      We worked with Holiday pools on a design for our new home, we gave a deposit to Holiday Pools 2 months earlier than we actually needed to. We were told if we did this we could avoid their upcoming price increase. A week after signing the contract we reached out to our Sales person ***** ***** and told her that we needed to cancel our contract as we could no longer move forward due to medical reasons, we were no longer able to build our home so we couldn't move forward with the pool.These were unforseen conditions so we asked if we could have an exception for medical reasons and would they be able to return our deposit since we were so early in the process and they hadn't done anything yet.Holiday pools had not ordered anything for us, begun and of the engineering process or permitting process which the deposit usually is meant to cover, they suffered no "cost" at all but refuse to return our deposit. We were still 4 months out from even owning the home where the pool was to be built. I asked a week ago if there was a manager or someone else I could speak with to resolve this and there was no response. ***** only says her hands are tied. We signed the contract and left the 10% deposit in good faith , never thinking that we wouldn't be able to move forward with the project. No costs have been incurred by Holiday Pools on our behalf, they are just keeping our money because they know it is non refundable , even though they haven't done anything that the deposit is usually used for and the reason for our cancellation is due to a medical condition which no longer allows us to move forward with building a house in Florida. We offered to compensate for the design of the pool and there was no response. At this point we are looking to see if the BBB can step in to get any of our money back.

      I am rejecting this response because:  We are asking for an exception because of a medical reason for having to cancel the contract. We were atleast 3 to 4 months out from building the pool. Nothing had been started on the pool, no permitting, engineering  or construction. Holiday Pools suffered no "cost" because we canceled, we even offered that they take some money for the pool design which is usually part of their process and included even if someone goes elsewhere before signing a contract. Holiday pools is keeping over $7,000 of ours even though they have done nothing for us and some how they justify doing this without taking a closer look and realizing that we were working in good faith and only had to back out because we had a medical issue come up, we realize that the deposit is non refundable and are looking for a little bit of understanding of the situation . We cancelled a week after signing, again, nothing was done on their end that justifies them keeping all of our deposit

      In April 2024 my neighbor was installing a pool with Holiday Pools. When they sprayed the gunite, it was breezy and it hit my lanai/cage. Our neighbor alerted Holiday and the came out to power wash. When the power washing was not working, the employees of Holiday went to ********** to get something that would help remove the gunite. Well come to find out a day later that the something that would help was Acid. So this hit our lanai, cage, grass and 5 week old hot tub and cover. Through a ton of work (emails and calls) by my husband and myself, the grass and screen were both replaced but not my hot tub cover. I am past being angry about it. The neighbor contacted them 2 weeks ago, but they already received their money so I am not expecting much action. This would be a $1,250 expense for me and I didn't invite them into my life! If there is no resolution by my next day off, I am filing with small claims court.

      This is a complaint against Holiday Pools concerning their failure to rectify punch list items after pool construction was completed in August. First, it must be said that pool construction was itself a good experience overall and communication during the construction process was very good.After the final payment was made, however, attention to the remaining punch list items has dropped off along with communication about progress to address those remaining items. In particular, there are several issues involving the pool cage, including a screen tear and broken door sweep. There was also damage to an existing lanai enclosure that has not yet been repaired.Additionally, the pool light has never worked, and we have been told that an incorrect controller was installed.Finally, the overflow drain is too high and therefore does not function. The pool must be drained manually after storms.

      In January of 2023 we purchased a home in ******* in *****************, **********, ** that was built by ****** and had a pool installed by Holiday Pools of west Florida. That same year we entered a contract with holiday pools in March to maintain our pool on a weekly basis. In 2024 we renewed our contract. Two weeks ago this year we noticed our pool losing water. We called holiday pools and had to leave a message. We called again and left a message. We have been calling for more than two weeks and leaving messages and getting no response. We have left more than five voice mails and have received no response. In the meantime our pool needs to be filled everyday so that the pool water doesnt get so low that the pool equipment thats running doesnt get burned out. We dont know what to do. I cant believe that we cant get someone to respond. The pool came as part of the home purchase so Im not sure exactly what our warranty is but we have a yearly contract to maintain the pool and we cant get a call back. Our last voicemail we left we said that if we dont get a call back we will have to proceed with other options. We didnt get a call back and its been four days.

      I was able to reach Holiday Pools and they came out and fixed the leak in the pool.  The repair *** told me that the drains were not installed properly and there were two holes.  The pool is not even 2 years old.  I told them I didnt think I should have to pay for something that wasnt installed properly.  The repair *** said he will leave and not fix it unless I say I will pay.  I was not told how much it will cost and I havent received a bill yet.  Im very worried but at least Im not losing an inch of water everyday.

      We purchased a new home with pool put in during the build. We closed on our home 12/7/2023. Holiday Pools refuses to communicate effectively and will not make an appointment to complete the warranty work. We have reached out to ********************* with ******************* **************************, and owner ***********************. The last communication was from *************************** on 5/31/2024 who stated that someone would come to our home on 6/4/2024 with the correct **** door. The one that originally came with pool would come off anytime there was movement in the pool and just float around pool, and the 2nd one they gave us randomly jams itself and causes the pool pump to not work (Not to mention 2 that were dropped off a month or so ago that are way too wide for the opening. No one has come, returned emails, or called to reschedule. In addition to the **** door, we have some major warranty work to be completed to include:1) Large gap between pavers and lanai wall needs fixed 2) Gaps between pool overflow drain strips needs fixed (Holiday needs to coordinate this work with the builder as the builder will need to get the lanai cage company involved to loosen/remove part of cage so drain strips can be put together. 3) Unsafe grade off both paver pads outside of lanai doors needs rectified and erosion issue needs addressed and fixed.We have been extremely patient but after so many emails and calls with no resolution and (usually) no response/communication we are at a loss on how else to get this resolved. We are very reasonable people but this has become a nightmare. We have sent countless emails asking for updates and resolution.

      SIGNED THE CONTRACT FOR A **** ON 2/4/22. TODAY IS 5/22/24 AND THE **** IS STILL NOT COMPLETED. THE AMOUND OF TIME THE **** TOOK FROM SIGNING TO FILLING WITH WATER SHOULD BE PUNISHABLE ALONE, BUT MY COMPLAINT IS FOR THEM TO FINISH THE ****.       We are working on getting the deck painted and the child safety fence inspected and repaired. We used a subconstrctor for the past 20 years that handled deck painting and installed child safety fences.  ************ abruptly closed without giving us any notice.  We are working on getting this taken care of.  As for the gap between the house and the deck I will get pictures of that and see what the issue is.  The deck is poured level and typically this is an issue with the house stucco not being taken down far enough but we will confirm that.

      I am rejecting this response because:

      For 2 years we have heard "we are working on it". After several numerous visits to their office, several unanswered emails, 2 calls and 2 texts to the owner, and a BBB complaint, a contractor showed up to take notes. He was great! He apologized for the lack of effort from Holiday Pools and spent 2 hours fixing the gap between the house and deck. The gap was not from the stucco issues, the concrete from the pool deck was not poured all the way to the house causing the gap. The gap has now been filled. The remaining issues with the construction have NOT been completed.

      If the sub-contractor went out of business I would guess you found a new vendor asap to help complete the ~800 pools that have been dug in the past year. I provided a contractor and a quote to complete our pool. To paint the deck I don't understand how it would take so long to find someone that can pressure wash the deck and roll paint on.

      Lastly, I've mentioned that I would like reimbursement for the $2k in pavers that I had to replace, without any response from Holiday Pools. Video evidence was shown to all Holiday Pools / ****** **** Services / Gunite team members that have been on site with an assurance that I would heard directly from the owner. I assume I will receive an answer about that too in the near future.

      I am rejecting this response because:

      When the guy from Holiday Pools came out to look at the fence during pool school, I showed him the fence would not close properly. When he tried to pull the fence tight to close, it pulled the screws out of the lanai. It now leaves a gap large enough for a child to climb through. He apologized and said someone would come out to fix it and he said one section needed to be redone to close properly. When the new contractor came out on 5/28 I tried explaining that if all sections were still fastened to the lanai we would not be able to close it, and if you close it now as it, it pulls away from the lanai far enough for my child to squeeze through it. Easiest way to describe it is one section of the fence needs an additional few inches added on and the fasteners need reattached to the lanai that connect to the fence.

      Let me know when I can expect to hear about reimbursing the pavers.

      We had Holiday Pools install a pool for us. Project started in Jan 2023 and was finished up in Aug. 2023. Its been noted that the pool was losing water quickly and there was water noted around the pump so its clearly leaking somewhere. We have reached out to them about the ************ sent someone out on Jan 5th who just put a bucket in the pool with a line marked on it. Well it rained significantly the entire weekend so this isnt a good evaluation of how much water was lost from the pool to begin with, but no one ever came back anyway. My husband sent pictures to the man via ********* said he would let someone know. Since Jan 8th, we have tried contacting them multiple times both via text and email with no response. We just want this leak fixed.

      We have sent a technician out to this home on multiple occasions for leak checks.  Not just the weekend that it rained.  No leak was found.  It is not uncommon for homeowners to think that natural evaporation is a leak.  However, no leak was found.

      I am rejecting this response because: your technician, ****, did just come back out on 2/1 after this complaint was made with the BBB & in fact said there was a leak around one of the pool jets when he did the dye test. He then placed a sticker in the skimmer area to observe the amount of water loss, but has never came back. In just 48 hours the pool lost 1/2 inch of water according to this sticker he placed. Havent heard back about what was going to be done about the leak. **** did fix the issue we had with the light while he was here.

      The new pool construction is incomplete . The pool has never been used and leaks. Their pool school employee could not place salt in the pool due to the severe leak. I have contacted Holiday pools daily. They can not give me a date in which they can come out to conduct a leak detection. The pavers have not been sealed or pressure clean. My bar and grill was damaged and they refuse to repair. The employees act as if the are doing me a favor by responding to my concerns. I have spent ****** on this project. I have had 2 pools built before and I have never encounter these issues . It has taken one year to build a 16x30 pool.

      There was a leak on this pool which can happen.  Leaks are not uncommon but we found the location and repaired it.  The salt has been installed also.  This should be closed as the repair was complete.

      Holiday pools installed the pool that came with my new construction house. Before I closed on the property there was an issue with the pool losing water. I was told nothing to worry about. I added water and 2 days later I lost over 5 inches of water. I filled several work orders and after a week they finally found the leak was coming from a bad install. It has now been 2 weeks and no one answers the phone, emails, or has show up to discuss the major repair that is needed. The leak is underground and a constant leak will cause the earth under my pavers to wash away. This can lead to a huge safety problem if my yard was to collapse. My builder ****** has even reached out to holiday and havent heard back from them either. This situation needs to be fixed asap. If I dont hear back by 11/15 I will contact an attorney and take this to court.

      My spouse and I hired Holiday Pools to design and construct an inground swimming pool, a lanai made with travertine tile. Ultimately the company required ** to pay them in full well before the work was complete, and threatened to *** us for breach of contract if we did not pay them before they did the work, in an attempt to extort funds with the malicious intent of providing unreasonable and substandard work. The work was so substandard that the Lanai is almost unusable now. It has many safety risks in that the tile work is so uneven, that there are places where the tiles have sunken in so much that they stand up vertically. There are inches between the leveling, which is a risk for anyone walking on our lanai. We have attempted to communicate via email, first class mail and left phone messages for the owner of the company, ***, who has refused to communicate. Since we paid in May, 2023 in full, the lanai has proven not just subpar but hazardous. As indicated by the attached photos, the tile work is so uneven that some tiles protrude dangerously, creating tripping risks. Our pool maintenance crew has expressed concerns over the tiles shifting underfoot, a clear safety violation.We've reached out repeatedly to ***, the owner, via all communication channels. Despite their daily presence in our neighborhood for other projects, our requests have been met with silence.I've attached fresh evidence of the poor workmanship. It's disheartening to say, but the lanai is close to unusable in its current state.We're at a point where further silence from Holiday Pools isn't just unprofessional; it's unacceptable, and likely violates the communication requirements set forth by the Florida consumer protection act and the code of ethics set forth by **** license requirements. I'm hopeful for the BBB's assistance before taking this to the Florida ******** of ********** I am hopeful the BBB can intervene and help us come to a resolution amenable to all parties.

      Holiday Pools has gone over and above to satisfy this homeowner.  We had several deck crews spend several days on their deck just to satisfy both him and his wife.  We first had them work a day going over any issues that ********************** had only to have his wife not agree and had to send another crew out to go over issue that she had.  Before we were done we had both of them agree that the deck was complete to their satisaction. Before we would complete the pool project we asked that the pool be paid for in accordanace to the signed construction agreement. The contract states that the final payment is made prior to the interior of the pool being installed.  We could not move forward with scheduling the interior until final payment was made.  See attached copy of contract front page showing draw schedule and final payment. 

       

      On page 7 and 9 clearly states that the deck is not warranted aginst settling, checking, raising of cracking.  This pool has been complete for over 8 months.  We have sand in Florida and decks can settle.  We performed our terms of the contract.

      I am rejecting this response because:

      Holiday Pools' assertion that they have fulfilled their obligations and resolved our concerns is inconsistent with the reality of the situation. Despite multiple crews being dispatched, the end result remains unsatisfactory and, crucially, unsafe. The resolution we agreed upon has not been achieved; verbal commitments made by their team, which were recorded for transparency, regarding the necessary rework post-settlement have not been honored.

      Moreover,the claim of satisfactory communication is contrary to our experience. Our attempts to engage with Holiday Pools through email and other communication channels have repeatedly been met with silence. When we have raised this issue,the company has denied receipt of any correspondence, leaving us with no choice but to question the integrity of their communication practices.

      This pattern of non-response and the dismissal of our concerns leads us to believe that Holiday Pools is engaging in a pattern of unfair and deceptive business practices. Such practices, we fear, may be in violation of the Florida Deceptive and Unfair Trade Practices Act (FDUTPA), specifically Chapter 501,Part II of the Florida Statutes. The payment terms, as highlighted in their response, were indeed part of the contract. However, the insistence on full payment under the threat of legal action, despite the project being incomplete, demonstrates a lack of good faith. This approach is especially concerning given the substandard condition of the lanai, which remains a hazard.

      The clause in the contract stating that the deck is not warranted against settling does not exempt Holiday Pools from their duty to deliver a deck that is safe and well-constructed from the outset. The issues we face are not mere settling;they are a result of poor workmanship, as evidenced by the photographic documentation provided.
