We just bought a new home in the Town of **************, ** and our subdivision (***********) is maintained by Miami Management **** We have experienced issues with them not being responsive to garbage and litter all over the community left behind by construction crews, and the area looks neglected. They advise they have no record of the calls, emails and complaints. When Hurricane ******************* Southwest *******, we wrote the *** asking for them to help secure loose building materials left across the street from our new home that could become projectiles, nothing was done.My property was just issued 3 citations, for "dry grass" that I am in a dispute with the builder who laid down poor grass/sod when the house was built, as well as my American flag on a pole in my back yard for 1) being on an easement when there are American flag poles put up by the Ave ***** Veterans Association all over the town on same rear yard easements. They also say I never asked for permission to put up my flag, which is against state statues. They argued with me on the phone saying its a "formality" and they don't deny the permission request, yet still demand I ask for permission. As far as the sod I told them the house was just built and the builder has not repaired the sod damage THEY caused.Our ****** area dream has turned into a Miami-esque nightmare because our *** leaves our neighborhood to be littered and cracks down on homeowners for their patriotic displays and golf cart parking in our own yard. I will NOT ask for permission for me to put an American flag up, and I already moved it off the easement.Add Insult to injury we just had our rates raised, all to be treated like we live in an occupied foreign city. My resolution? is to be left alone, and have *** policy on American flag displays to be in line with STATE LAW and not demand a permission form, and let people park their golf carts on our property as we see fit since this is a GOLF CART COMMUNITY. Good morning,
In response to the complaint received by Mr. ***********************,three notices were sent to ******************** on January 4, 2023 for non-compliance of the following issues.
Condition of lawn
We perform regular inspections and when we see a lawn that is in an unacceptable condition, we send notice to the homeowner to correct same. ******************** contacted management after he received the notice and advised that he was dealing with the builder on the lawn issue. We are more than happy to work with homeowners who are experiencing delays with correcting violations for a valid reason. However, we are not privy to this information unless the homeowner advises us - at which point we notate the account.
Parking golf cart on his grass in his yard / causing ruts in grass
Golf carts and vehicles are not permitted to be parked on any homeowners lawn, which is the reason ******************** received the notice. The golf cart is also causing ruts on the neighboring property.
Flagpole approval and relocation notice
Then *** is aware that Flagpoles are permitted by ******* Statute. ******************** received a notice because the pole was installed in the lake easement, which is not permitted. ******************** called the office in an extremely negative manner and did not care to listen to the administrative assistant that was explaining this to him. We do not argue, we explain and educate homeowners. The pole was not installed correctly and requires relocation. If ******************* followed the proper procedure by submitting an architectural modification request, as it states in our rules and regulations, we would have seen the placement during review and requested that it be installed with proper placement, which is not in the lake easement.
Regarding the complaints of trash and hurricane: Our maintenance staff is touring this community during working hours, every day, removing trash. If the builder has a buildup of trash due to construction, we contact them immediately, as this is their construction debris to remove. The administrative assistants response to the complaint of trash is not what ********************* is claiming. She stated she did not recall the complaint, not that the office has not received it.
During Hurricane ******** personally stayed in contact with CC Homes customer service from prep before the storm (until power was lost) and then throughout the clean-up process afterwards. The homeowners were all advised that the construction items were strapped and secured. To claim that the *** did not help in contacting the builder is false.
We suggest that ******************** contact the builder for the issues he is placing blame on the *** for. ******************** closed on August 31, 2023 and received his welcome packet via email on September 19, 2023. He should be aware of the rules and regulations of the community he chose to reside in.

I am rejecting this response because:Unlike the polite apology I received from the Ave ***** *** management *******************, this terse defensive response threatens to extend the dispute. I find it funny that I am called the "negative " party here, when in fact I was told to "call the news" if I don't like it when I said I would seek assistance from the county and town.
The facts are really being misconstrued here, the issue with the ******** flag pole was not only over placement, I was told I needed *permission* as well which is in direct violation with ******* law. I have the ******* County Commisioner for our area and ************************** board supporting me on this. I did not plant the flag, the Ave ***** Veterans Association did, the same way they have planted flags all over the town, including in lake easements behind homes. They say this is the first flag you have ever decided to cause an issue with.
In any regard, I had no problem moving it, I did have a problem asking for a certain womans permission in my *** office to plant an American flag however and the verbiage on their threatening letter.
I have since reinstalled my American flag on my own property, and sent in a map of the location per agreement with ******************* at the ***. Perhaps if the corporate supervisor ***************** would have taken the time to return my call this could have been resolved, and yet that never happened.
I desire to be left alone by this Miami based *** that seems more interested in harassing patriotic homeowners than serving them by keeping our community picked up from garbage left by the homebuilder.
Let's talk about that relationship also, I have since learned that our ***** of ********* does not even live in our community and is made up of CC ************* representatives (home builder), no wonder they get a free pass with garbage thrown in our lake and streets by their work crews.
This is also probably why the *** didnt force them to pick up debris and materials from their construction sites around us before Hurricane Ian. And yes this explains why my new home was planted with dead sod, and I (the homeowner) gets cited and the home builder gets a pass.
As far as the golf cart parking on my own yard, for a golf cart community maybe you should reconsider alternatives for golf cart parking via the street ******. For now I moved it to my driveway and it's for sale.

I spoke with ********************* the same afternoon that he submitted the complaint.
I explained our violation procedure in detail regarding his lawn. He stated that CC Homes was pending on the replacement of the sod. I then explained that unless we are advised of any pending info, we would not know. I updated the system to show that his sod will be replaced by the builder. Resolved
Regarding the ARC request for the flag pole was due to the fact that he installed the pole without advising and it was installed in the lake easement. ********************* reinstalled the pole immediately and submitted the ARC for approval. Resolved
Regarding his trash in the community complaint, I did contact CC Homes immediately for him and also sent our maintenance to his area to remove any builder trash. Resolved.

Hello On 10/07/22 I requested the trees in the back of my backyard to be trimmed. The long branches are inside my backyard and the dried leaves are staining my floors and clogging my pergola gutter. After many emails and phone calls to the property manager and supervisors nothing has been done. They keep telling me that the work is approved by Aquabella Home Owners Association and scheduled thru a ******************* As of today 12/15/22 the trees are not trimmed and my problem has not been resolved since 10/07/22 when I first reported this issue I want to mentioned that I am current in both of my accounts. Hello,
In response to this complaint, when this issue was originally brought to the property managers attention In October, she and the landscaper went to look at the trees in this area. Since they are immature (newer) trees, they have not been trimmed yet. As such, the property manager obtained quotes to have ALL of the common area trees trimmed behind these homes, not just this single tree behind this residents home. As such, it had to go to the Board for approval. The vendor who will be performing the tree trimming is currently finishing up another landscape job within the community and when this is complete, they will begin the trimming of the trees, which will take place the second week of January (tentatively).
I attempted to explain this to the resident when she called to speak to me, however, she was not receptive, responded with do your joband proceeded to hang up the phone on me while I was speaking. We wanted to resolve this for the owner but was unable to fully communicate the above successfully to her.Initial Complaint

I am a resident of ******** in Downtown *****. For month's I've been asking for a solution to the dreadful landscaping conditions in parts of our community- more specifically in front of my house- despite paying HOA fees that are supposed to take care . Not only are most of the plants dead due to lack of soil, but also whenever it rains still water will sit in our front yard fir days due to the ground not bein leveled in this are. This is causing the tree in our front yard to rot and the still water is attracting hoards of mosquitos during the summer. The first time this issue was brought up was on 6/6 and the last time I heard from the association was on 9/6, despite multiple emails sent. We understand **************** complaint and appreciate the opportunity to address the issue at a different level. ********* of ********* of ******** at Downtown ***** Homeowners Association, ***** together with Miami Management, Inc. have been diligently working to resolve the issue that has been originated by different reasons beyond the control of the ***** of ********* or Management.
First, we would like to stress the fact that ******** community is still under construction, and all the houses including the grading of the lots are being built in accordance with the approved engineering plans. However, some owners have raised the grading of the side patios without proper authorization from the Association, altering the way the pre-calculated drainage of the water from the mews into the alleys causing the stagnation of water. During regular meetings with the representatives of the different fields, the topic has been discussed in an attempt to find a permanent engineering solution that eliminates the cause of the water stagnation in the area and prevent it from continuing to happen in the future. This matter is still under review and all affected residents will be informed once the engineers decide the next course of action.Thanks

This company is ridiculous. The amount they charge for HOA fees while only providing the amenities promised MAYBE 50% of the time is EGREGIOUS. The grass in my neighborhood is almost always overgrown and the pool is only open half of the time.Business Response

Sometime in May I had an incident where the Homeowners Association (***) charged me a violation fee and locked my account online, preventing me to pay. I had to go in person to pay in a check but my account was never unlocked which was still preventing me from paying online. I contacted the *** representative and she never answered the phone, I left various messages and she never contacted us back. I finally got a hold of her via email and she stated that she sent our account to "collections" and I had to contact the ***'s lawyer. The lawyer is attempting to place a lien on the house. I keep getting group emails from Miami Management located at ************************************************************ and have asked them to remove my email from group email blasts. the building i live in, the company just pockets all the money and doesnt use it to improve the building or upkeep or repairs EVER! we have had repairs of flood damage waiting to be fixed for over a year now. its 4 out of the 5 floors have hideous damage, the lack of security cameras that would provide safety, management gets paid 60,000$ but is hardly available. they raise HOA snd rent prices during peak covid times. its mainly the lack of repairs that i am complaining about.Business Response

Thank you for reaching out to us and voicing your concerns with the building. We take great care to ensure important matters such as this are properly managed/processed. Regarding the common area hallway re-build the association received their settlement payment on May 6, 2022 from the insurance company. Currently, we are working with our contractor to begin the re-build to the hallways with a tentative schedule date end of May beginning of June which we sent an email to all residents on May 13, 2022 giving everyone an update. Again thank you so much for taking the time to share this with us. We would also like to acknowledge that we do understand that no one likes to see a rise in cost for HOA fees and the association does its up most best to work with our contractors to keep cost minimal. Currently due to factors out of our control supplies/goods are rising due to the current rate of inflation. Every year we do reach out to different vendors to obtain the best pricing for services as we take this very deeply in consideration for all ownership. We sincerely appreciate your feedback and thank you again for taking the time to reach out to us.
