This company solicited our property to pest control services and offered to spray the residence with money back guarantee. The verbal agreement was the need for pest control services on the interior of the property. They would send a confirmation text for appointment, we would agree to that appointment time to allow them access into our home. However, their techs would show up for the visit either days or hours outside of the appointment window therefore not actually servicing our property because we were not home. After running into this issue on 3 separate occasions of 6 months, we decided to cancel our services with them as they clearly had no intention of fulfilling their end of the agreement. They are now harassing us for canceling a contract early that THEY did not fulfill the services on. They refused to send me a copy of the original agreement stating we would owe an early termination fee despite many requests via email and over the phone. They have been calling our personal cell phones sometimes 3-4 times a day harassing us to pay the bill, despite our attempts to get a copy of the contract they claim we agreed to. This business is completely fraudulent and needs to be investigated.Business Response

I entered a contract with their door to door sales representative. I was told that exterminating service was available between scheduled visits if I called. I also asked about my commitment and responsibility to the company. I was told if I I was not happy I could cancel at anytime. I would have no monetary commitment. I tried reaching EcoShield between visits in September, I called at least 5 times. No response. I had a scheduled visit coming up and reached out for interior service as per the text message. No response. A week later the same text, I called for interior service. No response. At this point I was afraid of damage to my home, since I was not getting the proper extermination. I called EcoShield and canceled. I am now being harassed and billed $191.00 for the first visit, since I canceled. I have spoken with them 5-6 times since cancelling explaining they voided the contract by not providing services that I believed I contracted for. All I get is you signed a contract. I keep reiterating that they have failed on multiple occasions to provide service.Business Response

Gentlemen:I have asked that the above service agreements be terminated immediately.I have moved and rent an apartment in *******, ******* The apartment management of the complex is responsible for pest control. They will not allow another third party service company perform services which they provide and are responsible for. Additonally the ******* lease agreement will not allow any tenant to contract for any services on the developer/owners property.Additonally the two party service agreement is invalid since both parties to a two party agreement must be ready and able to provide the services agreed upon in the agreement. Fortunately **** now resides in an apartment in ********, *******. The services provided by Eco Shield cannot be provided by EcoShield at ****** ******** location and **** has no authority to contract for outside vendor services for property **** does not own. Contract law requires the services are both performed and are legal in order for an agreement to be valid and enforceable, EcoShield is prohibited by law to trespass upon the property of the apartment comple owner developer. The reviews of complaints filed with the BBB are correct and are reasonable. I am rejecting this response because:Attached are invoices or Accounts ******* and ******* Eco Shield cannot provide any services at my new home in ******* and since they are not able to provide any services they are in default of their own agreement. ******** and ******* law both require that they must provide their service before they are allowed to charge and they cannot provide such services in the apartment I rent in ********. Thus their claim is invalid.
Contract law is clear in they must provide a service and id they cannot they cannot make a claim. Their operation is basically a scam designed to extort ins. I'm 76 years old and have seen many such scams before. These people prey upon unsuspecting customers especially older individuals.

I am rejecting this response because: Ecoshield represents by sending additional bills and letters that they are entitled to be compensated.Their reply to the BBB confirms our position as stated in this BBB complaint that they are unable to perform any type of service at my residence *******.
This statement by Ecoshield can be and is a clear statement by Ecoshield that they are going to be unable to perform the services they claim they are entitled to receive comoensation for. Effectively they have stated that they are going to be in breach of their service agreement. Since they do not have the ability to perform the services they have agreed to perform.
Such failure to perform hereby terminates any obligtion by **** to continue compensation payments to Ecoshield in light of the breach by Ecoshield.
This complaint correctly applies to Ecoshield in *******. Invoices clearly indicate "Ecoshield Pest Solutions - ******* Central"
Ecoshield attempts to avoid their obligation by falsely telling the BBB that this complaint should not apply to the ******* operation. This is a lie and they attempt to get rid of this compaint whch highlights a complete lack of integrity at Ecoshield.
**** will seek compensation for any damages **** may incurr, plus legal expenses, resulting from any action taken by Ecoshield in their attempt to continue this Scam.

Thank you for bringing this situation to our attention. I have reviewed the customers file and found that the charge outstanding on their account is a charge back for the discount provided at time of the initial service. Per the agreement that discount would be charged back if the customer terminated service prior to the end of the service agreement, in this case 12 months. I understand that the customer has moved out of state and is unable to retain service due to their current accommodations. As such, I will waive the $200 discount charge back and want to assure the Gaiks that their account is closed. We were only notified on 1/3/23 that the Gaiks had moved and were no longer in need of service. We apologize for any miscommunication that would have left them feeling as though we were attempting to take advantage of them.Customer Answer

I am rejecting this response because:I responded yesterday. The ******* BBB forwarded this complaint to you in error. Please review the addresses shown in the attached.
The service location was to be in ***********, ********. The EcoShield address is in ******** also.
Ecoshield indicated in their answer sent to the BBB in ******* area a confirmation that they do not provide any service in *******. Since I moved to ******** . ******* and EcoSed does not nor will not provide any service in the ******* area, they breach the agreement and are not entitled to further compensation as a result of their Breach. This complaint was filed with the correct BBB office.
Ecoshied is a SCAM operation that no longer can perform the services they said they would. Just t get rid of the pest, Ecoshield, I would agree to send them a total of $ 100 to close both issues ($ 50 per location). Otherwise I would rather give the money to an attorney in ********. This is a very good offer for them.

I signed a 3 month contract with Ecoshield Pest Control. They promised to remove spider eggs around the perimeter ***** of the property. I paid $120.00 to terminate the contract for failure to remove the spider eggs on successive visits. Now they are showing a contract for 24 months with a signature that is not my signature and they are telling me that I owe an additional $280.00 to terminate the contract. This is fraud. I did not sign a contract for 24 months.Business Response

In August of 2022, a seller from Ecoshield came into my home and sold me a service saying that I would be under 6 months contract. On the second visit from this company, I was not home, I wasn't notified about this visit and I got home pretty surprised with a note that they left on my door saying that they were here in the exterior area for 30 minutes. It is impossible for him to have spent 30 minutes only on my exterior if on the first time he did the interior and exterior of my home they spent about 10 min maximum. They were supposed to call me to schedule a visit which they never did. Also, I still had many ants in my kitchen, that's why I called them to tell them that I was really upset about it. They were supposed to call me to schedule a visit so I would go around my house and show them the problems. So basically, I was paying 159 dollars for a service I didn't get. After that, they asked a technician to call me to be back here again on October 7th. He called me, he schedule a visit at 10 am. He got here at 8 am and I was taking my son to school. I told him to come back at the scheduled time and he never did.So again, I paid 159 for a service they didn't provide. Then, I called them on December 1st saying that I would like to cancel my contract. They told me that my contract was a 24 months contract (which I was shocked!) and I would have to pay 141 dollars for the cancellation fee. I told the lady in customer service, that they should get the 159 dollars that I paid in October for a service I didn't get, and she should close my account. She agreed with it. And today I got an email from them again, charging me 141 dollars.I talked to ******* (customer service guy) who repeated over and over again, that I should pay for the "cancellation fee" after I explained to him that I paid for NOTHING in October and he should just take this payment and use it as the cancellation fee. I just want them to release this charge (141 dollars).Business Response

This company seems to have some confusion about how contracts work. You provide me a service, I pay you money. If either one of us breaks our half of the deal, the deal is off. Our last pest service was scheduled for October 2022. We were home, expecting them to arrive at some point that day so we could unlock the *********** and they could dust for spider webs. Every time prior a technician would arrive they were very friendly and professional. They would knock on the door and ask if we had any concerns or issues inside. Then would proceed with treatment on the exterior including our backyard. However, the last scheduled service, nothing occurred. No one showed at any point of the day. Yet we get a very detailed invoice from the company about all the things they treated at our house that day and my credit card is charged $159. We called to report that no one had been at our house. No knock on the door, no door hanger, or any evidence they were there. Our dogs in the backyard didn't bark (and they would) and our security cameras saw no activity during the listed service times. The customer service stated they have an email that someone had treated. You can send an email from anywhere. And told us to prove they weren't there! How would we know that someone was there from an email? I called to cancel and they tried to give me all kinds of options to remain a customer. If I wasn't home that day, you would have stolen $159 from me! Sorry, we are done forever. They stated that I would have to pay $150 as a cancellation fee. I explained that I was not the one who broke the contract. They didn't provide service, but I paid my bill. Now you want to take more money from me? They agreed to waive the cancellation fee and cancel my service. Sure enough, 3 days later I have a bill for $150 cancellation fee. And what about refunding the $159 for services not rendered? The customer service line remains blameless and not helpful.Customer Answer

Door to door salesman suggested that I try their services at half-off special. Following day we called to cancel any further service. We were billed for an additional service that was not performed. Finally we were told that we would have to pay $250 to "cancel" their services. When we refused, they turned us over to collection agency that is now seeking $400.00. I signed up for pest services with this company who told me that my entire outside of my residence would be cleaned of cob webs/bugs. This company provided service to my first story only and not the second floor. This was on 5/30/22. I called and they came back out on 6/14/22 after missing the week before when they stated they would be here and still were not able to complete the full service which was agreed upon in my contract, being the entire second story. The employee who provided service stated he doesnt even carry a ladder and is not sure why they would tell me that they can reach all of my exterior. I again called and complained and they had no resolve for the situation so services were canceled. This company offers a 100 percent satisfaction guarantee. My service was half completed, yet I was billed for the entire service. **************** calls sends you overseas and they have no jurisdiction other than to collect a payment. I have reached out to their local office in ***** 4 times and have requested to speak with a manager. No return calls. Now, theyre sending my debt to collections over a service that was never fully provided. I hired a new company and have a letter stating my house was indeed in never cleaned on my second story. Thank you for your feedback. We reviewed your account and found that a free follow up was performed on 6/14/22 to remove spider webs and any other pest debris from doors, *****, fence attachments, windows, and light fixtures. I am rejecting this response because:the service was never completed on my second story. Its not dirty areas that were missed. On May 16th, an Ecoshield salesperson came to our house offering pest solutions. I agreed to have them perform an initial treatment which comprised 2 services within a month's time. After each service I would be charged for the service. The salesperson told me that after the initial treatment that I was agreeing to, they would default to a bi-monthly service at the agreed upon price for the next 12 months. However, he made it clear that I was under no obligation to continue service after the initial 2 part treatment and could cancel any time free of charge. After paying for the initial treatment, I call to cancel my account. The customer service department told me that I was responsible for paying for the expected 5 services in the 12 month agreement - $645- and that if I did not do so, I would be sent to collections. The agreement clearly does not state financial responsibility for the services, unless they have been performed, and that the customer is under no obligation to make any payments beyond the initial service.Business Response

Hi ****,
Thank you for reaching out and providing us the opportunity to work together on a resolution. We reviewed and attached the Service Agreement you signed up for and found that it is a 12 month Bi-monthly plan for a total of 7 visits. On the initial visit, you received a $271 discount for agreeing to complete this plan. You received 3 service visits from ** and unfortunately, did not complete the agreement. On 10/14/22, we let you know that we would need to get the $271 discount back as the terms were not reached. We notice that the amount was sent to a 3rd party collections agency and our main goal is to take care of our customers. As an act of good faith, we went ahead and waived the $271 balance from your account. Please **** business days for the collections agency to reflect the new changes.
Your account is closed and the $271 charge is waived. Thank you.

In august 2022 a door to door salesman for the company said they were out treating a neighbors lawn (probably a lie) and noticed ant hills and spiders egg sacks on our porch. We have a contract with another major pest control company, but he promised they could do better. He represented himself as an owner of the company and made a guarantee they could do eliminate these pests after just two treatments. He also made a verbal statement that there was a 2-year contract but they were a small business and we could cancel at anytime if we were not happy with their service. He specifically stated to me they dont have policies like the big companies requiring cancellation fees to end a contract. He had me sign a box on his tablet to authorize service, and someone called me as verified I would pay, but I did not physically see the contract until later that night (after the first treatment was already completed), when it was emailed to me. After two treatments we did not notice a change and even the servicemen performing the work told us there was nothing they could do for spiders except knock down the webs which our other company did already. Ecoshield was more expensive and more frequent, but we agreed to try it to see if they could help with spiders. After two treatments we did not see a difference so decided to cancel. At that point the company said there was a $200 cancellation fee. Also the salesman who claimed to be an owner was just a sales rep and was no longer even with the company. He did not write the verbal promise that there were no cancellation fees, so the company would not waive it, We were lied to by the sales rep on his position (we thought we were supporting him as a small local business owner), he lied about the guarantees of service they could provide, and he lied about our ability to cancel at anytime without fees. Despite the company offering to lower our $/treatment we discontinued service because we lost trust in the business.Business Response

Hi *****,
Thank you for bringing this to our attention. We reviewed your account notes and found that you signed up with us for a 24 month period and were provided with a $200 discount for agreeing to complete the 24 months. This was also confirmed with you over the phone on 8/29/22 on our "Welcome to the family" call which reviews the terms, pricing, perks, and length of our services. Based on the cancelation call from 10/7/22, you mentioned you wanted to cancel due to you finding a company that was cheaper. We offered to work on the price with you, but it was declined. Due to this we only ask for the discount we provided you with. We've attached a copy of the Service Agreement that was sent to you the day you signed up, for the BBB's records.
