulated had passed. MLG issued a refund to*********** for all the garnishment money her employer had sent us. We terminated the judgment and closed the account in our system.       Mandarich Law Group purchased my information from another party in hopes to deceive me and get money. When I called Mandarich (**********************************************) all stated that the DOB and address they have for me doesn't match what I'm giving them. I informed them several times that I'm a victim of identity theft and they didn't care if the information they bought was inaccurate. After speaking with law enforcement I was told that this company is a call center and purchased my information from another source. That source gave them the wrong dob and address and as a result their unable to provide me with the source- NAME and PHONE NUMBER. I'm a victim of identity theft and I find it very alarming that my information was purchased. I have 0 collections/liens/garnishments. I don't have issues paying my bills.

In the complaint, Mrs. **** alleges MLG bought her information from a third party and is using her information to deceive her out of money. Mrs. **** also alleges that our representatives did not provide any information regarding her debt due to account information being different from her own personal information. MLG investigated the allegations and responds as follows: MLG and our client *** ****** take allegations of identity theft seriously. As company policy we send the defendant a Debt Verification Package to inform them all the parameters of the account. MLG does not buy information from third parties in order to deceive or collect money. Our procedures follow all the laws and regulations of *********************. On 7/11/2022 The debt verification was sent to Mrs. **** so we can further investigate her claims of ID theft. With regards to Mrs. **** claim that our representatives were not able to help her because the information she provided did not match the information on the account. MLG has policies and procedures in place that MLG representatives abide by in order to be able to provide information for our accounts. Our representatives are trained to ask for information to verify the account in question. This policy allows MLG to find the accounts and prevents us from divulging case information to unauthorized parties. I have ZERO collections/liens/garnishments. I have an outstanding payment history with no issues of missing payments.       This company has started garnishing my paycheck at 25% of my check and I'm the only one e working in my home and I have two children that I support. One being in college. I can never get accurate information from anyone at the number listed. The representatives keep telling me that there is no one that can help me there or they will send an email to the astronomy's office to call me back and no one calls me back. I'm unable to take care of my family because of this old debt. I was trying to settle it but I can't even talk to anyone that can help me. I need help please I can't afford the 25% and my bills and my family . Someone please help. I need to file an exemption but by the time I received the paper work to file it I only had like 3 more days before it expired. It's like they are setting me up to fail and forced to pay money I don't have. This is a fair and unethical.

In the complaint, ********* alleges he has tried to make settlement offers and has not been able to reach us and that our representatives have not been able to provide reliable information about this debt. ********* also claims that he was not given enough time to file an exemption and that our practices are "unethical". MLG investigated the allegations and responds as follows: On or about June 10, 2022, *********'s wife called our office to get information on the pending wage garnishment against her husband. Our representative provided a required disclosure and proceeded to answer *********'s wife's questions. ********** asked our representative if we ever notified ********* about this debt. Our representative answered yes and provided instances in which we informed ********* about the incurred debt. We sent ********* an Initial Demand Letter on or about July 25,2021, to the address listed in the consumer information in the complaint. ********* was also served with a Summons and Complaint on or about September 17, 2021, via process server. ********** discussed the possibility of a payment plan or options of settlement with our representative. After an initial offer, ********* decided it would be better for the wage garnishment to go through and ended the call. On or about June 16, 2022, ********** called back our office. Our representative provided the required disclosure and attempted to assist ********** with her concerns. ********** was emotional during the call because *********'s employer was served with the wage garnishment and their income is limited, therefore they could not afford to be garnished at the time. Our representative tried empathizing with ********** and comforting her during this difficult situation. ********** stated that ********* will file exemption and they would send supporting documentation demonstrating their financial situation. ********** also requested a call back from one our attorneys as she ended the call. Our representative put in the request for our Florida attorney to call ********** back the following day. On or about June 17, 2022, Our Florida attorney *************** attempted to call Mr. and ********** to the numbers used in previous calls and her call was not answered. Mrs. ****** left a voicemail with all her personal information and provided times where she was most available to receive a call back. Mr. and ********** never attempted to call our attorney back. On or about June 27, 2022, we received a call from **********. After providing the required disclosure our representative stated that ********** was highly upset claiming our attorney never reached out to them and theyhad legal questions regarding the garnishment paperwork. Our representative explained that our Florida attorney *************** attempted to call ********** and she was not able to reach her. Our representative also stated that Mrs. ****** left her information in a voicemail. ********** claimed she never received the call or voicemail. Our representative verified the phone number used to attempt to call Mr. and ********** on June 27, 2022. ********** confirmed the number and still claimed they never received the call. Our representative asked ********** needed another attorney to attempt to call her back to answer legal questions. ********** refused and demanded answers from our representative. Our company policy states that our collectors and phone representatives are not allowed to answer legal questions since their knowledge of the case and laws is limited. To provide a better understanding of the case, the consumers are directed to the attorneys to accurately inform them about legal proceedings. After informing ********** about our policy, ********** about our policy, ********** ended the call abruptly. In conclusion, MLG has been accommodating and helpful to Mr. and ********** regarding this debt. We have followed all the rules and regulations in the State of Florida regarding legal processes and have provided ********* with many opportunities to settle and pay his debt.
