    Original Transaction Date: March 18, 2021 Amount Disputed: Security Deposit $1750 Luker Properties committed to a legal, fair, and reasonable execution of the lease and lease terms, specific to the return of the security deposit minus damages. The damages that have been claimed by Luker Properties are puffed up, and erroneous in an attempt to unfairly retain the entiriety of the deposit amount. The nature of the dispute began on 4/21/2022, which is the date of receipt of the communication from Luker properties stating that the intention to claim the whole amount of the security deposit. Luker properties has charged me for damage that existed at the onset of the lease, like the dilapidated patio lounge chairs, and charged me for damage that occured as a result of inoperable appliances/ amenities that was not our fault. i.e. the hot tub was leaking and eventually completely broke down and flushed itself. We notified them immediately, they did not send anyone to repair the hot tub immediately but were charged for the rust and mold that was left by the leaking hot tub. Additionally, Luker has made completely false claims, i.e., " Unit cleared of left over personal belongings" and "Damages to regrigerator Surface", and has not provided any proof of their claims. Lastly, Luker operates completely digitally from the lease signing, lease addendum signing, notifications, among other official things; Yet, in regards to disputing their "Notice of Intention to Impose Claim of Security Deposit" they submit in and require written objection, mailed to them. This is clearly used to deter and place roadblocks to keep renters from replying or disputing. A quick google search of their reviews shows that many other renters have had the same and similar experiences. I believe that Luker Properties staff are unfairly attempting to punish and penalize me as a former renter because I held them to the laws and standards.

    Business Response /* (1000, 12, 2022/06/02) */ I, Jack Luker, am writing this to dispute the complaint made against Luker Properties Group regarding the Security Deposit. Luker Properties Group, LLC is a Real Estate and Property Management company in which we take pride in taking care of all of our customers and tenants. As far as a security deposit goes, it is always in the best interest of every party to return the security deposit in full. If this happens, we know that the home was taken care of and left in the SAME condition it was rented to the tenant. When this happens, Luker Properties Group is happy because we don't have to send maintenance in to do reapirs and clean, the owners are happy because the rental property is vacant for less time and the prior tenants are happy because they receive there full security deposit back in full. There are zero benefits to Luker Properties Group keeping the security deposit as we DO NOT keep a single penny of any security deposits. Luker Properties Group had to make this claim because the house was left in an absolute mess. Along with this, we also found an ash tray full of cigarettes in the master bedroom, and the premises was left with all the windows open which is definitely not secure. I can only imagine the only reason the windows were left open was to mask the smoke smell left form smoking cigarettes in the dwelling. Smoking in the dwelling is an automatic breach of the lease agreement in itself. As a company we take pride in our move in and move out inspections. We have full documentation and pictures of both of these inspections which will paint a very clear picture in why the security deposit was claimed. I would be glad to provide both the claim letter and both sets of move in/move out inspection pictures. Please let me know where I can send a file this big..? In closing, Luker Properties Group, LLC has not done anything to steal the tenants security deposit, however claimed it on the bases of the lease terms and final condition of the property. Response to Luker Properties, LLC Reply to BBB The statements made by Luker Properties in their response are a fabricated untruth of the highest order and categorically denied. Please note that Luker Properties, LLC did not address them charging for cleaning the patio which was well rusted and stained from the first day we moved in and was noted on the initial walk through, the patio furniture already had holes in it/ them, also noted in the initial walk through, the leaks in the ceiling that we notified them about on several occasion but was ignored until towards the end of our lease, which caused the mold that they charged us for drape cleaning and all other fabric surfaces after we moved out. Luker Properties has no verifiable proof that smoking took place in the unit and their claims of smoking are denied. Please note the lease states that smoking in the unit is prohibited but does not speak to, address, or prohibit the burning of incense, sage, or palo santo for spiritual practices. This did occur in the unit and did not violate any signed lease terms. Addressing the claims made regarding the windows being left open, that was simply to air out the unit in the same fashion and for the same reason that Luker properties specify that the refrigerator is unplugged and left open in their move-out instructions. Leaving the unit's windows open/ unsecured was NOT specified in the move-out instructions and seems to be only mentioned here as a distraction from all of the previous unaddressed claims we have made. If Luker Properties has "full documentation" as it claims, then it should be submitted hastily. Otherwise, as previously requested by us and many other former renters as evidenced by their google page, and other online review forums, it should remit the whole of the security deposit. Again, Luker Properties has not provided any material evidence in their responses. A great example of this is how the before photos do not show a head-on close-up shot of the patio furniture, mainly the long chair that was already addressed as having holes in it. Furthermore, Luker properties did not address or mention in this or any of their responses that the hot tub was leaking/ inoperable on day 1 which we have already presented evidence proving. Lastly, in their most recent response, Luker Properties admitted that there was a leak coming from the master bathroom, where holes had to be cut into the ceiling to repair by their repair staff. Leak= mold, which was already addressed and we have shown evidence for. Luker properties did not respond to the interrogatories/ additional questions, request for productions, and request for admissions which, under other circumstances is an admission of guilt. We have presented our case well enough to show/ expose Luker Properties, LLC and how they operate. If that isn't enough, as previously mentioned, the online reviews on multiple sites shows the same stories from a number of former renters. It's not just us. We are just the first to file a formal complaint with an agency.
