    United States Attorney for the Eastern District of Washington vs. Lincare Holdings, Inc.

    The following describes a government action that has been resolved by either a settlement or a decision by a court or administrative agency. If the matter is being appealed, it will be noted below.

    On August 10, 2023 Lincare Holdings, Inc., a Florida-based, wholly-owned subsidiary of German multinational chemical corporation Linde plc, entered into a settlement agreement with the United States Attorney for the Eastern District of Washington to resolve allegations that it fraudulently overbilled Medicare and Medicare Advantage Plans for oxygen equipment [Case No: 2:21-cv-151-TOR (E.D. Wash.)]. Per the settlement agreement, Lincare Holdings, Inc. has agreed to pay $29 million and perform extensive corrective actions.

     

    In the settlement, Lincare admitted that it improperly billed Medicare, MA Plans, and beneficiaries for oxygen equipment rental payments and co-payments after it had already received 3 years of payments. Lincare admitted that it lacked adequate controls to ensure that MA Plans and beneficiaries were not improperly billed after 3 years of rental payments had already been received.  Lincare additionally admitted that for traditional Medicare recipients, it had controls in place to prevent improper billing, but that those controls were not always effective.  Finally, Lincare admitted that when Lincare employees raised concerns about Lincare’s billing practices, Lincare officials in its Regional Billing and Collections Office located in Spokane Valley, Washington, and at Lincare’s corporate headquarters in Clearwater, Florida, instructed them that Lincare would continue its billing practices.  The settlement announced today resolved claims that Lincare’s conduct violated the False Claims Act.

     

    As part of the settlement, Lincare entered into a 5-year Corporate Integrity Agreement with the U.S. Department of Health and Human Services, Office of Inspector General (HHS-OIG).  That Agreement requires, among other things, that Lincare implement a robust compliance and reporting program as well as a number of significant billing reforms and practices.  Additionally, the Agreement requires that Lincare retain, at its expense, independent experts to review its claims and billing practices to ensure they are appropriate.

      In November of 2023, I began receiving bills from Lincare, MDINR. These bills were paid by my insurance and I called them to ask why I was getting these bills, since I have ******** too but secondary. They told me they are a ******** only company and so I cancelled right away and returned my INR Testing device to the local office in ****************. This is the same store I received the device from in 2016. The woman was rude and did not give me a receipt. I asked but she refused and was extremely unhappy. I left hoping everything was good but now I've received another bill and I don't have any way of getting in touch with the billing department. I called the We Care line and I got a case number and the confirmed that my account was indeed closed. They keep transferring me to the pay by phone line. I'm at my wit's end trying to remedy this bill.

      I have awarded one star because this company would owe stars. My insurance co. droped the O2 supplier , the highest rate one in the area, and I replaced it with Preferred Health which was in their network. I have been with them for less than three months and they: Have not been able to supply my O2 needs and, at best, give me half of what I ordered and the delievery guy makes it seem as though they are doing my a huge favor. They refuse to supply me with a home fill unit like my pevious supplier. They refuse to supply me with a regulator that goes above 8/l per min., my previous supplier gave me regulators that went to 10/l per min and 15/l per min. They tell me that a D tank will only last me 10 to 15 minutes at 8/l per min when my experience is they last me 30 to 35 minutes. They are quick with excuses: People hoarding empty tanks, people stealing tanks. With my previous supplier had none of these problems in the four years I was with them. The customer service women I have spoken with when ordering are great, the delievery guy is O.K.. The fault seems to lie with a management team which appears to be made up of brain damaged junior high schoolers who have no idea of supply and demand. The company should change its name to Deffered Heath Care or Charlie Foxtrot (ask some one with military experience) Care.
