    Regarding: Complaint by Mr. *********** ****** (Complaint #********)

    Dear Better Business Bureau Representative,

    Thank you for forwarding Mr. ******* complaint to our attention. We appreciate the opportunity to respond and clarify the circumstances surrounding this matter. Below is a summary of the timeline and our efforts to address his concerns:

    Engagement and Reduced Payment Arrangement
    On or around February 5, 2025, Mr. ****** signed our contract to restructure his payments to approximately $776.56 (not $687 as he alleges) for a set number of weeks.

    Bank Information and Missed Payments
    **************** signed the *** form, our team discovered that the bank account information provided initially was inaccurate. This resulted in a failed draft for at least two payments.

    We immediately reached out to Mr. ****** (via phone, email, and text) to rectify the situation. He confirmed that he could not make two payments at once and requested that one missed payment be moved to the end of his schedule. Our ****************** acknowledged this request and began processing the correctly authorized weekly payment of $776.56 going forward.

    Allegation of Instructing Him to Stop All ACH ********************* states in his complaint that we advised him to go to his bank and stop ACH altogether. Our records indicate that we only asked him to verify his ACH payments to ensure that he was not double billed.

    Unfortunately, it appears Mr. ****** placed a more general stop/hold on his account. That decision prevented timely processing of the revised, agreed-upon payment.

    *** Filing / Account Freeze
    We advised in our contract, welcome call and through enrollment the risks associated with the program and that the lenders have these collections methods available to them and we advised methods to mitigate these risks and he did not choose to exercise these methods.

    Mr. ****** references a *** filing that led to his account being frozen. It is important to note that such actions typically relate to the original creditor or merchant cash advance companynot to our company. We do not initiate or control UCC filings. Our role is to work on the clients behalf to negotiate and settle with creditors; we have no authority to file or remove a creditors UCC lien.

    Overdraft Charges and Negative Balances
    We understand and empathize with Mr. ******* frustration regarding any overdraft fees or negative balances. However, these fees often arise when a stop-payment or block is placed on an account without proper coordination. Once an ACH has already begun processing, it can be difficult for the bank to halt it midstream.

    Our team made multiple attempts to work with **************** and our own ****************** to ensure there were no duplicate or erroneous charges. We remain willing to assist him in documenting any wrongful charges if proof is provided.


    Settlement & Communication

    We have been corresponding with Mr. ****** and/or his legal representatives since early February to resolve the outstanding debt and negotiate terms with his creditor (Apple Advance). We responded to inquiries from attorneys (such as Ms. ******* **********) who contacted us on his behalf, and we remain open to further discussions to finalize a settlement.

    At no point have we refused to communicate or failed to read the contract.All adjustments and documentation were based on Mr. ******* input and explicit authorization (via e-signature).

    Request for ********************* is seeking a full refund and accuses our company of fraudulent or scambehavior. We respectfully disagree with his characterization. We have performed services in good faith under the terms of our agreementdrafting, negotiating,and communicating with relevant parties on his behalf.

    It is clear in our contract that there is a setup fee that is non-refundable,and we did not collect fees more than this amount.  Therefore, there is no remaining amount eligible for a refund.

    Conclusion
    We take our clients concerns seriously, and we regret that Mr. ****** feels dissatisfied. At all times, our goal has been to help him settle his obligations in a manageable way. We remain open to working with him (and/or his legal counsel) to address any final details, including clarifying the payment schedule and ensuring any pending ACH issues are resolved at his bank.

    I entered into an agreement with Debt Consultants Group on September 12th for assistance in managing my debt. However, I have encountered the following issues that I believe warrant your attention:Failure to Cancel Contract: I contacted them via phone within the allowable cancellation period outlined in their contract to terminate the agreement. Despite my efforts, they failed to process my cancellation request. I was transferred repeatedly between representatives, none of whom resolved my issue. Fifteen days after the agreements commencement, I sent an email requesting cancellation due to unauthorized deductions. This email went unanswered.Unauthorized Deductions: Since my initial cancellation request, the company has made unauthorized deductions from my checking account. Payments are being processed weekly, and for random incorrect amounts.Harassment and Threats: On December 24th, a representative contacted me and spoke in a demeaning manner, threatening legal action if I attempted further communication regarding cancellation. This behavior constitutes bullying, harassment, and retaliation.Failure to Honor Agreements and Threats The representative who contacted me on December 24th promised to provide a clear breakdown of what I owed. Instead, I received an email with additional unauthorized fees. The company has now imposed exorbitant fees, including $50 for each withdrawal,$35 for insufficient funds and $500 for blocking their access to my account I paid that, yet they are still taking additional payments. I have since sent a certified mail request to cancel the contract. Yet, the company continues to harass me with calls and mail, including attempting to contact me through other addresses or phone numbers I may be associated with. This violates my privacy rights, especially as per the initiated payments and successful payments out of my account. There have been no missed payments. The last successful payment was drafted on December 31st,2024.

    I called within the 3 day window to notify your company I wanted to cancel and thought it was done, till the next payments just kept coming out. When I reached out again in 15 days I was told of fees that I could pay to cancel everything . Still nothing was done. The company just keeps assigning me to different members of their group and nobody wants to hear that I wanted to cancel everything . As far as reaching out to my lenders. After trying to cancel from your company since the very beginning , I just started to reach out to the creditors ( in December) because you all havent paid anything out of the 14k deducted from my account, nothing has been paid towards any of the creditors. Your company is just waiting for everything to charge off to enter a settlement. After I keep asking to cancel my agreement, you all begin to threaten me , take out different random amounts out of my account, harass me through other addresses and locations , and bullying me into not cancelling. 

    All I am asking is to cancel the contract from the first three days. After seeing that you guys will not stop harassing me. I sent a cancelation request by mail certified recently ( you just took out another payment out of my account on the 31st) , And Ill be gladly attach the recently sent cancellation request to you . Im simply asking for you to cancel everything. Your company already collected ****** dollars from me and nothing has been paid to any of my creditors .     I no longer feel safe or comfortable speaking to you all after all of the threats and the harassment . Once again, publicly, in front of BBB, I am requesting once again to cancel our agreement , cease and decease from calling me and sending me threatening text messages along with text messages saying to wire your company 800 dollars and etc. I will attach the proof of the cancellation request  below. It shows that the address you listed on your contract isnt even your address because its now being forwarded to your forwarded address. Your company has already collected $14,000 from me and have done nothing, have not applied none of that amount to my two creditors . Again, I am requesting to end the contract, end the relationship and please stop calling me and reaching out to me at my address, my business address along with my relatives .     At this point, I am not even requesting for them to return my $14,000. But I want to be left alone. I would like to cancel the contract , stop all of the calls and harassment. I dont know what other way to put that. They are sending messages daily and leaving messages daily . I sent them the cancellation request by mail since they ignored me at 3 days by phone call, ignored me at 15 days when I emailed and paid what they asked me to. And their address on the contract is not even valid, because as I am tracking the tracking, it says its being transferred. 

    I dont know what do they need to call me about. I just need them to stop .

    This company is a ****.. they agreed to settle your loans for a reduce amount. 17k was sent in for payments and non of my lenders were paid. They kept the money and never paid my lenders. When I asked for a record of those paid they stated they do not have any records because my file was terminated for non payment. Payments were stopped due to my lender advised they had not gotten any payments. This company is a scam and should be investigate for fraud.

    Here are facts stated from the lenders  regarding this company.. More than happy to continue this issue further and bring in the companies that were supposed to be paid.. 

    *** legal department stated they made several attempts to work with company and they never responded. Amari advised me in a text message they were unable to reach a settlement and could not get in contact with CFG ... I am have worked out my own settlement with this company and have not had any problems talking to them. 

    The missed payment was due to I was not sure if my lenders was getting the payments and gave them a bank account to run payments but Zelle the payments. 

    The fact of the matter is that this could took $17,000.00 from me and my lenders gave  got nearly anything on my debt.

    When I asked for my spreadsheet of payments Amari said they were DELETED and she know longer had the payment history (REALLY). 

    So again I do not acknowledge to redraw this complaint due to this company is scamming American small business that are trying to stay in business and you can companies that promise to help but steal your money.

    The following events started on April 4 2024.My company was approached via phone calls by DCG to provide debt relief with our creditors. While we were in no need for such services, their sales pitch to halve or highly reduce our payments was very tempting.As they explained their process and how it would not cost me anything, they would negotiate fees with the creditors, we began to talking and divulged some of the financial information they required. The case was then passed on from a call representative, forget his name to **** who handles setting up the "account" and then passes you to a case manager by name of *******. During the account setup process, DCG will send over a debt settlement agreement that states what they do. I assume most people do not read this agreement in its entirety as I did not at first since they caught me during a busy time. Once the agreement is done, they immediately draft any agreed funds form your bank account via *** and to them the agreement is pretty much set. They then will tell you to call your banks and put a stop on the *** payments to your creditors since they will, in their words, negotiate and make payments on your behalf. They want you to do this because in order for them to be able to negotiate lower payments they need you to be in a state of financial grievance. Therefore the further you default on your payments, the likelier that your creditors will negotiate. This is a terrible tactic since it will destroy your business credit and financially ruin your business. Not to mention if you read the settlement agreement, DCG states that is what may/will happen and by then they will not help you.Therefore, after reading the agreement, I saw that there was a cancellation period which was 3 calendar days. I called and cancelled on April 5th 2024 and put a stop to their *** withdrawals from my bank.I then contacted ******* via phone and email requesting a refund for the original *** payment and DCG has refused.

    I am rejecting this response because:

    I am not satisfied with their response. 

    The original complaint was submitted almost one year ago and it took them this long to give an answer. Their response is very short and is still false.

    When I spoke with a phone representative from ***, I informed them that I nor my company was in financial distress, I was just looking at options to reduce my weekly payments. I was not looking of setting up my company for any financial hardships and will be able to make the weekly payments that I agreed upon with the lenders. The phone representative understood but still proceeded to sell their services.  So according to their response, " If the customer was not experiencing a hardship, it would not have been appropriate for him to enroll in our program," that is correct, I was not experiencing a hardship yet your *** representatives continued to enroll me. No one can enroll in your program on their own, someone has to do it for them so this statement is plainly false. The proof is in the screen shot images I provided since it specifically shows a name and number which by the way has been conveniently out of service. 

    Also, as I stated before, I was wise enough to cancel the agreement within the contractural terms. Which according to the contract would absolve me from any further commitments and obligations with ***. *** did not have a problem with this, their problem was keeping the money that they took directly from the ************* account without doing any work for it. This was what I wanted refunded. Instead they sent over a docu sign document outlining the terms for a reduced refund. I refused to sign this document because it was not the full amount that they took and also because it absolves them of any future litigation. They just want to settle at every chance that they can get, making sure that any legal matter takes place within their preferred courts regions and to limit any negative publicity. Well that was not going to happen so here we are now. I attempted to contact them numerous times but their phone services was out of service. They just wanted me to sign their refund agreement contract which I was not going to. I have attached the document as proof of their tactics. 

    If they want to properly settle this matter then they can issue me a refund for the total amount taken from my bank which was $ 1652.66.

    My name is *********************, former CEO of ************************* LLC. My son and I are in partnership and we obtain a five year contract with American Tire Distributors, ATD and provided services in *********, **, ******, ********, and ******* *****. The spring of 2022 we did a required bid for ATD and are was bis was for 10 more cities. We received an award of six cities in January of 2024. The bid was a substantial size requiring operational capital. We applied for a business capital loan from PayPal for $93,000.00 dollars to cover the expansion operational costs. Thirty days later our bid award was put on hold, but were told it would reopen soon. After a few months of being on hold, I decided to refinance the PayPal loan which was $1982.00 every seven days. This was not going to be a problem as our revenue was projected to around $150,000.00 per month. ATD kept delaying the bid **** so I contacted a Company called Debt Consultants Group. They reduced my payment to ****** every seven days. This transition took place over February-March 2024 time frame. ***** was when I began to receive emails from law firm saying I was way behind my PayPal payments. I called DCG and informed them of these emails and they told me to forward them to them and their legal department would take care of it. The law firm began sending me packages about my PayPal loan and that they were going to arbitration. I forward this paper again to DCG, and they had me sign paperwork to allow a law firm to represent our company ,CMC LLC. I called DCG again and asked, "Have paid anything to PayPal and they said no". They have no money but their attorneys are working on it. I have not been able to contact them and they do not answer emails. January 24, 2024 the ******************************** closed the case and award the monies to be paid. Unfortunately, no one was their to represent us even though they said they had a law frim to represent us. Having trouble finding someone who can help me.

    At the time of cancellation, the customer was in week 21 of a ******* program. Counsel was actively engaged in negotiations when the customer began experiencing Non-Sufficient Funds (NSF) issues.

    The customer subsequently requested to skip two payments and ultimately **** on the final payment before canceling the program.

    Hello,I have made several payments to have my debits paid and I have found out that payments were not being paid. I asked for an accounting report and I was told I would get one. I wanted to see where 23k went within a month. No one has told me or sent the documents. They stole from me and just say we cant give money back .

    25k was paid. First mca was less then 800 then smarter 4500. None of this add up. Where this the rest of the money go in some one pocket this is a waste of time this will never be resolved with crooks like your company. Look online of how many people you did this to scam and a room. The only way this get resolved is ********* sent back to me. No more reply from me I done. Even the ************************ was a waste of time to this was reported to multiple entity. Never again

    I would like to start with I was looking for financing for my business and was connected to a company called Diamond Debt Relief. **** who claimed that he was going to connect me with an amazing company to help me with my business debt, Debt Consultants Group. This has been nothing but NOT amazing. I hesitated at first and **** at DDR kept pressing and telling me how helpful they would be. They made me pay upfront first for start up fees which from what I have researched and by the *** is illegal. They told me they have been contacting the *** companies and now I have 2 liens placed on my business. I have paid DCG thus far 1 payment of $927.50 3 payments of $700 and 1 payment of $878.94. I have requested a refund because now I am seeing they have not resolved anything and they tell me that there are no refunds with their program and refuse to provide me with any proof of what they have resolved or paid the companies. This is completely inhumane and very discouraging. And to be completely honest illegal. Please help me get my money back so I can take care of my matters on my own so I can have these liens removed. I have tried to reach out to **** at Diamond debt relief and he now doesnt respond. H have reached out to **** and ****** at Debt consultants group and I get tossed back and forth between the 2 with responses of emails and texts telling me I am Im breach of their contract and that I will not get refunded. Its disheartening to know they have or are still doing this to other people and their businesses. Please help
