    Leah King Group was a Realtor from Zillow and she referred me to her employee Anthony Johnson and Fairway Mortgage lender Michael Farkas. I was pre approved for a loan and spent months finding a property. A few days before closing I was no longer approved after I had paid the inspection and appraisal fees, took trips to the property which was 2 hours away plus gas and tolls. I applied after this denial with Mutual of Omaha and was told I had zero credit and could not get a loan. I feel that I was scammed and/or taken advantage of because of being a senior citizen and disabled.

Leah King referred her to ********************************* who advised her that she had zero credit & should wait to purchase or look into other options. He told her it would be a difficult process, but they could try. I took over because Leah had prior obligations on some of the days requested to see homes. In order to provide the best service possible and accommodate the clients needs/disabilities I started doing the video tours & helping the client in the home buying process. During this process & before going under contract I informed the client that many of the costs associated with purchasing a home were nonrefundable including the inspections & appraisal. Almost all of the tours up until finding the property we went under contract on were video tours and the client was not present. We were told by the lender that the client did not give truthful information about past payment history on her application. The information on the application is used to pre-approve the client & without honest information the client cannot be properly preapproved. While under contract and nearing closing there is a community HOA approval process that the client has to undergo. After the HOA reviewed the application it was determined that she was denied to move into the community based on her information on the application. Additionally, there were discrepancies in the HOA's budget found in underwriting. Time was not on our side and in order to protect the clients escrow I advised canceling during our contingency period so that the client could receive her escrow money back. The lender reimbursed the client her inspection cost & appraisal cost ($970), which is not customary practice. We feel we did everything we could for the client based on the information the client gave and her situation. Consumer Response /* (3000, 11, 2022/08/19) */ (The consumer indicated he/she DID NOT accept the response from the business.) I am appalled that this is a blatant lie and attack of my integrity and character. I NEVER gave any false information as I am an Empath and highly spiritual human being and lying goes against every fiber of my being.I was refunded the inspection and appraisal fee because of the mismanagement of my pre-approval and the fact that I was never told that I was unlendable until I applied with mutual of Omaha who were up front with me from the beginning and didn't try to fudge paperwork to make a sale. Business Response /* (4000, 13, 2022/08/31) */ The client was on a strict loan type and one of the requirements of the lender (Fairway Mortgage) mentioned having a clean payment history, which I believe had to be for at least 12 months. It was found that this requirement was not met by the buyer, and there was no other solution to resolve this issue. I can only speak for myself as the real estate agent in the transaction. I performed my duties fully and protected the buyer's interests throughout the entire process according to our contractual deadlines and obligations. It appears the client's major discord is with the lender, which I cannot speak on their behalf. My understanding is that the lender has compensated the buyer for the two major costs (Appraisal & inspection). I truly wish the end result had turned out differently, but sometimes cancelling is the only solution available in order to protect the client's escrow.
