      A new roof was installed in July 2020. Less than a year later it developed a leak in the master bedroom. I called numerous times and was told they had been there. Whenever it rained it leaked. I had to put a bucket and towels under the leak. They came to fix it but it was raining and they couldn’t get on the roof. The next time they came they apparently attempted to seal it with silicone. Looking on the roof myself I found a nail protruding from the roof. Yesterday I consulted an attorney and he suggested the Better Business Bureau, the FDACS and the Attorney General’s office. Therefore l am consulting all three of these departments. The consultation with the attorney cost me $300.00 for his advice. If I am not successful he will send APC a letter from his law firm which will cost me $600.00.

      APC put a new roof on our home. First hurricane that hit ******* water poured in through the corner of the chimney and caused about $7000 in damage. Roofer came and fix the roof and promised to repair damage. They never showed to repair damage and put a lien against our house.

      Response to BBB Complaint Case # ********

      The homeowner called APC Roofing. This meeting triggered an insurance claim from damages sustained to their roofing surface.

      The Homeowner received a check from the ***************** for $24,446 dollars. The initial of two checks the homeowner was expected to receive. The homeowner advised that he doesn't trust companies all the much and provided a down payment of only $12,000. We trusted the homeowner to keep their word that they would pay fully or at least partial the rest of the bill immediately after the install.

      The roof was completed, and final inspection passed on 9/8/2022. For several weeks we didn't receive final payment or any partial payment. Despite calls to the homeowner to collect payment.

      On Sept 28th Hurricane *** made landfall in *******. The roof warranty with APC roofing expired when a named storm event struck the **************** as any damage caused would need to be sought after the insurance company not the roofing company. Prior to the hurricane there were no leaks reported by the homeowner.

      Despite the roof warranty being void. ***** the General Manager of the company went to the property to take photos and see if he could determine the cause of the leaking. He found a vent built into the side of the chimney that had no protective flap over the vent opening. It could be that it never had the flap or it could be that the hurricane blew it off. After identifying the probable cause he asked for payment or partial payment none was offered to him in person.

      The homeowner then called the office on Oct 14th told us he had someone come look at it and now he's convinced it is in fact the chimney flashing that's causing the leaks. Despite the warranty being void we sent a crew to re flash the chimney and to make sure it was done correctly. Even without any physical evidence brought on by the homeowner to suggest they were correct in their assessment. This was done with the promise that if we did this, the payment would immediately follow. This was done on or before Oct 26th. We waited more weeks with no full or partial payment.

      Hurricane ************************* on Nov 10th the leaking around the chimney continued, because the flashing is not the issue. The homeowner called and complained again about the continued leaking. The final ******************* had not been paid.

      ******* the Owner of APC Roofing went to the property himself to inspect and view the source of the leak. He determined and took pictures that proves that the chimney is leaking above the flashing/ decking level. Thus confirming that its not a flashing issue. The interior walls of the chimney are rotting the source appears to be the vent that was first discussed by the General Manager.

      Now despite that fact that we can prove this is not a APC roofing issue and despite the fact that this would not be covered under any roof warranty due to named storm damage. ******* provided the ** with contact info to a ***** contractor. Told the homeowner that we might even be willing to help with the bill to repair the chimney up to including the entire cost of the ****************** repairs (depending on the cost or repair). But that the homeowner would need to pay the final roof bill immediately.

      The homeowner promised it would be paid and that he would reach out to the ***** contact. This offer was not an admission of guilt but our way of saying things have not gone your way and despite us not being responsible and us being able to completely turn our back due to the hurricanes, we are still willing to help you out. This was with the hope that the homeowner would be overjoyed with our efforts to continue to assist them blat us on social media with positive reviews and of course collect final payment.

      Since the homeowner has still not paid us and the deadline to file a lien approached, contractors only have so much time in which they can file a lien after the job is complete, with the deadline looming we were forced to protect ourselves by filing a lien against the property because of the excessive delays of payment from the homeowner and the numerous broken promises of payment.

      According to the contact ******* had provided the homeowner. The homeowner never reached out to the contact to schedule an estimate for the chimney repair. It would be pointless to attempt to fix the interior until the chimney is repaired.

      The office continued calling to collect payment on 11/17, 11/22 & 12/2 left voicemails each time. Homeowner refused to return calls or discuss payment.

      The General Manager called the homeowner on Dec 12th at approximately 6:45 pm to discuss the BBB complaint and other complaints on various social media platforms and again the trend of ignoring APC Roofing continues.

      Now due to the homeowner attempting to file an illegitimate complaint against us and spreading lies through BBB and social media. Our offer to assist the homeowner with the bill to repair the chimney and interior is now void and completely gone, an issue that was not our fault to being with. Now since the homeowner is threatening legal action on the other social platforms all communication will cease between us and we will let the lawyers handle it.

      We continue to stress to the homeowner that the warranty is void in a named storm event and furthermore the source of the leak is the chimney and not the fault of APC Roofing and even if it was, the hurricanes caused damage to your home and you need to file an insurance claim for your damages.

      The current situation stands as this. The lien has been filed and the next deadline approaches before we send to the complete file to our attorney. Which will trigger the next few legal recourse actions against the homeowner until the payment is settled.
      Now we consider criminal charges for defamation.

      We have gone above and WAY beyond what any other roofing company would have done and we are getting dragged in the mud by lies.
      The homeowner has proven themselves to be completely untrustworthy, as even today Dec 12th. We have yet received anything beyond the initial down payment and nothing but complaints, and false promises. Despite the job passing final inspection and being 100% complete, its people like this homeowner that make it hard to trust people.

      Attached to this response is a picture and proof that it's the vent leaking. It makes us wonder why the homeowner ignores the blatant evidence. We now feel the homeowner never intended to pay anything beyond the initial payment.

      Paid APC Roofing 10K for roof repair. There was a lot of wood replacement and this bill is separate from the 10k roof contract. I was advised that the price of wood has increased by the salesperson Joshua C******* and would cost $3,000-$3,500. I agreed. The job started 7/22/2021 and passed inspection 7/30/2021, I received an invoice with the cost of wood totaling $7,678, over double of what I was quoted. I sent an email to the salesperson asking for an explanation. I was given pictures of the roof taken by the workers. I was not satisfied and sent another email to the General Manager. I had a meeting with the GM Brian and salesperson Joshua yesterday, 7/24/21 at my property. I was shown a ********** receipt for 25 pieces of wood but the total was whited out. I asked why and was told it was private information for their company only. I have asked for receipts and verification that all the purchased wood was used on my property to no avail.

General manager Contact Phone: 4072710209 Contact Email: [email protected] At the signing of the contract, it was explained that any rotten wood costs are extra / beyond the contract price. @ 120 a sheet of plywood or $8 LF for any timber required. This is true for any contract signed during the month her contract was signed. The roof job started on 7/22. Early in the tear-off process we discovered the rotten wood was becoming extensive in the initial area we opened. Like most roofing companies we bulk purchase our products and store them in a warehouse. We had limited quantities of wood this property required and retrieved what was available from our warehouse. We already determined that what we had available at our warehouse was not sufficient for this project. We made an early morning run to*********** and purchased our first order of various wood sizes at 8:46 am. We notified the homeowner that we have not finished determining the extent of the rotten wood damage but so far, the cost was approximately $3700 and the price would increase as we discovered more rotten wood. Homeowner asked us to keep her updated and we advised we would let her know the final amount. Later in the day as the job progressed, we had to make another run to*********** and purchased another order of wood and returned to the property. During this entire time the homeowner was available and able to see the wood rot being replaced. She was aware of the rot and knew of the extent of replacement, could have asked questions as our people were on site available to her. When the job finished, and we didn't use the final two boards in the install. We deducted the LF from the job order to keep the LF count accurate. Post job install, upon notification, the homeowner immediately complained about the total cost of the replaced wood. She advised that we only told her it was $3700. She asked the general manager to come to her property and prove to her we used that wood on her property. I brought two receipts and explained. Normally there are no receipts. Because we bulk purchase our orders and simply bring materials from our warehouse to the job sites as needed. But in her case a large chunk of her wood was on receipt. She then said, your receipts do not prove that wood was used on my property. So... I then opened our photos of the roof she had in her possession. Then I began to count boards in the photos and used a roof diagram to show her where I was counting boards in the photos and compared to the roof diagram. I added up the boards on the diagram, with the photos we had I was able to account for 625LF or $5000 of wood costs and pointed out an area on her roof, barely seen in one photo on one slope where we replaced more wood but were unable to determine from the photo how far along the roof that wood replacement went because it was mostly covered with underlayment at the time of the photo. If it went to towards the edge than that easily accounts for the remainder of the wood that we claimed, we used. While at the home of the homeowner - She advised that she would have the money by the 30th and will pay us what she "feels" she owes us. I left the property and informed the owner of APC Roofing. I then got an email from the homeowner who tried to say I only gave her one receipt. She's now complaining about how we blocked out the confidential company pricing information we have with our vendor. Our cost of the wood is not, nor should it be the issue. We have a set charge for wood for everyone she was charged the set amount. She does not need to know how much we pay for our wood purchases. On top of the fact that we are lucky in this case that there are even receipts to show her, but even with receipts she has no good faith in the receipts, no good faith in my attempts to show her we used that set amount of wood in the photos she has in her possession, she not happy with my email I sent her explaining our position and her complaint isn't the amount of wood used. It's our non-disclosure of private corporate vendor pricing. All reasonable attempts to show, explain and prove our wood use has been made. On top of her availability to create her own self assurances on the day of her roof install. It's seems she simply does not want to accept the cost of wood we used on her property, regardless of facts presented to her. We are charging her the full amount for the rotten wood costs, because. General Manager APC Roofing LLC, Clermont Office Pre-contract: Salesperson Joshua C. advised that the wood cost would be separate from the actual contract to repair the roof. Before signing the contract for 10k (cash), I asked for the cost of the replacement wood. Salesperson Joshua C advised me a few days later that the replacement wood will cost anywhere from $3,000-$3,500. I agreed and signed the contract. Again, on 7/22/21 when the job started I asked to be informed of any additional wood cost since the first order was already at $3,700. Joshua (salesperson) and Jonathan (worker) assured me that I would be informed during the process of repairing the roof. This did not happen. You state that I was available and able to see the wood rot being replaced and could have asked your APC workers to see such. Your salesperson Joshua C had previously informed me that the workers did not speak English and when I tried to ask questions this was evident. Second, your salesperson Joshua C advised me that your workers would take pictures of all replacement wood for your records as well as my view. Out of the 140 pictures I viewed, only about 40 were of the actual roof and did not show 776 LF (as stated on the invoice I received) of wood replacement. You stated that you counted 653 LF or $5,000 of replacement wood. Based on these facts above, the question of the 776 LF used on the property still remains. The quoted price of 3K-3,500 increased to $7,678 without my knowledge and without pictures to verify 776LF of replacement wood. Thank you, Note: Total price: 10k cash was paid for 1120 sq roof repair, single floor Additional Price invoiced for wood: $7,678, over double the quoted price of 3k-3,500 Business Response /* (4000, 9, 2021/09/07) */ **** your story doesn't make any sense anymore. You initially agreed that you got the wood price figure from Joshua on the day of install. Now you're saying you somehow got the wood cost from Joshua on the day you signed the contract, before anyone could have possibly ever seen your wood damages to know how much its going to cost. We didn't even know at that time you had 1x12s as decking boards. We were still under the assumption you had plywood boards like most residential homes, right up until the day of your install. At no time before the job was 100% completed, did we say to you wood was only going to cost (X amount of money), and we never quoted to you a figure of wood cost that you would have had to agree to. We could never have given you that information because we didn't know the extent of your wood damage until the roof was 100% open. We said "So far" it's about $3700 and we haven't finished evaluating your roof for wood damages. The only 'quote' we gave you was the rough estimate 'usage amount' on wood use just before we had hit the halfway mark on your roof project. Keep in mind you received that information from Joshua, who speaks English and Jonathan our field install supervisor who also speaks English, the main office was available to you via phone and email all day. At any time, you could have spoken to Joshua, Jonathan, or any of the office staff to get your questions answered. Communication cannot be a valid complaint and we said we would update you on the final amount of wood used, in fact we did once the job was complete, and we calculated the correct amount of wood used when we had to subtract some leftover wood from the final invoice amount. We did that because we don't charge people for wood we don't use and it wasn't until that time we knew how much wood was used on your property. We had already informed you the wood use was extensive and costly and we would update you the final figure when known. You won't validate or accept the receipts; you won't validate the wood use in the photos because you don't 'feel' like the wood in the photos is verification enough for what is used on your property. I have already provided reasonable evidence and assurance that we are charging the appropriate amount of wood use on your property. Our position stands, we are charging you the full amount of wood used on your property because we used that amount of wood on your property. My statements and my account of what I was and was not told makes perfect sense because it is the truth. When you and Joshua was at my property on 8/24/21, my last words to you both were "we would not be in this place today if you would have kept me informed along the way as I requested since one day one we were over the quoted amount." You both nodded your heads up and down. Regardless of how you are trying to clean up the actions of your staff/crew, the facts remain that: 1. Your salesman Joshua quoted me the price of replacement wood of $3-3,500; 2. You are unable to provide the consumer (myself) all pictures of all replaced wood covering 776 LF. By your own admission Brian, you can account for only 653LF. With that being said, a certified letter can be mailed to your office between today Friday 9/10/21 Monday 9/13/21 with a check in the amount of $6,470. Breakdown: $5,000 by your admission and proof of 653LF $720. Your invoice states this amount for Plywood - 6 sheathing boards $750 Your invoice stated 50 LF of flashing ** already paid 10k for shingles, etc When your company can verify and show me the (the consumer) 776LF of replaced wood, I will be more than happy to pay the difference. Please advise immediately whether you accept this or not. An essay is not necessary.
