      We signed our contract with Roman Roofing on 1/18/23 and paid our deposit on 1/26/23. Since that time, we have had one issue after another. When the work started, the dumpster company leaked oil all over our driveway and broke our pavers. Tear-off and dry-in happened 5/22/23 and our roof started leaking. Roman sent crews three times to fix the leak and only found it after I went in the attic and pointed out the trouble spot. Our ceiling repeatedly got wet. Roman said they would fix that issue, but it was not fixed and we had to hire a mold remediation company to tear apart our newly remodeled bathroom. Installation of the metal roof started in August and has still not finished. Countless times I have been told the roof was finished, but then I will go on the roof and find issues. Right now, the biggest issues are unfilled s**** holes along one edge of my roof, caulk filled s**** holes along the peak of my roof, unsecured ***** trim, rust and scratches all over, and improperly bent metal. The roof was not installed to code or manufacturers standards. Crews have been promised to come out multiple times to solve the issues, most of the time, they do not show up when they are supposed to, and when they do show up, they miss items and create new problems. I want the following: 1) my roof is finished, meaning it is installed to meet the manufacturer's recommendation, no holes in the metal, even if caulk is used to fill them, that shouldn't be there, no rust or scratches, and the ***** trim is secured correctly 2) When a crew or foremen is scheduled to show up and I take off work, they show up 3) a discount is given for all the work I have had to put into the roof 4) the cost to remediate the mold and restore my bathroom is debited from the bill 5) Or I want Roman to refund my deposit and cancel my contract so I can find a contractor who knows how to install a standing seam roof.

      Roof was un completed now we have leaks causing $900 and up in ceiling damage. Also they caused me $3000 in damages when the workers cut into a water pipe flooding my laundry room. With this damage they never offered to adjust my bill nor will they come out and finish the roof.

      Roof was 100% completed to code. Roof was finaled by the county as complete. Attached you will find closed permit. Attached you will also find pictures of the before and after of the roof. The roof has modified on the top flat roof. This is proper install for her specific roof. Florida Building Code does not allow for shingles to be installed on any pitch of roof less that 3/12. The specific areas she is speaking of are 0/12 pitch (flat roofs). We are not responsible for waterlines that are illegally ran too close to the roof deck (not to code) and it states that in our contract.  Please see attached picture that it was a nail that went thru water pipe.  
      We are in an active lawsuit to obtain final payment. She is in breach of contract and has been for some time. Technically she does not have a warranty until contract is fulfilled with final payment.   Homeowner did not have any issues until she was served with a payment demand from our attorneys.

      I contracted with Roman Roofing in January 2019 to replace a roof due to a leak that was occurring above my master bath shower. The contract was for $17,800 and had a warranty clause that stated that Roman Roofing would warrant their work for 5 years. This had the additional warranty from GAF (Golden Pledge) which I don't think applies. They completed the roof in March of 2019. In June of 2020 the roof was leaking in the same location. They sent a repair man to attempt a fix. In 2021 the leak reappeared. They sent someone out to attempt a fix. It did not leak during 2022 but the same leak in 2023. January 2024 the same leak occurred again. I have had to pay to repair my ceiling on three occasions and they have not repaired the leak. This current time 01/2024 they tried to blame it on the hurricane (Sep 2022). I have written emails, called and asked for the issue to be escalated to the owner. They just ignore my emails, and phone calls. The latest leak 01/2024 has not been addressed. I spoke with ************** from their company. He stated that the company can't be held accountable after a hurricane. I had the leak which was the original reason for the new roof two years before the hurricane. ****** also on 01/05/2024 checked my roof for any previous hurricane damage and said the roof looked fine. I have requested in email and by phone to have the issue escalated to the owners. I have reached out multiple times both in writing and by phone. My request is for the company to stand behind its work and while it may be difficult to find this leak they need to fix it. I have provided the company with a copy of the contract and a letter explaining the problem in accordance with their contract. The roof was completed 03/12/2019

      We have reached out to ***************.  We informed *************** that his warranty is with GAF and that he needed to file a warranty claim.  We installed a new roof in 2019.  After Hurricane ****, he filed insurance claim with ***************************** Firm which states that he knew he had damage from the hurricane.  A couple years later the roof then went thru Hurricane *** and he contacted our office claiming to have a leak.  We stated to him that due to the hurricane and the winds being in excess of 130mph, that his standard warranty had zero coverage.  However, his warranty with GAF was still in effect and he needed to file a claim with them.  At this point, GAF would contact us (Roman Roofing) and we would schedule the repair.

      Out of good faith, we have made an appointment to come and look at the roof.  We will service the roof as needed.  *************** has agreed to sign a hold harmless contract from our attorneys stating that he understands that all warranty claims need to be ran through GAF.

      I am rejecting this response because: I will accept the companies offer when they come out and fix the roof.

      I will address the information that has been provided by Roman Roofing.

      First, I understand that I have a warranty with GAF. It is called the Golden Pledge warranty.  I also have a warranty with Roman Roofing. Here is the warranty statement from the contract which I signed with Roman Roofing on 1/18/2019. Note that the contract states Five (5) years from the date the work is completed.  The roof was completed on March 12th of 2019.  I delivered written notification to Roman about the roof issue on January 29th 2024. This latest roof leak occurred on January 15th 2024 and it is now February 26th six weeks and they have still not been out to take care of the leak. 

      EXPRESS WARRANTY Roman Roofing, Inc. expressly warrants work to have been performed in accordance with the specifications set forth on the face of this Proposal for a period of FIVE (5) YEARS from the date the work is completed. If Roman Roofing, Inc.'s work is found not to be in accordance with the requirements of the specifications set forth on the front of this Proposal, Roman Roofing, Inc. shall correct the work promptly upon receipt of written notice from Owner. THE FOREGOING EXPRESS WARRANTY IS IN LIEU OF ALL EXPRESS AND IMPLIED WARRANTIES ARISING BY OPERATION OF LAW, INCLUDING BUT NOT LIMITED TO ANY IMPLIED WARRANTY OF FITNESS FOR A PARTICULAR PURPOSE OR IMPLIED WARRANTY OF MERCHANTABILITY OR HABITABILITY AND ALL SUCH IMPLIED WARRANTIES SHALL BE DEEMED WAIVED AND RELEASED. 
      DELAY/UNKNOWN CONDITIONS: events beyond the contractor, such as acts of God, labor strikes, inclement weather, material shortages, delays due to municipal restrictions/inspections, buyers inability to qualify for or obtain financing, or other events resulting in delays in performance of this agreement do not constitute abandonment and are not included in calculating time frames for performance by contractor. In the event the contractor determines that this agreement cannot be performed as intended by the parties due to, for example, incorrect pricing, unforeseen structural defects or pre-existing conditions to the buyers property, the contractor may cancel this agreement, notify the buyer(s) of such cancellation in writing and return all monies paid by the buyer, or buyer(s) and contractor can agree to additional charges. The contractor and the buyer(s) have determined that a definite completion date is not of essence to this agreement. Under no circumstances shall Roman Roofing, Inc. be liable to owner for any damages associated with any delays caused by Roman Roofing, Inc. or its material suppliers or subcontractors.

      I am not sure what Hurricane **** has to do with this matter.  It needs to be noted that Hurricane **** was on 9/10/2017 one year and two months before signing a contract with Roman to replace our roof. We were in IL at the time of ****. We called our insurance company Tower Hill.  I have no knowledge of the ***************************** Firm. I explained that my brother-in-law found some shingle tabs in our yard and I was concerned we may have damage to our roof. Tower **** suggested we open a claim and let them know if we find damage. We arrived in ** on 9/17/2017 found no reportable damage and the claim was closed. 

      The important facts here are that we have had a leak in the same location that has reoccurred four times between 03/12/2019 when they put the roof on and 01/15/2024.  Three of these occurrences were between the dates of 03/12/2019, when they installed the roof and 09/28/2022 hurricane ***.  We have dated photos each time the leak occurred. Roman sent out a repair man under the warranty twice to attempt to fix the leak between these dates.

      Hurricane *** which occurred on 09/28/2022 did not create the reoccurring leak that has been plaguing the roof.  In fact, the roof was dry after *** and there was no damage after that storm until the 9 inches of rain ********** received on 01/15/2024 1 year and 3 months later.   I contacted Roman on 01/17/2024 to report the leak and asked them to send someone to fix the leak. This leak seems to be a situational leak. It seems to occur under certain storm conditions.  I am not sure exactly what those conditions are but there are times it has been a year between the leaks.  The latest leak on 1/15/2024 was the first time we were in ******* when the leak occurred.

      All I am asking is to have the root cause of the recurring **** identified and fixed.  My frustration lies in the fact that I had a leak above the master bath shower. I was told that my old roof needed to be replaced. I paid Roman Roofing for a new roof. I have continued to have the same recurring leak above the master bath shower almost every year since the roof was replaced.  

      I understand that Roman is working with an attorney to have a document created that they want me to sign releasing them from liability. In the future they would like me to put in a warranty claim with GAF.  Of course my fear here is that I will sign this document and their fix will not fix the issue.  I wont find out that it didnt fix the issue until  6 months to a year from now when the storm conditions are right to again cause the leak.

      I am willing to sign their agreement and accept their offer when they fix the roof.

      **** the production manager contacted me and on 2/29/2024 8:30AM. **** and a couple workers came to the house.  One of the workers got in the attic and they did a water test.  They were able to locate the leak and fixed the problem area.  They asked me to sign a holds harmless on the roof.  They explained that while my warranty with their company was almost complete I was still covered under the Golden Pledge warranty provided by GAF.  **** was unaware that my roof was still under Romans 5 year warranty.  We have had several heavy rains since the repair and there has been no leak.

      Roman Roofing replaced ******* and was paid per payment schedule listed in "their" contract. All payments were made on time and picked up in person by represntaive of Roman Roofing. When last scheduled payment came due, Roman Roofing, indicated there was an issue with the schedule of payments they listed in "their" contract being incorrect althought they excepted each payment with the final payment clearly marked "paid in full". They also cashed the check the same day. After excepting and cashing the check, Roman Roofing said they were not going to complete the final step which was the wind mitigation so I paid for that out of my pocket. Now, less then one year after the roof was put on, I have a leak that is coming into my home. My contract indicated a 5 year warranty on workmanship but I can't get Roman Roofing to answer phone calls or emails let alone honor the warranty. I am stuck paying for the damages out of pocket.

      Roman Roofing out of ********** ******* installed the wrong color shingles on my roof. My contact person thru this process was *****, we ordered Bark Wood colored shingles thru *****. I told ***** when we were choosing the color, we wanted Dark Brown. I have messages regarding the color we wanted. On 6/7/2023 approximately 1:00pm I received of phone call at my work from my daughter who was at my home telling me that "Roman Roofing is here installing the shingles and you are not going to happy, because it is not the dark brown that you wanted". My daughter took a picture and sent it to me. I called ***** immediately and told him that my roof is being installed as we speak and they are putting on the wrong color. I said ***** it is supposed to be *************** and ***** stated "yes you wanted ************* and I said yes, he said no one communicated with you?, I said communicated what, he said they (roman roofing was supposed to call you regarding the company did not have the Bark Wood"). I told him no one has called me and the communication has been terrible thru this whole process. He said I will eat this cost, someone was suppose to contact you, let me make a couple phone calls and I will get back to you. I left work and called ***** the minute I got home and told him that they are still installing theses wrong shingles, I asked him if he wanted me to tell them to stop and he stated "no, they have to finish the job", which I thought that was little weird. on 6/8 at 9:13am, 10:13am I called ***** and messaged his cell phone with no response. I then called the office and the secretary put him on the phone and he stated that **** from production said that there is a signed contract. On Friday 6/9 I then called **** in production who was extremely rude to me and he said there is a signed contract, and I said the contract has the wrong color in it, which is a mistake on your behalf and when I signed the contract, I was not looking for errors regarding the color. I was making sure the price that was quoted from ***** was the same. **** then said how about if we paint your house and I said I would have to discuss this with my husband and nothing was agreed upon on this date. **** said we will talk again on Monday 6/12. I called **** on Monday 6/12 at 1:38pm, 1:45pm, 2:28pm no response at 3:00pm **** said he was going to talk with ********************* (CEO) and would call me tomorrow before noon. Tuesday 6/13 I called **** at 10:45am, 12:45am with no response. Wednesday 6/14 1:45pm I called **** and he said, we are not going to do anything regarding this issue, possibly take $500.00 off the remaining balance owed. I said are you kidding me and he said no, I will send you the final Invoice and I said the remaining balance that I see in the portal is incorrect by an increase of $670.00. I then hung up the phone. Thank you so much for your time Mr. * ********************************

      The signed contract states the color she chose and the color we ordered and installed.  Please see attachments.  Per the contract we fulfilled our obligation.  When she called to changer her mind about the color, the roof was already 90% complete.  We still offered $500 off and to sympathize with her we offered to assist with painting her home as a customer service gester.  At this point we are in litigation for non-payment and breach of contract.

      The contract has the wrong color, the color we chose was barkwood not the color that is in the contract. We never ever ever changed our mind on the color that we chose and ***** turn bull can verify that, the day the shingles were being placed on our roof. I called him immediately and told him the wrong color was being put on our roof and he asked me if Roman Roofin ever communicated with me that they did not have the Barkwood when they went to order our shingles and I told him no.And ***** also stated I will eat the cost. Let me make a few phone calls and I have not heard another word from ******************** phone call.  **** in production offered to paint our house and that never happened. We also were told that we were going to be given a credit of $500.which I did receive on an invoice which is attached but the lien that was placed against our house does not have the $500 deduction.

      we do not have a problem paying our debt, but this is very unfair to us as the homeowner that we ended up with the wrong color shingle on our home due to the wrong color being put in the contract that we signed. Our home looks terrible.

      In early November 2022 I contracted with Roman Roofing to re-shingle my house for the sum of $8,800.00 . It took about 10 days to finally get a signed contract from them on 11/16/22. I was told it would take about 10 weeks before they could do the job. today is 4/13/23 and the job is not finished. They have $6,600 of my money already and are leaving me sit with an unfinished roof which never did leak but now it does. They have sent out subcontractors who have done damage in the process of doing the job. They either do not answer my calls and messages or when they do ,they simply say they will get back to me. Very unprofessional and most workers they send are from out of state and do not speak English so that I can communicate with them.

      This job was estimated remotely after the hurricane, the customer failed to provide information about his tubular skylights.  We were unaware there were SolaTube tubular skylights on the roof until we showed up to tear off the roof.  These are a custom order item.   We had to custom order the tops only and it took several weeks for them to come in.  The leak was on his lanai roof, which we had nothing to do with.  We were only contracted to replace the main roof, not the lanai.  Customer has since paid in full and job is 100% complete and roof has passed all inspections.

      I am rejecting this response because: The statements made by Roman roofing are in correct.

      1. The Lanai roof does not leak and was never mentioned about or asked to be any part of the re-roofing project. Have no idea why anyone at roman roofing is talking about a roof that has nothing to do with my contracted shingle roof on the main house.

      2. They were absolutely aware of the sky light solar tubes. They never communicated to me that there would take sometime to order new ones. If they would communicate they could avoid alot of issues with their customers.

      3. The job that was to be a ten week start time is now finally finished six months later.

      I contracted with Roman on 12/13/22 for doing the repairs to my roof. I have yet been given a date for the repairs to be done. The repairs are minor but if let go for much longer they could result in leaks and interior damage.

      1.  We have reached out several times for scheduling.  He has not answered phone and has not returned any calls.  We reached out 4 times and then have reached out 4 more times since the complaint has been filed.  A total of 8 calls have been made with several voicemails left.

      2.  Roman Roofing has not received a deposit

      3.  The color on his contract is no longer produced/available and that is the original reason we were reaching out to him

      We have a staff of 8 answering phones and he has never reached out to us to see when he is scheduled, but he files a complaint?

      Our desired resolution is that Mr ***** answers the phone and makes a decision on alternative color for his repair.   A second resolution is that we will gladly release him from his contract.

      I am rejecting this response because: I have called more than four times since signing the agreement back on 12/13/22. The statements above do not reflect the actual events. I've talked to several customer service folks at Roman. Pricilla and Holy were two that I spoke to.

      As far as a deposit is concerned there is no requirement on the agreement

      I'm saddened that Roman has chosen not to honor their contract. They installed our roof about four years ago and were more than pleased with the results. Apparently Roman is no longer the company we thought they were.

      If they wish to break our agreement made on 12/13 please have them inform us in writing.

      Roman Roofing started out really strong, however the minute that the deposit was paid all communication stopped. They don't answer their phone and don't even have a voicemail. They started the project and we immediately realized that they were putting the wrong color shingle on the house so we stopped them. They claim that the color that was put up was the color we chose. We went back and forth with the sales person and it came to a point that they said it would be $3500 to remove a small amount of shingles. I told them it was their fault, but that I would split that amount with them where they can eat half and I would. They refused to compromise so we had to fire them and get a much better roofing company. Completely unprofessional bunch if you can ever get in touch with them. Never answer during business hours and won't admit any mistakes.

      Contracted with Roman Roofing *** (RR ***) in 4/7/22 to do a re-roofing job on our home. Contract stated :Cover pool, lanai, pool heater and both AC units - included". Roman Roofing ***. is a GAF Master Elite Certified Installer. We gave a deposit of $5425. Job started 7/25/22 crew began tear off. No protection on lanai, pool, pool heater or AC units. Despite our communication (texts) to ***************** tarp was not used to cover pool, lanai. Wet cardboard box was put on pool heater and plywood over AC unit only after I personally stopped work. **** does not speak English despite claims on website they do. Cut plywood was placed in the gutters. This did not stop debris from going on lanai and in pool. ***** assured ** on 7/26/22, a tarp would be used to cover, as promised, but work began Tues without any such protection. No supervisor came to supervise the work being performed. RR ***. promises clean up each day and they did not. Workmanship is unacceptable. Fascia on my home is severely damaged - bent, has holes exposing wood, and is improperly installed. Roofing tar is all over our vinyl siding. Lanai screen is torn from wadded up blue tarp that was left for days, filled with rain and the weight ripped screen. Add'l screen has holes from ************** I still have nails and shingles hanging in my trees. No cleanup was done on driveway and I have collected hundred of nails and screws. We are unable to park in our own driveway. We have sent numerous messages with pictures, to ********************* (licensee and owner) and *********************************** (Production Mgr) that have gone unreturned. We have asked the licensee to come to our home to review the work and damage - no response. *************************** (RR ***.Salesperson) texted after visiting our home and seeing damage that our credits will exceed the outstanding balance on our contract and asked that we stop contacting him as there is nothing he says he can do. Roman Roofing has not registered our warranty with GAF.

      Roofing company did work for my property at **** ****** ***** in October of 2016. They did not pull a permit for the job, which totaled over $9,000. This has affected my ability to get insurance coverage and sell my property because of lack of evidence showing that the roof has been worked on since 1997. I attempted to get the company to return to certify their work, but they said they would not do it. After several attempts to contact them the end of 2020 and beginning of 2021, they would not return my emails or calls. Now that I have tried to get other roofers to estimate a replacement, they are all telling me the roof was done well and does not need to be replaced. However, I cannot obtain insurance for the home and am having difficulty since the age of roof isn't reflected in the permits. I will be spending at least another $14K or more to have the roof replaced (that doesn't really need it) because they did not do their due diligence. I have the initial contract, estimate and copies of communication as well as the final invoice and pictures showing they work done. They have tried to say that I did not uphold maintenance required by the product manufacturer, but other roofers tell me that's not really true. Hard to know who to believe in this industry. But here I am now having to replace a roof again when I really should not have to.

      Business Response /* (1000, 13, 2022/02/01) */ The homeowner filing this complaint is not the person we were contracted by to do the roof coating project.. They have since purchased the home. The project was a roof coating project and the original roof was not removed. To validate the warranty, the homeowner was responsible for the maintenance on the roof. This is not considered a brand new roof as the old was coated to extend the life of the existing roof. There is not a roofing permit that exists for this type of project. We coated this roof back in 2016. The first time we were called back to the property was in 2020 to pressure clean the roof. The homeowner we had the contract with informed our sales estimator that she needed us to come clean it because people who were looking at the home were trying to negotiate a much lower price due to roof. She stated that she knew the warranty was not transferable, that they were just trying to clean it up. We arrived to pressure wash and upon inspection, it was clear that the maintenance had not been done on the roof. There was a large amount of debris laying on the roof that should have been cleaned off regularly. The property was sold to the new homeowner. I believe this new homeowner was misinformed about what work was done on the roof. It was never replaced. We have the contracts, pictures, and payments to prove such. I am the homeowner (******* ******** *******), so comments about not being the same person are incorrect. I have copies of emails going back and forth with the company and then lack of response to provide another estimate to go ahead and coat again as they offerd. Not true that this was ONLY a coating job. The invoice itself has "small rear roof replacment" and I had to pay an additional cost for more plywood to replace aside from the rear roof, some other areas that needed it. I too have the photos, which are attached to this file. Everyone I have spoken to has said that any cost above $2500 and any wood replaced should have required an appropriate PERMIT. I spoke to the City of Fort Myers building department this week, who also concurred that a permit should have been pulled for this work that was completed, especially given that plywood was replaced and my total cost o over $9K. The city has advised me to contact Dept. of Business Regulation for the state. Even if this work is not considered a full roof replacement, it has still caused issues for me to lose insurance on the home and sales because of the perception that I have not done any work. A permit should have been pulled, period. Business Response /* (4000, 24, 2022/03/17) */ ***Document Attached*** I, also, have text message documentation between my estimator/project manager that states that we went and looked at the property. Because of the lack in maintenance all warranties should have been void (See attached pictures). We went ahead on good faith and resealed a few areas around the chimney and flashing. The City of Cape Coral does not offer a permit for a Coating Job. There is no permit to pull. We also had a hurricane in 2017 which would void any and all warranties at that point anyways. Attached is picture documentation that the roof was not taken care of, and the text messages where she notes that she is aware that there is no warranty and also that the quote to properly fix things were out of her budget.
