    I had a recent encounter with a local lawyer. He is one of the big advertisers on the radio, and he got me good! The law office of Kenny Leigh and Associates pulled a good old fashion bait and switch on me. the short version of the story goes as follows. I contacted Kenny Leigh and had a phone consultation which he did charge for. At the end of our consultation he went over everything and said I had a solid case and his words " I would love him after this". One week later I had my first call with one of his associates to go over my case and create a filing to submit to the courts. After a very brief phone call I was informed by the associate that Mr. Leigh had missed a crucial part of my final divorce judgement. Effectively leaving me with no legal leg to stand on. I thanked him for his time and let the office know I did not wish to proceed with my case. I asked for my retainer to be refunded since according to them I have no case. They informed me that they have a no refund policy and will not return my calls or emails. I am a single father that saved up money to hire a lawyer, which I explained to Kenny Leigh. He had absolutely no problem robbing me and casting me to the side. Apparently I am not the rick male client trying to hide money from my ex wife that he is used to. I should have read more of his reviews as they are all terrible. Please help.

    I am rejecting this response because: He has offered me a very questionable refund that I have attached and invoice from his office. After the phone call with Kyle Porter I informed his office I did not wish to proceed and I wished to have my money refunded. I am requesting a full refund of any money paid to Kenny Leigh & Associates $1600. On the ground that Kenny Leigh did not provide me with the correct information in our consultation phone call. He did not do his due diligence in reviewing my case for our phone call. He is breaking his oath of admission he took when he joined the Florida bar. I have added a copy below to save you time. 

     

    To join the Florida Bar, lawyers take an Oath of Admission. 1 By its terms, every practitioner pledges fairness, integrity, and civility,2 and swears to support the state constitution.

    Email from the office of Kenny Leigh attached. Here is your smoking gun, he admits to not reviewing my divorce final judgment in his email. How could you possibly give credible legal advice with out reviewing the only document first?

    ***** had a free 10 minute consultation and the only thing we can do during that time is take the client at their word.  Once he hired us we found out from research and work that the client did not give us accurate information.  We then gave him is options moving forward and he decided that he did not want to move forward.  So we refunded any unused money.  The idea that the work done on his case to find out that he had not given us accurate information should be gifted to him makes no sense.  I feel like we are at an impasse with this client;

    I am rejecting this response because: Mr. **** has now joined in the ***! Mr.**** has stated that the consult was free. I have attached for the second time my Amex ledger that clearly shows a $100 consult charge. Again, negating any argument that due diligence was do on Kenny Leighs part during a PAID consult.

    After hiring Kenny Leigh and associates we received an order that was incorrect and I sent revisions that were never made. I kept going back and forth trying to schedule phone communication to which the office never reached out. And I was billed for an order sent to me on 4/22/24 that was never sent to me. I receive one call after my retainer contract and one order which was grossly incorrect. The revisions I communicated be made were never corrected and I was billed for services not rendered. Our contract states that I will be refunded money if the charges aren't a reasonable fee and that the office will maintain regular contact to which neither were upheld.

    Although the person who has submitted this complaint is not actually the client, I will give an answer to the complaint.

     

    Client retained our services in early February of this year.  As per our policy, initial pleadings were drafted within 48 hours of retaining.  We filed a notice of appearance within 1 week which is customary.  Client’s first missed appointment was on 2/8 as of 2/9 client had already missed two appointments, as of 2/21 we still had not heard back from the client.  On 2/26 sent a letter to the client to reschedule once again to speak with the client.  Finally received an email from the client on 3/1 and client stated allegations that were alarming.  Once again there was a phone call scheduled on 3/1 that the client missed.  Finally had a phone call with client on 3/16, very concerned about the situation we attempted to move forward.  On 3/19 had another phone call with the client and explained the seriousness of the situation.  As of 4/22 client still had yet to sign necessary court documents.  As of 5/21 client still had not provided signed documents so we sent a letter to determine if the client was moving forward with this serious case.   On 6/20 sent a letter to the client giving them a last chance deadline to respond.  Due to the fact of the many missed appointments and lack of communication and the work that was done in good faith for the client no refund is warranted.

On 2/27 I was billed for court filings created on 2/5 that were incorrect. On 3/16 I sent corrections. On 4/28 I was billed for court order created on 4/22. Second order was never provided by Kenny Leigh even though I was billed. Kenny Leigh responded no documentation was signed. That would be because knowingly lying to a court is perjury. Kenny Leigh billed for services not provided. Did not communicate appointments to the client. Did not call for scheduled appointments. And did not provide the court order that the client was charged for.

    Kenny Leigh stated that there would be a portion of the money we could not use which would be refunded and we would be notified what it was which was false. He stated that if we did not go to court we would be notified about what we would receive back.     I paid a retainer fee to the lawyers office and no service was ever provided. They took my money and told me they couldnt help me.

    Although initial retainers are typically non-refundable I did see a note to refund this client if we found after research that we did not have jurisdiction.  So the unused portion of this retainer is eligible for refund and will be sent to the billing department to begin their process.  The typical process is 60 days however since this has been sitting awhile, I will push this through to be done as soon as possible.

    After many attempts to explain that we do not do flat fee retainers and that there is no way to predict the future cost of litigation this was still confused.  After the failed attempts client submitted a BBB complaint while he was still a client.  Who also communicated that he did not have any money to continue litigation.  I am willing to write of the balance due but we can not finish the case for free.
