David Weekley and I entered into a contract to purchase a house on . The salesperson, ***************************, was quite personable and made many statements to sell the house. Some of those statements were not included in the contract, but we were assured that they would be honored because she would make sure that David Weekley would always do the right thing.In this case, we signed the contract on March 8 with her assurance that if we had to back out of the contract, we would receive our ******* money. While this wasn't a standard practice, as documented in their promulgated forms, we were assured that it would be fine because we signed the night before a rate increase. What we were told is that because we were on the fence about the contract, and because of the price increase, if we signed on the spot, we would be guaranteed our ******* money, should we change our mind at a later date, but to lock in the price, we should sign to lock in the price.The ******* money collected was $7,500 and I believe was predatory in nature. I am certain looking back that *************************** and David Weekley had no intention of ever returning the ******* money and were just trying to close a deal by making promises that they did not intend to keep.Business response

This former customer decided to cancel their contract for the purchase of a new home with David Weekley Homes. I was out of town and below is all I have been given so I do not know what the customer has written to the ********************. I can tell you they refused to work with the mortgage company further after letting us know they intended to cancel and we did offer to transfer their deposits to a lower priced home in another community if that would help. Pursuant to the terms of the contract their deposits were retained.
