      1) Contractor walked off job. Drywall mud was disposed down kitchen sink ruining garbage disposal. Additionally, drywall mud was poured down toilet. Bathroom sink and toilet were clogged, toilet overflowed. Roto Rooter found evidence of drywall mud both in kitchen and bathroom drains. Roto-Rooter charged: $1,323.98 to clean kitchen drain and guest bathroom drain. ************* agreed to reimburse me for bill. ( I have a recorded conversation where *** said he would replace broken garbage disposal and reimburse me for Roto-Rooter Bill) 2)Wallpaper in dining room and hallway and guest bath, and, master bedroom, was to be removed. Contractor decided to difficult to remove so used a product called draw tite, and textured walls. Wallpaper bubbling under texture, due to incorrect application of draw tite compound. Portions of wallpaper were not textured with drywall mud. Hepa vacuum was not used when texture was sanded. Furnace vents were not covered to prevent drywall dust entering HVAC vents. ************* was advised that I had asthma. I suffered severe respiratory distress due to drywall dust contamination. Contamination resulted in 2 visits to ************ 2 visits to primary care, 3 chest xrays, 1 Chest CRT Scan, 2 visit to Asthma Specialist, who has referred me to a Pulmonologist and Cardiologist. Treatment is ongoing. 3} ************* has threatened, bullied, and intimidated me. He walked off the job. I have several text messages and recorded conversations, that display his promises, thrests, and intimidation. I am seeking reimbursement for Roto-Rooter Bill: $1,323.98, and $120.00 for cleaning bill, and a refund from deposit: $2650 for work not completed.

      Greetings,

       

      We Discussed taking care of this Issue and reimbursement for any and all damages caused by ABC Painting and Textures LLc with ******************* on and around AUG 24, 2023. We wanted to do a walkthrough and remedy the situation, and allegations.  Heretofore, and after numerous attempts to set a walkthrough date, we've yet to hear from the client.  Our President was on the phone with ******************* and it was decided that when she got better, she would give us a date to stop in and assess. The call never came through. This is the only communication we've had since.  We never "walked off" ******************* got Sick and told us to Leave until she got better. We are interested in resolving this matter per our contract, which the client has breached.

      I reviewed the businesss response to my complaint. I disagree with the business response for the following reasons:

       

      1. Business response stated that ABC Painting a Textures LLc spoke with me regarding damages and reimbursement on or around Aug, 24, 2023. This is false. Work was not started until September 5, 2023,

      and business picked up all tools on: September 12, 2023. Additionally, business informed me on September 13, 2023 that they were walking off the job. I can provide a copy of a text message received on

      September 13, 2023 that details ABC Painting was walking off the job.

       

      1. A walk-thru where I showed the work I was dissatisfied with was done with ************* on Friday, September 8,2023. Additionally, ************* was informed at that visit, of the drywall mud disposed in

      the kitchen sink. *** was also informed on Saturday, December 9, 2023 that guest bathroom toilet had overflowed. RotoRooter found evidence of drywall mud in kitchen sink drains, bathroom sink

      drains, and bathroom toilet, when drains were cleaned on: Monday, September 11, 2023. *** was informed of RotoRooter bill and findings when he was at my house picking up his tools on Tuesday,

      September 12, 2023. I have a recorded conversation where I was told he would reimburse me for the RotoRooter bill, and also a new garbage disposal.

       

      1. If ABC Painting and Textures is interested in resolving this matter, (as stated in their response) than I would like BBB to implement an arbitration, where BBB is there to mediate. Per my numerous

      recorded conversations, and text messages, ABC Painting and Textures has not tried to resolve the issues they created. There was never an attempt to set a walk-through date after September 13, 2023.

      All tools were picked up on September 12, 2023.  There never was a conversation that I would give them a date to stop in and assess after I was no longer feeling ill.

       

      Thus, at this time, I am requesting that my complaint be reopened. As previously stated, I only became aware of the Business response to my complaint as of: December 5, 2023 via an email.

      To Whom It May ****************************** have uploaded the original contract and our legal terms signed by the customer on the day of initial payment was 

      received for 50 percent.  Our Terms on page 3 explicitly state "Deposits are non refundable" also "No warranty of any kind will apply to projects not completed (for any reason) or projects not fully paid or in any situation where any other work is performed to an area on the project by any one other than *** or in any situation where damage occurs due to an event natural, accidental or intentional."

      Although ******************** asked US TO LEAVE because of her Sickness, the very last line in our terms on page 3 clearly states " We Reserve the right to cease work on any project at our discretion."

       

      ******************** was given over 3 months to contact us and she never did.  She masks her number when calling to state "RESTRICTED" on caller ID. so if we miss her call and she doesn't Leave a VOICEMAIL, we don't know to call her back.

      Please find the attached documents that nullify any and all claims made by ********************* and all pictures of UNFINISHED WORK, as she asked us to leave and obviously the work couldn't get done until we went back, every job sites pictures look like that until the job is completed and cleaned up.  We hereby ask the arbitrator (although again our terms clearly state, and ******************** Signature appears right under them "*** Assumes no responsibility for representations made to or by client or others in any such matters to anyone."

      If ******************** communicated clearly as do our other clients, we could address and remedy the issues at our cost, with our subs and plumbers and others we use that are proven to produce high quality work at a fair price AT THE **** OF OCCURENCE not 3 months later.  We are not responsible for previous items in the plumbing system, and we know there were other drywallers present onsite one day after she asked us to leave because our Subcontractor went back to gather the tools and saw another drywall company present.
