    On 8/17/2023, INSIDE OUT Roofing and Restoration was given a check for the insurance payout for hail damage to my property in the amount of $13,000.00. I was in direct contact with the owner trying to schedule the work, with no success. I was given excuses every time of why they weren't able to get started on the work. I sent a text message on 12/13/2024 to the owner to return the insurance payout within a week since they haven't started the work. Since this text I have not been able to reach the owner, they will not return my calls or text messages. There is a roofing permit pulled for the work. Shortly after I sent the text, I had an inspector show up from ****************************** to do a roofing inspection, I explained to them no work has even been started, they looked puzzled and left. I received a phone call from ************************* explaining the contractor was trying to cancel the roofing permit, I told them no, because the contractor has been paid but hasn't done any work. They said they would speak to their manager, and that's the last I've heard from them. I feel the contractor is trying to pocket this money since they were trying to cancel the permit. All I'm asking for is the money to be returned so I can get this work completed. Travelers Insurance has more info if required. I believe they have correspondence with the contractor.

    Mr ***** is correct, we did receive a deposit in the amount of $13,000 last August, but has left out a detail or two.After receiving the initial deposit, there was 9 ***** ****** cement -board siding, 3.5 trim,fasteners and new sub straight delivered to his home. I have attempted to schedule the install numerous times and have been given various reasons why he wasnt ready. But saying I am the reason it is not done, is just not correct. I can not and will not proceed on good faith alone anymore as we have previously handled his home repairs that were covered by insurance in 2018-2019.  We ended up taking a loss for his repairs bc he did not pay the total balance due in the end. I know Mr ***** personally and at the time, I thought maybe I had miscommunicated something to him so I didnt press the remaining balance and moved on, ****** learned. But I was not going to do the same again . Normally I would have just went ahead with the roof, but the cost of materials is out of control and after the last experience with not receiving all of the money at the end, I just couldnt take that chance. I told him I needed to get approval for the decking he insisted on and I still havent received it. All of this was communicated to Mr ******* A refund of his money isnt a reasonable remedy, when materials were delivered, permits pulled. Notice He made no mention of the thousands of dollars  of siding that is at his house being deducted from the money or any mention of it at all here in his complaint either. I regret that this time the process hasnt gone the way it normally does, I know the delays are a lot, but threatening someone, doesnt make them able to do it any faster. I have never given any indication that I wouldnt complete the repairs on his home, nor have I demonstrated it previously. Im just not prepared to not be paid to do them again. Mr ***** cant keep bullying me, making invalid claims, telling half stories and demanding I do work that isnt paid for.

    Everything that was explained by the owner was incorrect. They received an insurance payout on the previous work as well and was paid in full. That insurance company followed up on it. They actually didn't finish all the work to be completed. They never replaced the gutters per the insurance claim. The material they dropped off was leftover material from previous projects. It has been sitting outside for a year and a half. I have called and sent texts for months with no success to reach anyone. They just need to return the insurance payout. This company shouldn't be able to keep insurance payouts for doing nothing, isn't that insurance fraud? If anything comes of this, hopefully it keeps other people safe from this fraudulent company.

    i am sorry Mr ***** is not willing to uphold his end of the agreement. But I am not willing to do more on good faith at this point. To date, Mr ***** has twisted facts, not disclosed important details, and not proven anything except that he isnt intending to pay for the second quality materials that he has made sure sat uninstalled for the year and that he will not keep his end of agreements. He SAYS he does, but saying it doesnt make it true. Feel free to compare what I have claimed by referencing the claim paperwork he submitted. He to date has paid an amount that is LESS THAN he was paid, and not including the portion he is required to pay (the deductible), But he expects me to go forward and do MORE unapproved work before he does one thing hes said he would? The only thing preventing the repairs from being done is the same thing that has been delaying it the whole time. Mr ***** expecting more be done Without having to pay for it and my unwillingness to do it AGAIN. He never paid the total amount of the claim last time and I replaced 5 windows and a sliding door that insurance wasnt covering last time. And then, he still didnt even  pay the total that the work without the windows cost. It was right about $3k short last time.. this time, the amount is right about $3k short of the replacement cost value for only the repairs listed, and  now hes acting like the siding that was delivered, unused by a local delivery service and covered for protection, is not good enough to pay for. Well? I wonder why we wont do more without his doing SOMETHING to make sure we know will  be paid correctly this time?Weve already done more than we had to, both times. We shouldnt have to do more for free just  to keep him from threatening and slandering us. He of course has  the right to not have the work done. But he does not have the right to not pay for what has been done, demand more and then demand a full refund . Thats just not reasonable. No matter what he SAYS.
