Date of Transaction: December 4, 2023 The amount of money I paid to the business: $5985.00 The Business was suppose to issue me a refund, after they informed me that because of my sugar level was highly elevated they was not able to proceed with the surgery; this was the second time that they personally canceled my appointment.Nature of Dispute: Refund I started by calling the business and speaking to Ms.Odesa the front desk receptionist, asking her for a status update on my refund; she then informed me that she is not able to find any information regarding my refund and will be leaving a message to the account manager ****** stating that she will call back with information regarding my concerns. I never received a call back by anybody I went ahead and called the business again and I got to speak with Ms.Odesa again and she just gave me the run around and stated that she will put a message again for me to receive a call back with information regarding my refund, I informed her that I was already waiting for about a month for a call back from ****** and I never received any. I continued to call back every week after that to see if there was any resolution and they had informed me that the refund process has started on August 7 but till this day I keep calling back and they still have no information regarding my refund. Till this day I keep trying to get in contact with the account manager and have not been able to speak to her just keep getting the run around I then was informed by a new employee , that they did not see any refund being process in their system and just said that she was gonna put another message for the account manager to contact me but yet again I still haven't been able to speak with the account manager. On March 28, 2024, I spoke with a sales *** regarding Aqualyx, a fat-dissolving injection. I provided my credit card information; I instructed the sales ***. to hold off on running my card until I called her back for confirmation. I noticed that the location is 5 hours away. I called the sales *** back, and I was told that my card had been charged $1200, and I was requested to sign a consent form. I informed her that the closest location is 5 hours away and requested a refund. I was given an email to send the refund request to cause she stated that, technically, you did not sign anything, so we can refund you. I did not sign the consent form, nor did I sign the ledger. March 30, 2024. I spoke to the manager, ******, who stated that a request was being sent to the refund department to refund me the $1200 from my account. The Services have not been rendered. Was fraudulently charged for health service that Was not rendered. The patient ********************************* alleges that she was fraudulently billed. She had a consultation on April 3, 2024, for an Abdominal Liposuction and fat transfer. The patient completed the necessary paperwork and confirmed her readiness for the scheduled procedure on July 29, 2024. However, on the scheduled day, the practitioner assigned to the patient was involved in a severe car accident, resulting in the unfortunate passing of the Practitioners mother. This unforeseen event was beyond our control.
Given the circumstances, the patient was given the option to reschedule for the following day or that weekend. The patient declined and requested a refund. Consequently, her case was forwarded to the accounting department for processing of her refund. Subsequently, the patient raised claims of fraudulent charges to her HSA account, leading to her case being escalated to our legal department.

I am rejecting this response because:The statement of offering me a new appointment date is completely false. I was never given an alternative date. I have a transcript of every phone call if needed. Also my FSA was charged under a different company name. Central Florida rehab is not the correct name of the company on my end but that is the name on the receipt. It is very unfortunate of the circumstances but I still believe this company is still unacceptable especially since I took off work and paid for a flight. I will be seeking legal actions for further compensation

This business robbed me of $4500. They scheduled me for a procedure I did NOT agree to and purchased products I did not agree to. I never got a procedure done due to their unethical practices of promoting two similar procedures yet electing the procedure and products THEY wanted versus what I wanted. The refuse to refund me and mandate a no refund policy due to custom products- lies. Had the product been what I approved I can understand. They do not return calls and the owner ignores calls and msgs after getting ya money. Sculptra BBL is a personalized procedure tailored to each patient's body mass index (BMI) and individual objectives. In cases where patients have underlying conditions such as diabetes or hypertension, additional resources are required, and alternative techniques are employed to minimize the risk of infection.
********************** underwent a consultation for Sculptra BBL on April 22nd, 2024. During the consultation, ********************** received detailed information about the Sculptra BBL procedure, the customization of the medication used, and the refund policy. ********************** was scheduled for May 1st, 2024. Our office has ordered her customized medication and has it ready for use. Due to the personalized nature of the medication, it cannot be resold to another patient or returned to the pharmacy.
The patient's medication has a 60-day shelf life and will remain at our office unless she confirms that we can dispose of it. Once she approves that we can dispose of her Medication, we can issue a refund of $1,655, Which will reimburse us for the cost incurred on her 2 Premix Lactate bags at $1146 per bag, along with the $550 consultation fee. But as of now, the patient is not due for a full refund. Please refer to the executed contract between our practice and the patient.

I am rejecting this response because: The proposed refund amount was $1655 (should have been 1658 due to total *** charged to me being 4500). Also, the $500 consultation fee is a fee that is just being introduced in this claim. I scheduled a consultation due to the company posting "FREE consultations" to their Instagram stories.there are also multiple post that that is the only reason I requested a consultation because it was free. by definition a consultation fee is a fee paid for providing advice, guidance or expertise. consultation fees are paid prior to having a consultation done because there is no guarantee the customer will proceed with a process or procedure. the consultation fee of $500 that is now being introduced should also be refunded to me. In total, the refund offered should be $1655 + $500 = $2155.

The company offered a refund however it was an incorrect amount. I responded requesting the amount be corrected for resolution. The case should not have been closed but instead it should have allowed for the company to see the miscalculation, correct or, and provide the proper refund amount. Please reopen and allow the company to correct the calculation and issue the proper refund amount. Doing so will allow for a successful resolution

February 2024 I paid in advance to have fillers inserted into my buttocks. I specifically asked to see the nurse practitioners license to make sure this procedure is done by someone certified. A day ***** to arriving to my appointment the coordinator ****** said that they would be using a product called Aesthefill which is similar to Sculptra, I have her on tape saying this, I told her that they were misled me into receiving Sculptra because thats what they advertise. When I arrived to their ******* location they wanted me to sign paperwork that was listed under the state of *******, I asked the Administers to show their licenses, and they refused to do so, so I decided to not move forward with the procedure because I they would not verify theyre licensure, which I could of easily looked up on line, also they were going to inject a product that I did ask for. I ask them to refund my payment because I did not receive the procedure and theyve been giving me the run around. I disputed these charges for a service that I did not receive but they withdrew the funds from my account again. On February 8th, 2024, the patient underwent a consultation for Sculptra BBL, wherein the pros and cons of two different polylactic acid brands were discussed: Sculptra and Aesthefill. Both brands employ dermal fillers as the primary ingredient; however, Aesthefill is comparatively more economical than Sculptra, which is relatively more expensive due to its popularity. During the consultation, the patient received comprehensive education on both brands and decided to opt for Aesthefill, which cost $4,700.
Following the patient's booking, she wanted to know the details of her upcoming procedure. Our team of medical professionals informed the patient that a Registered Nurse or a Nurse Practitioner would be responsible for conducting the procedure. Regrettably, however, the patient remained dissatisfied with this response. We have also apprised the patient that the administration of simple injections is well within the Scope of practice of a registered nurse and a Nurse Practitioner with proper training.
Several days after the patient's initial request, she explicitly declared her preference to receive the Sculptra Brand and declined Aesthefill. Consequently, we promptly upgraded her package to the Sculptra Brand without additional charges.
On February 28, 2024, the patient arrived at our medical facility for her procedure. During her visit, she requested to examine and obtain a copy of the practitioner's license for all ********************** employees. The demand placed the Registered Nurse and Nurse Practitioner on staff in an uncomfortable situation as they had never been asked to provide a copy of their license to a patient previously. The Nurse Practitioner who was scheduled to do her procedure was apprehensive that the patient might utilize the copies for illicit purposes, potentially endangering her license. Consequently, the Nurse Practitioner informed upper management, who recommended that the Nurse Practitioner present her license and identification to establish her identity without providing the patient a copy.
Upon the return of the nurse practitioner to provide the requested documentation, Ms. ******** vacated the premises and expressed her opinion that our facility lacked licensed practitioners.
The patient relations manager contacted the patient, requesting her to return to complete her procedure because the products had been mixed. However, the patient expressed dissatisfaction with the process due to the failure to provide copies of the nurse license and identification upon request.
The patient relations manager effectively managed to calm *************** and was able to reschedule the appointment. The manager also arranged an additional supply of Sculptra Vials for the patient's upcoming procedure. However, on the appointed day of March 27th, 2024, the patient failed to attend the appointment, resulting in a second loss of products.
The patient in question subsequently initiated a chargeback with her bank, alleging that we were operating without a license and administering Aesthefill. In response, we provided the bank with a range of documentation to demonstrate our compliance and adherence to industry standards for both Aesthefill and Sculptra. This included the qualifications and certification of the Nurse Practitioner who was scheduled to undertake the procedure, as well as the medical director's license. We also shared evidence of our purchase of authentic Sculptra Vials for use with the patient, as well as the contractual agreements that we had in place with her.
The following incident was somewhat unusual. However, our establishment made every attempt to assist the patient concerned, albeit with regrettable outcomes. Despite our best efforts, we were unable to achieve the desired result.Customer Answer

I met with the owner ***** ********* who assured me that they would make things right. I had a licensed Nurse ****** *********, who performed the first session said she would do the second session. I found out later that that nurse quit as do most of the employees there because of bad business practices. ***** proceeded to tell me she will get a nurse from another location to come to ******* to perform the procedure. That never happened, instead an unlicensed person tried to accomplish, but failed miserably! This same unlicensed individual also assisted a double board-certified surgeon in other surgical procedures that required a licensed nurse. I complained again to *****, who stated again that they would start for scratch and get it right. I had an appointment in November, which the same unlicensed person performed the procedure because the said the licensed nurse was not available. They had scheduled the second session for December which they cancelled because the ran out of products. I not sure of ANY business that runs out of products for the second time. I tried to call to see when I can schedule, but I keep getting the run- around from the new receptionist there. She told me the person was running an errand, then I called later, she then told me that the person went out to get lunch. One excuse after another, I left my number but no returned call. This is the final straw; I do not want to proceed as far as them trying to redeem themselves. The company has several complaints against them and also a high work turnover. They say they have board certified people performing procedures there, but that's not the case. I am requesting my returned monies, as they did not produce what they claimed I would get. Update: They finally called a left a voicemail message on 1/8/25 at 3:43pm to tell me that they did not return my call due to the fact that they only have products for people that have paid. This company is false advertising services. For me it was specifically the liquid bbl. The pictures they post on their sites are misleading. They only show the results of the procedure right after, saying that those are the results you will have for 1 year. That is in fact not correct. The results that are seen by potential clients, only lasts for 24 hours. Once the 24 hours are up the results go away! I wasted over 2000$ for this procedure with the hopes that my hips & buttocks would expand in volume and I would have that look for at least 1 year because that’s what they advertised. We perform liquid BBL using Sculptra a dermal filler made of poly-lactic acid. Depending on the patient's shape and size, this procedure is a build-on process that most patients must finish in at least three sessions for desired results. Results last for two to five years after a patient has finished the recommended course of treatment.
You received a free consultation on February 24, 2022, during the consultation we informed you about our liquid BBL and developed a treatment strategy based on your body type and your individual objectives. According to the size and shape of your body, it was advised that you undergo 3 to 4 injection sessions. Based off your notes, You indicated that you would like to begin with a single session. You didn't return for the remaining sessions of the treatment plan after that initial one.
Results from patients who strictly adhered to the suggested treatment strategies vary on our IG page. This is why we offer free consultations to patients who have questions and ensure that the information we give is correct.

I am rejecting this response because:After reviewing your ** posts displaying the Liquid BBL again, I do realize that I am in fact correct. You stated, “Get immediate and permanent results” after inserting a picture of someone who just got off the table. I feel that’s a marketing strategy you are using to mislead potential customers into believing that is the look they will have immediately and permanently because that’s what you literally state. Not once does it say anything about the product absorbing back into the body after 24 hours(which what I was told what had happened when I woke up the next day to the same exact body I had before the session).Why would I spend thousands of more dollars if I see zero results from the first session. Would you? That’s completely unacceptable! I’ve inserted pictures of how I looked right after I received my first session. The look was perfect! I wouldn’t have wanted any more sessions after that. I also inserted a photo of how I look now, and as you can see there’s a big difference. The hips and buttocks volume I paid thousands of dollars for are gone! How is anything about that permanent?
Also, I recall the nurse saying that it takes about 3 months after the session to see results. That NEVER happened. Again proving that this is a hoax because how is that immediate?

I had aqualyx a fat dissolving injection done to my chin in January 2022. I did my research and also a consultation with them. They told me what to expect and recovery time. The day I had the injection done I was swollen like a bullfrog which was expected. They said the swelling should only last for 2 weeks. Told me to massage, wear chin compressions, no smoking or alcohol which I followed. 5 weeks later my face was still swollen, sore and had lumps. They did ultrasound maintenance on my chin area and told me to give it more time. About 10 weeks out the swelling was actually spreading from my chin to my jawline and neck area. When I tired to massage the pain was unbearable and the lumps got worst. I did a follow up call with them and the situation. They did not help. All I was told to wait longer and put ice on it. They didn’t answer any of my concerns and actually were very confused. During the call she kept putting me on hold to look for an answer to my question. It got to the point where I had to accept my facd is now disfigured and smooth body contour does not care about helping their client that’s suffering. It’s been around 13 weeks now and my face is very much swollen, sore and lumpy. I have to wear a mask on my chin area to hide my deformed chin area. I am really uncomfortable and not sure what to do. I tired speaking with smooth body contour again but this time the lady was very rude. She accused me of making this up. Why would I waste my time lying about being in pain. I asked what can be done to fix the problem. She said they couldn’t do anything. What? At least exam my face and offer me something. I’m your client suffering from a treatment y’all did incorrectly. It’s said that some medical spa will neglected their client instead of taking accountability and making the situation easier on bother parties. On January 11th, you received a free consultation for fat-dissolving injections for your chin. You were recommended to complete two sessions and only completed one. On January 19th, 2023, you arrived for your first procedure, and a photo was taken.
On February 14th, over a month after your first procedure, you spoke to our District Manager. You explained that you did not like your results and no longer wanted to continue with your second procedure but wanted to try another service. We gladly transferred your credit to another service and continued to maintain your chin at no additional charge.
Four Months after your procedure, you said your face was disfigured and swollen. Our Practitioners never said you lied, but found it strange to have an adverse reaction one to four months after your chin injections.
Most patients will experience mild swelling and redness 5 days after the procedure. We have never seen one month, let alone four months, after injections.
