I have purchased a ****** Forester from Automotive Avenues on April 6, 2023. During the purchase of the vehicle I have been offered warranty protection by Protective by Revelos which cost me an additional $1,365.00 for the extended warranty. I was promised at the time by Automotive Avenues that the warranty would cover break downs along with electrical component failures as well as powertrain and in the event of such an occurance I could bring the car in to Automotive Avenues for service. The warranty deductible is $250.00. During the warranty period I had numerous issues with the power steering and horn function. It was determined by the service advisors ******************************* and *************************** as well as the service manager ***************** that the clock spring was needing replacement which is not covered by the third party warranty they sold me in the first place. I have been on the phone back and forth between the warranty company and Automotive avenues and stated this is a safety issue as the air bag is involved and may not deploy in an accident. ***************** was extremely rude with me on the phone telling me I know nothing about cars!!!! I have been denied repairs on this claim which is breach of contract which clearly states "horn" and full electrical is covered. Protective by Revelos blames Automotive Avenues for this issue and they quickly point fingers at each other over this. I am filing this complaint as this is a failure to honor the warranty I have purchased from Automotive Avenues. No other mechanic will take this warranty. Upon them denying me service is breach of contract in which my attorney has stated himself. I demand full refund of $1,365.00 for failure to honor there own contract in which they sold me. The supervisor ******* of Protective said herself Automotive Avenues is responsible for this ongoing issue and the sole reason the repair was denied in the first place. Automotive Avenues has closed down as a dealership and now a service center.

    Business Response

We are very sorry that the customer has had a bad experience. We have 30+ years of history, dealer awards, and reviews that are indicative of the great care we take to be honest and straightforward with our customers. We understand that there was an unfortunate situation in which the warranty purchased by the customer does not cover the defective part in question. Extended Service Agreements (***s) such as these are never "all-inclusive, and this is stipulated clearly in the agreement that the customer signed. In the end, we are not the warranty company, and it is the warranty company that has the power to deny claims based on the agreement purchased. In this particular case, the part needing repaired is clearly not covered by the *** the customer purchased.

    Thank you.

I am rejecting this response because: The part itself is not on the exclusions list and the information Automotive Avenues gave me at the time about the purchase of the warranty was not clearly stated. A representative from Revelos admitted and said the contract itself was vague in it's writing and not thoroughly explained by the service manager at the time. I believe I was scammed out of my money since I have been denied service from this very company. Again Automotive Avenues is pointing the finger at the warranty company when in fact they are responsible at a customer service standpoint to fullfill there obligations to me the customer. You cannot justify selling a warranty to a customer and pick and choose what is and what is not covered. Again this part is part of airbag safety system which is top priority. Automotive Avenues needs to come up with a solution for this matter. Automotive Avenues closed there dealership ******** after I purchased the vehicle and now I don't have the option to trade in the vehicle and now I have been denied repairs in which I was promised I would never have a problem with. I want my money back in full. Automotive Avenues sold me a warranty and now refuses to honor it! It's false advertising and fraud.

    Sincerely,

I would like to re-open this case as this has not served any cocnlusion to my complaint. I have not received any answers about a settlement or any type of reperations from this issue. Automotive avenues needs to make reperations from the not honoring the warranty in which they sold me under false pretenses.

    Thank You,
