I am writing to file a formal complaint against Focus Financial for federal consumer protection law violations. Specifically, I believe the collection agency has failed to comply with several provisions outlined in the Fair Debt Collection Practices Act (FDCPA).Violation 1: Failure to Provide Validation Information (12 CFR 1006.34(b)(5))I recently discovered that Focus Financial has reported a collection account on my ********************** report without first validating the debt. Under 12 CFR 1006.34(b)(5), the collection agency is obligated to provide me with sufficient information to verify the debt. However, I have not received any such validation from them. This lack of validation is a violation of my rights as a consumer.Violation 2: Failure to Allow Dispute Under 12 CFR 1006.34(c)(4)(i)Furthermore, the collection agency has not provided me with an opportunity to dispute the account, as required by 12 CFR 1006.34(c)(4)(i). On 09/09/22 ******* ****** was involved in a motor vehicle accident and had services at **********************. While the account was with the Hospital he provided his ************* of **************. He did not have any health insurance. Mr ****** was represented by a law firm and calls and letters went back and forth, again while the account was still with the Hospital. The total charge of the bill was $10,388.20. After the bill was paid by ************** there was a remaining owed amount of $3,806.81. The Hospital was unsuccessful at resolving the balance with the law firm. On 02/12/24, the account was placed with Focus Financial Services. Since it was immediately evident that Mr ****** was being represented by a lawyer, Focus Financial Services was obligated under the Fair Debt Collections Practices to only communicate with the attorney. Focus Financial Services has been in regular communication with Mr ******* attorney. It was understood the case was on a trial docket but it is unknown if the trial has occurred yet. Mrs ****** provided her Florida drivers license as identification, and it was scanned into the system. Her drivers license she provided showed a Boynton ********************** address. She advised the Hospital staff that her drivers license did not display her current address and refused to provide her correct address. The same way Mrs ****** filed this BBB complaint, she is not providing her current address. If she moved to ******* at the time of her service and was visiting (as an example), she is required to obtain a new drivers license with her new address, within 30 days after a change of address. She also provided her ******************************** as her coverage. The insurance was billed and after they processed her bill, the insurance left $615.00 as a deductible for her to pay. After the Hospital was unsuccessful at reaching a resolution through phone calls and letters to Mrs ******* the $615.00 owing balance was then placed with Focus Financial Services on 06/11/21. It is incorrect to state that I refused to provide [my] correct address. The address listed on my drivers license at the time of my hospital visit was my mothers address in **********************************. Failure to Receive Notice of the Bill:
You state that the hospital made multiple attempts to resolve the outstanding balance through phone calls and letters, but I did not receive any such communications. I want to emphasize that I never received a bill or any form of notification from the hospital or Focus Financial Services regarding this debt until this dispute was initiated. Additionally, I have had the same phone number for over 10 years, and I have reviewed my voicemail inbox, which contains messages dating back to 2018. At no time have I received any voicemail or phone call from your company.
Although the address on my drivers license was my mothers address in **********************************, I had already moved to ************* by the time of my hospital visit. However, because my mother still lived at that address, any mail sent to that address would have been received by her. She has confirmed that she never received any mail related to this bill before August 2022. Had any letters arrived for me, my mother would have informed me immediately, but no such communication was received.
You also mention that the $615 balance was referred to Focus Financial Services on June 11, 2021 (the same day of service). Given that the address on my drivers license (Boynton **********************, **) was my previous address and where my mother was actively residing, I would have received any mailed communications if they had been sent to that address regardless of me living in *************. I have confirmed that no such mailings were received by myself or my family at that address before August 2022.
Request for Itemized Bill and Documentation:
In your letter, you reference the existence of an outstanding balance, but you have not provided an itemized statement that clearly explains the charges or how they were determined.
According to the Fair Debt Collection Practices Act (FDCPA), I am entitled to a detailed and clear itemization of the debt. I formally request that you provide me with the following:
1. A copy of the itemized hospital bill for services rendered on June 11, 2021.
2. Proof that all attempts were made to contact me, including copies of any letters sent and phone logs showing attempts to contact me via my provided phone number.
3. Documentation showing that the billing process adhered to all applicable Florida and federal laws.
Request for Pay for Delete:
Given that I did not receive any communication or itemized statement of this debt until now, and in the interest of resolving this matter amicably, I would be willing to pay the outstanding balance of $615. You are correct. The date of service was 06/11/21 and I also incorrectly entered that same date as the date of placement with Focus Financial Services. The correct date of placement was 03/06/23. Because your $615 balance is a balance after insurance, your insurance would have also mailed you your Explanation of Benefits (EOB) advising you of your responsibility (they are required to), besides the Hospital, and also the collection agency. I did a ****** search of the Massachusetts Registry of Motor Vehicles, and the requirement is 60 days to obtain a new Drivers License with a change of address to that state. Here in *******, it is 30 days. You provided the Hospital the same address as what you had on your Florida drivers license in ******* **********************, so that is where mail was sent and that address you admitted was not yours. The bottom line is we make an effort to bring the owing balance to your attention before credit reporting takes place. Now that you are aware of the balance, if you wish to do so, our client has agreed to have the delinquency deleted. After paying we can provide you a paid in full/deletion letter and we would have it removed with the credit bureau. Our phone number is ************. Payment arrangements are also an option. On 04/25/22, *************************** had services at *********************** The total charges for the services were $3,226.31. **************** presented her Florida drivers license as identification, and it was scanned into the system. She did not have any insurance coverage. ************ qualified her for a discounted rate for not having insurance and reduced the bill to $500. ************ was unsuccessful getting a resolution after they left messages and mailed letters. On 11/14/22, the $500 owing amount was placed with Focus Financial Services. That same day the Reg F letter was mailed. Voice mail messages and additional letters were done, but did not achieve resolution or a conversation. On 06/01/23, the account was ********************** reported. After our thorough review of this account, we are confident of the correct party and the correct balance that is still owed.

On 03/02/20, the $500 owing amount was placed with Focus Financial Services. That same day the Reg F letter was mailed. Voice mail messages and additional letters were done, but did not achieve resolution. One conversation with Mr ****** on 05/10/22,but it did not result in anything positive. On 09/01/20, the account was ********************** reported. After our thorough review of this account, we are confident of the correct party and the correct balance that is still owed. Responding to the complaint we received from the BBB regarding Focus Financial Services, Inc. FFS has been in operation for over ************************************************************************************************************ good standings.
On this BBB complaint, ********************* filled out her name as ***** *****, which is an error on her part. Her email address which she included shows her full name, so based on that we have decided to answer this BBB complaint rather than saying we do not know this party. ********************* has two bills owing. On 05/15/21, she brought her daughter ***** to **********************. ********************* provided her ******* drivers license as identification, and it was scanned into the system. The total charges were $1,344.93. She provided her ********************* and they were billed. B/C paid $143.07 and $565.16 was applied to her deductible and $35.77 was her coinsurance. ***************** responsibility was $600.93. After the Hospital made attempts by phone and letters, the delinquent $600.93 was placed with Focus Financial Services on 12/27/21. On this same date the validation notice was mailed to *********************. Focuss collection efforts involved letters and phone messages but did not result in a conversation with ********************* nor any payments from her towards the bill. The account was ********************** reported. After our thorough review of this account, we are confident of the correct party and the correct balances that are still owed.
