      Based on an ad on *********** site for a vehicle for sale, we agreed to purchase the vehicle and paid $1,000 down per the seller's request, **** through ******. Upon further search, we found an ad for the same vehicle on ****. The **** site showed many more additional photos which were not on ********' site, showing extensive rust. and undercarriage damage. Based on the photos on **** which showed extensive rust, and the extreme cost of repair, we decided not to go through with the purchase and requested a refund of our down payment. The owner, * *, called us on March 5th,22, became hostile and refused to return our deposit. His ad post does not state that the deposit is non-refundable! We are a retired couple in our late 70s and cannot afford to walk away from our $1,000 deposit, especially when the dealer misrepresented (or hid) the poor condition of the vehicle by not posting the rust on his ******** website ad. That ad is still running with no mention of the RUST, and he listed the condition as EXCELLENT. False!       His statement is somewhat  correct, he did call me the first call  ,of 3 phone conversations before he sent the deposit ,and said he saw the **** ****** advertised 
      in ******** motor news ,he asked a few questions ,i told him the best thing to do would be go on **** and look at the car there ,are a lot more pictures and a video of the car running and driving ,with 50 pictures of the car ......he looked at **** add and called me back approximately 20 min.  later and haggled me down from $44500 to $41000 his quote to me  'help a old man out with a good deal ,its going to need some work ,I'll pay you tomorrow we both bank at wells fargo ",i told him make sure its what you want look at the video and the pictures WHAT YOU SEE IN THE AD IS EXACTLY WHAT THE CAR IS , I told him I had interest from over seas and in ********** ,he said "he wanted it " i said ok to the $41,000, I texted him my ****** address because I was driving .I said if i see the deposit in my payapl account I will take the car off the market ,and it was HIS CAR I WILL NOT SELL THE CAR TO ANYONE ELSE  ,i also told him i don't sell deposits i sell cars so make sure its what you want , i did NOT change any of the pictures of the car IN ANY OF THE ADDS ,after he sent the deposit , in my **** ad, and in our conversations, it said and i
      I said the deposit is nonrefundable .......you will see in my screen shot of our text message when he sent his email address for the paperwork 'THANK YOU FOR TAKING THE ADS DOWN'  i have sent my terms of my auctions ,that are in EVERY auction I put up ,also he dragged his feet all week  he wanted to pay with a credit card ,then he had to move money to anther account , then questions about paperwork, then  wanted copy of title ,which I complied with all of his requests .....then on Satuday  6 days after we made the deal he emails me and said he 'LOOKED AT THE PICTUES CLOSER AND DECIDED NOT TO GO THOUGH WITH THE DEAL"
      HE SHOULD HAVE LOOKED AT THE PICTURES CLOSER BEFORE SENDING A NONREFUNDABLE DEPOSIT  .........My **** add also encourages inspection before buying ............my **** feed back  is 100%  perfect ...........thank you for your time........  *** *******        TC Classic Cars  ************

      it is all lies.......you can see in my screen shot that he LOOKED AT BOTH ADS  before he sent deposit ...his quote "THANKS FOR TAKING THE ADS DOWN "........

      DEPOSITS ARE NON REFUNDABLE  IT SAYS IT EVERY WERE ........buyer remorse ......after he thought  about it , he kept saying shipping and taxes ...its a lot of money ........he wasted 2 weeks of my time .....had to relist the car again ,that cost money out of my pocket .......
       , how would he feel if i sold the car to someone else for more money and sent him back his deposit ??? would that be fair for him ....
      deposits work both was ,we agreed on a price ,he sent deposit ,i cant sell the car to nobody else for more money or any other reason ....and he commits to buying the car .......thank you for your time

      I am rejecting this response because:

       

      Frankly I couldn't understand most of his response due to poor grammar!  The fact remains that I agreed to purchase the vehicle based on his ad and the photos he listed on ********' site, NOT ****.  The photos on his Hemings's ad did not include any photos of the rust.  He should have posted the rust photos on both of his ads. His vehicle is totally rusted out, yet he is still claims that the vehicle is in "EXCELLENT" condition on his ad!

      The FLORIDA HIGHWAY SAFTY AND MOTOR VEHICLE has investigated the case and has agreed that he must return my deposit.
