I rented a mobile home on **************************************************** from 8/7/2021 to 3/9/2024. I provided the required notice to vacate on 2/23/2024 via certified mail, 15 days prior vacating as required by my lease. I included the details required including a forwarding address where to send the initial rental deposit refund. On 3/8/2024 I conducted a walkout with ********, property manager. She took photos and I took photos of the condition I left the mobile home and I handed her the keys to the property, Per my lease refund for deposits are processed weekly. I have not received a refund nor an explanation why my refund has not been sent. I sent a follow up letter on 4/9/2024 demand for deposit. Again I did not receive any response. I called ************* the week of 5/13/2024 3 times inquiring why my refund had not been sentt as it had now been over 60 days since I vacated the premises, I was told that my information had been submitted to higher management because my rental file had not been located initially but then afteri it had and I would get a return call in a week. It has now been 2 weeks and I have called several times and I keep getting told that I have to wait for a call. I am requesting my rental deposit refund as it is now almost 90 days since I vacated the property.Initial Complaint

Firstly when we moved in we were promised a bigger place which was never given to us, we cleaned up the absolute disaster that was the mobile home we got. They said they offered pest control only ever got it twice in the year and a half we were there. Our heat and AC has been on and off broken for a year they rarely answer our calls to fix it and it never stays working long. It's broken currently and the park manager would rather worry about my cats than fix it this is unacceptable, we did as she asked but we have been in a 90 degree House for almost two weeks. she shows up with no warning and we work overnights so she comes when we're sleeping and gets mad when we don't just let her in. We're two girls who live alone and she lets whoever in with absolutely no warning. They're also posting fake pictures on renting sites trying to get people that stay there.Business Response

****************** - Managers do pest control monthly but if no one is home or they refuse entry then it does not happen, however tenants can request directly with the manager at any time. Your air conditioner has been fixed prior to this complaint. All tenants are allowed up to two animals on the property. You did pay for two, but have four residing in the unit. This is against your lease agreement. Also, you are to keep your area on the outside tidy and you have been given notice to clean up your area. In order for us to assist with any work orders you will need to make arrangements with the manager to figure out a good time to come in and take care of them.Initial Complaint

My niece ****** ***** was a tenant in Livingston Family Communities' Martha Circle Community in Lutz last year. She and her family vacated your property in July 2021 and at that time was promised by the Property Manager that we would receive a check for the deposit within 6 weeks. Ms. ***** asked that the check be sent to me because I fronted the money for this deposit. After the requisite time passed, we began calling and emailing to check on the status of the refund. My emails went unanswered and my phone messages were never returned. Often I was unable to leave a message because the "mailbox (was) full." I recently sent a letter via certified mail again requesting a refund of $1130.42 out of the original $1926.90 deposit. This certified letter was sent to the address that you have listed for them and was returned listing "Vacant" as the reason. We would appreciate any help that you can give to return this money. These folks rent substandard homes which are rat and bug infested, and when something breaks, they refuse to do anything about it. For example, my niece and her family rented a unit with two bathrooms, one of which was never usable. They prey upon people down on their luck and use numerous tactics to avoid returning their hard-earned money when it's owed. I am seeking the return of this deposit so that I can use it to help out with my 4-year-old grand-niece. Thanks so much for your help.Business Response

There was a deduction of $345 for painting and cleaning, to which we have strongly objected. In addition, we were not informed that such fees would be incurred until almost a year later so that we could dispute them in a timely manner even though they had a forwarding addresses and phone numbers. I have made several attempts to receive my holding deposit back in the amount of $500 and no one is providing me with an actual reason why they are holding it. I spoke to the lady who I filed my application with and she told me I did everything that was requested of me. Once I gave this company my $500 I never heard from them again. About a week past and I rented a new place that was available now and when I contacted them back and asked how to receive my deposit back all they said is I had to mail a letter explaining my situation and I should receive my deposit back. I received a letter saying that I forfeit in my part deposit because I did not follow through which is a complete lie I followed through 100% and the only reason I'm not living at this place is because they did not have a trailer available before I found another place to live that does not give him the right to withhold my $500... $70 of the $500 t was for a credit report no one contacted me to even discuss the Credit report which is the reason why I would like to be refunded the full $500 you didn't have a place available for me to rent, I found a place that was available and that does not give you the right to keep my $500.Business Response

Please see the attached copy of the hold deposit that you signed on 4/20/22. It says that it can take up to eight weeks to find you a unit. You sent the letter on May 6th, only two weeks after signing the agreement therefore you are ineligible to receive a hold deposit because you did not comply with the terms of the agreement. These are very unethical business practices. If the agent would've told me I had to wa up to eight weeks to receive a rental or lose my money do you actually think I would've given you any of my money? This is a rental scam. This is very much a rental scam. I have called your company many times and left many voicemails, no one has yet to return 1 of my phone call. I will not accept anything but a full refund of $500. You took my money and ran with it. I still haven't been contacted by anyone and the only way I can get a response is by using the BBB. Please do the right thing and give me back alllll of my money! This is absolutely unnecessary and unprofessional that you make people go through this to get their money back. I will not except a refund for less than $430 and I would also like proof that my credit check was done on the date that you said it was done and if not I would like a refund of the $70 as well. If you would correctly teach your staff to be upfront and honest about the actual 8 week wait for a rental and the fact that nobody from your company will actually contact you to discuss your options, we wouldn't be in the situation. If your employee would have explained your policies correctly and not been misleading then I wouldn't have mailed you a notice requesting my deposit back. I would have waited the full 8 weeks and either rented from you or remained at my current residents. Once again please send me my full deposit back of $430! Either you intentionally took my money or you need to train your staff better. What date did you have a rental available? What date was I called and offered a rental? When will one of my phone calls be returned?
