      Over the last few months, I have received a violation letter from Capri at Lavina Homeowners Association c/o Empire Management Group, for dead leaves on my Palm Tree. I trim up whatever they could be complaining about and get another letter for the same thing. I called and left a message for the manger "Lionel ****** and sent an email, and got no response. Upon the third letter and threat of collections, I send another email, threatening to file a complaint with the Florida Attorney General or FTC for FRAUD & Unfair Business practices, and heard from them right away. I took care of whatever they could have been talking about and was told we were all good.

      This month I get 5 Violation Letters for a variety of issues, including the Palm Tree again!! Was told "Pressure Clean Driveway & Sidewalks, Mow & Edge Lawn (Which I always do), remove dead frons from Palm Tree, raise the Canopy of Tree in Front", etc.

      I took the liberty of taking pictures of several neighbor's property, and saw "Dirty driveways & sidewalks, Palm Trees with dead frons, Front Trees with Canopies similar to mine", and asked my neighbors if they had received any violation letters from the HOA for this, and NO they did not.

      It seems that the HOA and Management think they can Harass & take Retribution against me, for complaining to them, for their unprofessional conduct, and arrogance.

      This HOA & Management is guilty of "FRAUD, Unfair Business Practices, Retribution, and Harassment", which are crimes, aside from being Unprofessional.

      You cannot single people out for "Special Treatment" and Harassment sending them violation letters requiring action, while their neighbors having the same violations, receive nothing.

      That is Unfair Business Practice, and a crime.

      I have digital copies of the violation letters, as well as the pictures I took of my property and neighbor's property for comparison and would be happy to email or upload them to you for evidence if would like them.

      Thank you for your report and concern regarding the violation process and policy for the community you reside in. I did not find the name of the individual filing the complaint on the owner records for the community in question.
      We apologize for the previous LCAM not responding, however that LCAM is no longer with our firm as of 07/08. A Director of Management performed the July inspection which took place 07/23/22.
      A result of that inspection there was 89 active violations. of those, 24 of the 48 lots in the community had multiple violations. Of the total violations, 13 were for pressure washing driveways.

      If the owner of your residence would like to review the official records of the Association, including violation records, they may submit a Formal Records request per Florida Statute and review the details noted above.
      We would recommend updating the status of the open violation's on the owner portal. That will provide up to date feedback for the Board of Directors of the community to review.
      In closing, please note, we are contracted to inspect the community once a month. In between those inspections, if you receive a violation, you may email **********@empirehoa.com to provide any updates to active violations.
      Unfortunately, we can not post or share any HOA records on this platform.

      They are lying. The pictures of my neighbors property that had the same violations and received no violation letters smells of retribution and harassment for complaining to then about their unprofessional conduct, and arrogance.

      I want you to pull their records and review them. You can do that and we don't need to submit a Formal Records request per Florida Statute and review the details.

      You the BBB can make them turn over their records and make sure they are running a fair and unbiased business, which I believe they are not.

      I have been disputing $2,256 in "unpaid" HOA fees from this company that they claim were past due HOA dues from the company that forwarded them the dues that were claimed as being unpaid. In the 4 years I owned the property before the HOA was revitalized and assigned to Empire Management, I never once received any notices through any means that any monies were due or owed by me. Upon my closing of the purchase of the property, I was given paperwork that I had no current or future HOA dues owed. 4 and a half years later in September of 2021 I received paperwork in the mail that I owed $2,256 in a past due HOA charges(in additional to $346.46 in HOA dues which included delinquent interest and a late fee since I had no knowledge at that point that the HOA existed in it's current legal active status since I had received no communication about the HOA being revitalized) and that there was an intent to lien on the property. I paid the $346.46 since the HOA had been revitalized(despite my lack of communication about the aforementioned HOA revitalization) and those were valid charges but did not pay the $2.256 since it was not a valid amount owed in any way. I was informed by an employee at this company that the "intent to lien" was merely a procedural mechanism and that the charges were negated in this companies transaction database, and I have documentation that an employee sent me showing it was. I have continued to pay the regular monthly HOA dues since then as it is now valid, however in July of this year I saw on this companies website portal that there was another intent to lien charge(which was much higher than the first one) in addition to postage and carryover interest charges. If this "past due" charge from the prior company is not completely removed and I continue to receive fraudulent lien threats I will have my attorney immediately become involved with this matter.

      We took over this community April 1, and the attached first two letters are letters notifying all homeowners of the transition. Then on August 16th a Notice of Late Assessment went out to notify the homeowner that there was a balance due. This homeowner also emailed and was advised that an audit was completed on all accounts and the balance due was in fact due and he was sent via email a ledger from the prior management company. All homeowners were instructed that we will work with them and do an extended payment plan, this homeowner did not take the offer. This homeowner stated in his first email that the HOA was voluntary, and he did not owe these funds.

      1st, I received no documentation that the HOA was incorporated until September of 2021 nor did i recieve any offer of a payment plan.

      2nd, the balance from the prior management company was not valid as I have documentation from the prior management company that the total regular HOA assessments were $0.00 and that there were no future dues owed
