I signed up to join this gym at the end of last year assuming that I would be able to travel to ******* more often as I live in *********. My work situation changed so that I will not be returning to ******* for the foreseeable future, so I would like to cancel my membership. They will not let me cancel unless I see them in person, or send a letter. I believe this is in violation of the Health Studio Act. I simply want to cancel my membership.Business Response

With our cancellation policy we do have to come in person or send certified mail in letter . With the Health Studio Act it states that it must be as easy as to cancel as it is to sign up. Per our sign up policy , you are not fully enrolled until you come in person and confirm your account with proper identification, so we ask you come in person to close out your account with a proper signature. We do give the option to send a certified letter that requires your signature, if you have left the state or are unable to come in. Our cancellation policy is also outlined in our membership contract as well as reiterated verbally at the time of sign up. All patrons must fully consent to the cancellation policy via signature on the contract at the time of sign up in order to fully enroll.Initial Complaint

May 3rd, 2023 10:00 AM; Cancelled membership in person at Amped Fitness (spoke with young man at service counter, Manager was not available) to be affective June 1st.June 8th I was billed again $236.47 for membership, I paid this amount.June 1st, 9 AM; went into gym again and spoke with a young woman who said she cancelled my membership and would pass this on to the manager. June 29th met with manager finally to sign; yet again to process my cancellation. (3rd attempt to cancel)July 8th I was billed again $236.47. I disputed this charge with my credit card company and won.November 2023 Amped sent me to collection services for July's billing of $236.47. I'm refusing to pay for a membership that I made 3 attempts to cancel in person at their facility. This is bad management and lack of care for their members. I signed up for Amped fitness at the Tyrone location in October of 2021 as I had recently moved to the area for college. November of this month I had to unexpectedly move back home (over 20 hours away from any Amped fitnesses) due to a family emergency. Once I realized I would not be returning back to ******* for the foreseeable future, I called my gym to let them know to cancel my membership. I was then informed the only way to cancel my membership would be to go in person.. when I informed them I was 22 hours away back in NY, I was told I could send a certified letter to the gym instead (seems like a whole lot of work for a gym membership) and that it would take 30 days to process my request after they received the letter. I asked if I would have to pay for the 1-2 months worth of membership (depending on when they receive and "process" my request) my request and they said yes. Hi ****,
I do apologize that the cancelling process has not gone as smoothly as you would like. I will go ahead and cancel out your membership for you but please understand our front desk associates aren't trying to make things challenging for you, it is just the policy and they sometimes look like the bad guys for enforcing it. I have attached a copy of your agreement for you, one page 3 under the 'Renewal Program' section it states "The agreement may be cancelled at any time with a 30 day written notice delivered to the club's address... The member will be required to make any scheduled payments that are due within the 30 day notice to cancel."

First off go read there one star reviews a lot of people have been having the same issue but heres my story I signed up for one year of personal training paid for my one year of personal training and then life changed and my trainer stopped scheduling me and I stopped scheduling at that same time I stop getting charged fast forward to five months later and now I am being charged originally $1200 charge now $1500 for personal training sessions that was never signed up for and they are trying to make it impossible to cancel the membership Ive never changed any account information in the first charge I got from them since I stopped going was the $1200 charge. They have multiple ways of contacting me if payments were not being processed right I never got contacted.Business Response

I am sorry to hear you are unhappy with our cancellation policy although per your agreement your reoccurring service will continue month to month into auto-renewal after the term agreement upon ends. I know you mentioned through our email thread that your schedule at work changed, which is making it harder for you to get into the gym unfortunately that does not give ********** to cancel your program. Also, I do know your account went delinquent during that time of non use which your are still responsible to pay even if the service wasn't used. As I suggested via our email you still have access to all those sessions! I would encourage you to use those sessions that you have purchased. We can definitely get you with another great trainer!
I have attached a screenshot of your agreement and highlighted the session that explains our cancellation process to end your service. If you have any other questions please don't hesitate to reach out.

Business promised to help me with my health,to help me achieve my goals,to be on time for the sessions,that I was going to see a female trainer.I requested a female trainer,&on my 1st session they scheduled me w the wrong person. I arrived on time & was waiting for 1 hour since no one knew who was supposed to see me. My 1st session was not a full session, the guy just took my measurements. I had to talk to the manager directly in person so she could schedule me with the correct person.The 2nd time I came in to have my session with my trainer, I was there right on time & had to wait for her 30 minutes! That day I was expecting her to show me some exercises,she didnt. I was supposed to be with her for an hour,30 minutes for the small talk session & 30 minutes for my 1st workout.Third time I come it's a small training for ************************************* throw a ball, use some dumbbell and showed me one machine. This training was considered my second workout session, this was never clarified to ****** was confused since I was expecting a workout. This was the first time she showed me any kind of exercise.For our next session I texted her in advance, and she told me she was fired,2 contact the gym.I wasupset because I wasnt called in advance or gave any sort of noticed by the gym about this. I decide I am no longer going to deal with this very irresponsible gym and to cancel everything since they did not comply to what they promised by making a mess out of my schedule seeing me very late even though I was on time, putting me in the wrong person schedule, and not giving me a noticed in advance after they fired my trainer.These sessions are by appointment & if I miss 1, they Dont refund me they dont reschedule me. This is why I did my part by being on time and showing up for every appointment. While they didnt and provided a horrible service.I have payed $170 for bad service. I want a refund and I dont want to pay $250 fee for canceling, & this was NEVER explainedBusiness Response

Hi ******, we do apologize for the inconvenience and your experience with your first trainer. It's not often but sometimes we do have to let trainers go. We do our best to get all their clients reschedule ASAP but on occasion a client might slip through the cracks, which we do apologize for.
Per your agreement, under the governing law section, it does states though, "IT IS THE RESPONSIBILITY OF THE CLIENT TO SCHEDULE TRAINING SESSIONS. FAILURE TO SCHEDULE SESSIONS IN NO WAY CONSTITUTES THE RIGHT TO CANCEL YOUR CONTRACT."
We can understand your frustration with the changes but hope we can continue to help you achieve your fitness goals. We have many other amazing trainers available for you. If you would still like to cancel at this time you may but their is a buyout for ending the term early.
You can see under the "Buyers Rights" section of your signed agreement our buyout policy that states, "You may buyout this agreement at any time, provided your account is in good status, by paying a cancellation fee of $250.00."
Our hope is that you will continue with your program with us and utilize the services. We want to help get you to your goals!
