I purchased a vehicle on 2/21/25 that was presented to be in a great condition and was proven to be in otherwise condition after diagnostics testing along with running into a-number of problems since literally the day of purchase. The day of purchase there was no heat in the vehicle. I made them aware at the time of purchase and the heat was serviced by victory auto Mall hours later There was no heat indicating a rig or temporary fix theres still no heat in the vehicle Right now. This vehicle has a missing emissions testing system and also a deleted diesel DEF system. Which makes this vehicle illegal to sell with these types of modifications, The vehicle has bad fuel injectors. The vehicle has a recall that was issued December of last year that is currently active & ETC my contract does not indicate that I have a warranty in the specific section where it should be indicated. I paid $2500 for a *********** contract indicates that I made a down payment of $6000. I have documentation proving that I only paid $4000 . Victory auto Mall did not describe that $2000 of the down payment was from them on my contract so it seems as if I paid $6000 myself and that is falsified information. This tampered/missing items were not discussed during purchase and should have been as to the items listed above makes the vehicle illegal to sell, it has been illegally tampered with. How could you not know that about a vehicle on your lot?Since this purchase victory auto Mall also has held my registration and decal in exchange for payment when taxes and tags were covered by the down payment. ***************************** provided a decal and tag directly to me for free. This purchase was very rushed and I was misled into making a purchase on a vehicle that is not what it was presented to be. This experience has caused me emotional and mental turmoil and I have not even had a vehicle in my possession for a full 60 days yet. The contract for this vehicle has now been deleted!

Please see below Victory Auto Mall's response to the noted complaint from ******* ******:
    1. Repairs-*** ****** vehicle was not serviced for an issue related to the heater but rather the starter of the vehicle was repaired 2 (23/2025) days after she purchased the vehicle.  about 10 days ago *** ****** called the dealership informing us that she has a diagnostic of the vehicle and there are issues with the vehicle.  She was informed that she has an extended warranty and she can bring the vehicle to our service department for repairs.  To date  *** ****** has  not brought the vehicle in for service.
    2.  We confirm that the dealership did not modify for tamper with the vehicle. Please note that Emissions testing is not required in ********the state of ********
    3. If a recall comes up for a vehicle, some care makers will send their serviceman to the dealership to perform the recall.  This is dependent on many factors.  In this case, the recall was not conducted at our dealership.  Therefore, it is up to the owner of the vehicle to take the vehicle to the respective car maker for  the recall. In *** ******** case, her recall was from Nissan.  It is up to her to follow up on the recall as she is the owner of the vehicle.
4.The required down payment for *** ****** vehicle purchase is $6,000.00.  She only had $4,000.00 which she paid by a debit card.  The remaining $2,000.00 was to be paid on a deferral basis of 4 weekly payments of $500.00  starting 03/07/2025.  To date, *** ****** has paid only one payment of $500.00.  She still owes the dealership $1,500.00. Attached you will find the documentation signed by *** ****** evidencing her agreement to the plan. She was explained in detail about the deferral plan.
    5. Tag/Registration.  *** ****** was informed at the time she purchased the vehicle that her tag, title and registration would be paid by the dealership to the *** and she would reimburse the dealership for the expense.  See attached COD/Registration Notice and Evidence of Amounts Owed.  When she called requesting her tag/title and registration, we informed her of the outstanding amounts owed to the dealership.  She then proceeded to go to the *** to retrieve her tag, title and registration at no cost to her, since the dealership had already paid for the service.  *** ******, still owes the dealership $236.18 for this expense.
    6.  As mentioned is her complaint, she has not made her first and second payments to ****************************  Consequently, the loan was returned to the dealership due to first payment default.

I am rejecting this response because: Victory broke several laws with the sale of this vehicle from the down payment to the contract to the verification of warranty . This was a purposeful mislead sale & they have this to too many people ! I refuse to be scammed out of money & end up with a repo on my credit along with a Fraudulent loan from their personal banking friend ! I owe them nothing after them mental & emotional turmoil I have experienced since the purchase of this vehicle . I am rightfully due a refund at the least!

    Sincerely,

Horrible place to do business. Completely bamboozed me in many ways that I will list. Legal representation contacting them since they refuse to help. LASTLY, 2 of the 5 star reviews are from employees, one of which sold me the truck Im about to discuss 1) purchased a truck from Victory Auto. Victory auto took a $500 down payment while telling the bank I paid $2,500 (floating money, illegal move 1)2) when the bank called to confirm the vehicle information, the bank quickly found out that they lied about features of the car. They said it had a different engine, leather seats, and a bunch of other things it did not have in order to boost the blue book value. The bank then applied a big overbook fee to the loan because they charged so much over blue book value, as accidentally disclosed to me by the underwriter. Desperate for transportation to work, I continued with the deal 3. The truck had a check engine light and the door does not close all the way. I get soaked when it rains, legitimately. They told me it would be taken care of inside of a ***** day warranty. When I went to take care of it, they couldnt book me until 6 days past the warranty end date.4. 41 days into owning the truck, the dealership and bank called me completely out of the blue and said the deal had been cancelled because my ach payment returned. When they called me, immediately offered to rectify and make my payment with a debit right then and there. To my dismay, the truck loan was already cancelled.5. I then called 11 times over 3 days attempting to speak with the ** or the owner. When I bought the truck, they answered every call. Now they suddenly decide to not answer and 1 person refused to send my contract. I also have texts of the ** saying they will not return down payment that I made.Between the maintenance issues, sketchy sale, and refusal to send the contract that I legally should have, I have representation contacting them.

Hi, We as Victory Auto Mall had nothing to do with the bank returning a deal due to non payment from the customer, *********** was giving many opportunities to make his payment to the bank that financed his loan but failed to do so in time, once the bank return the deal there is nothing we can do to fix that, as far as any mechanical issues that *********** mentioned we do offer a free three months warranty on every vehicle we sell to make sure there will be no surprises after the sell and to make sure our valued customer are getting something reliable, reading the complaint I really do not understand what we did wrong to deserve a complaint, all *********** had to do was make his payment on time and there wouldn't be any problem.

I am rejecting this response because:

the bank returning the deal has absolutely nothing whatsoever to do with you keeping the down payment. Your contract specifically states that regardless of reasoning, if the sale is cancelled wasnt he bank returns the deal then the dealer MUST return ALL consideration. Once again, I have attached my contract.

page 5 specifically states the terms under cancellation.

I have requested a dispute through my bank and if victory refuses to honor their legal obligation I will have my attorney submit demand letter.

    Sincerely,

Had them put in a transmission. Ran fine for a day or two and than started to leak ****** fluid. Went there and spoke to so called service mgr. very rude, lacked understanding. He said I should have the truck towed to them. I refused cause it would cost me more money. Asked him to get a towing company, he refused. Said its not their responsibility to get truck there. Spent over $4000 and cant drive it. Tried to call manager, guy called Tank. After numerous calls and leaving msgs with machine and live person explaining the problems I was having with the service and their manager, never received a call back. Now I have to spend more money to get it fixed at a reputable service center. How can this company continue to sell and service cars is beyond me with all the complaints I see. License should be suspended, revoked, till they do right by their customers. Its disgraceful that they are allowed to continue to be in business.

I returned a vehicle to the establishment on 2/13/24. They have not processed the information to register the vehicle back to themselves. As a result the vehicle is registered to me and Im unable to remove it until they fill out the correct forms for the state of Florida causing my license to be suspended due to the vehicle not being insured. I held insurance on the vehicle up until it was returned to the dealership as required by both state of ******* and the dealership. Im just requesting the dealer complete the proper paperwork.

Purchased a car from them on 9/15. Started having issues with it driving the hour drive home. Exactly a week later 9/22 They took the car and supposedly fixed it. Told me they changed all four coil packs. Picked the car up on 9/25. The car ran fine for the first day after that it started doing the same thing it was doing before they towed it. It has left me stranded twice now. We called and spoke to the owner earlier today 9/26 and he told us when they towed it there was nothing wrong with it so they did not change nothing and did not work on it at all. The car has a 3-month warranty. I can tell now that they will lie and say that they've done this and that to your car until your 3-month warranty is up and then you're totally screwed but you're screwed from the minute you buy a vehicle from them. I called the finance company which they gave us no information for I had to call my insurance company to get that information and had our contract with a finance company canceled. We put down a down payment of $1,000 and we want our $1,000 back. After reading many reviews we have realized this company is a scam. They can come pick up their vehicle as there's no financing on it as the bank pulled the contract. Car is not drivable as when it gets hot enough it shuts down. And I'm not chancing my life driving it back down there to ***** they can come tow it since they know there is issues with it that they are refusing to fix. I want my $1,000 back in their car back into their possession. I have recorded every phone call and conversation that we have had with these people even the part when I pick the car up and they said they changed the coil packs I have them on recording. And then I have the owner on recording saying there was nothing wrong with the car when it was towed down there. So they can either give us our money back or we will take them to court with all the evidence we have

We the dealership went out of way to serve you by towing the vehicle to our location at no charge to you, repairing the vehicle repairing the vehicle at no charge to you, offering you a free three month forty five hundred mile warranty also at no charge to you.

The lender set stipulations to your approval which you were unable to provide, once this was established you called the creditor back and said there was issues with the vehicle and you were not going to pay for it after the vehicle was repaired at no charge to you.

In closing I do believe it is illegal to record a phone call or to video record someone or a conversation without their knowledge of the recording.

There will not be another response from me regarding this matter.

I am rejecting this response because:

They are scam artists, they didn't fix the vehicle. There was no stipulations that I couldn't uphold on my end. I called the lender because they sold me a lemon and lied about fixing it. I have all the proof I need. I have filled a complaint with the ******* Attorney General and will be taking them to small claims court for my money back. It's illegal to steal and that's exactly what this company does to their potential customers. I have all the proof I need with my LEGAL recordings that this company is a SCAM. They sale lemons and they know they do. I have on recording them claiming to over changed all 4 coil packs and then also on recording not even a week later claiming there was nothing wrong with the vehicle that they did no work to it. Now that they've been caught in a lie, recorded evidence, they want to try to say it's illegal, it's also illegal to keep my deposit!

    Sincerely,

Me an my girlfriend git approved for car loan , ir atleast we thought we did after *******$ down payment an 650 down for full coverage insurance. Within 40 days car had major oil leaks , an other maintenance issues which resulted in them keeping my car at there service station for a week for car issues , everytime i pulled off the lot , a new check engine light came on , 30 days later dealer called and said bank declined loan so bring the car back , we did they did not return my ******* $ refund they told me to contact a lawyer about my money because they were ant to charge me .69cents per alleged ***** miles i put on car , the bank never knew the car left the lot , we was never approved for the car , they gave us the car whill trying to get bank loan approved because car had major issues , they got mad wen we didnt want the car nomore because of maintenance issues , they made us return the car an told me to contact a lawyer for my deposit , nowehere on my installment agreement does it say im responsible for mileage on car if bank deal goes bad , the car was never ours , this is bad business and i need help on what to do to get my deposit back

The approval from the lender was contingent on stipulations being met by the customer(s) which were not. Therefore the dealer had to have possession of the vehicle.

When you complete a credit application it absolutely has to verify as stated. So, if the application states that you're employed for four years at the same location then you have to be able to prove this. Same for the monthly income. In this case neither were able to be verified and the lender did not honor the approval because the credit application did not verify as stated on the application. It also needs to be noted that the lender was unwilling to use the employment time and income from **************** (********************** girl friend) because it wasn't at the same location even though it was the same company. My personal opinion is this is unfair by the lender because ****************

We did off ****************** financing in his name only which he declined.

Any issues with the vehicle were repaired at no charge to the customer(s)

Attached is documentation the money down is non-refundable.

    Complaint: 20563514

I am rejecting this response because: As in response to victory auto malls reply, as they stated that the deal had contingent on stipulations, there was no stipulations explained other than we was approved for the car with ******** down and ****** a month as our contract states. The car was not for ***************************** it was for *************************, thats why ******* declined as well as the major oil leak problems with the car, they only fixed the car because the deal was never finalized and had to because it was still the banks car. It was under the impression we never had the car if your reason for trying to keep the deposit because ******* did not want the car and they said my deposit was getting kept because of mileage at 0.69cents per **** alleged miles that came from running back and forth to have maintenance issues all in 30 days of having car. We were treated good all until ******* and ******* asked for our money back. The bank never finalized a deal, which means the car was never ours and therefore its in our right to have our money back! We brought the car back in perfect condition and we need our money back to buy a car. We were honest walking in and got robbed walking out. This is unfair and its very vindictive of their associates and what your company stands on. Theyre telling me that with a deal not finalized on the banks side because ******* provided everything to leave the lot with the car. Whatever they put in the system to force us to leave with the car. ******* was the cosigner and was also approved by himself, so ******** paystubs was clearly exceeded by ********. We walked in honesty;they have their car, and we just want our money back. They were forcing a car on us with major issues, thats why there was so much pressure to resubmit paystubs that were resubmitted multiple times to the bank. Could it be because the staff forged the car? All the proper documents were given each time asked for by the bank. Even though we were told that ******** income was enough to finalize the deal by the sale agent. We were honest with them and now that they didnt make a legit sale, they are trying to re-nig on whats rightfully ours regardless of what the receipt says. The company is wrong, the car was never ours if the bank never finalized the deal. This is clearly a corrupt deal.  We have never been through anything like this with a car dealer before.

    Sincerely,

I purchased the vehicle august 1st 2023, I will just paste what Im sending lawyers. I purchased a vehicle from a buy here pay here in *******, *******. They took advantage of the fact I desperately needed a vehicle & sold me a vehicle that was not inspected before purchase and I can confirm because I brought it in three times in the week & 1/2 after buying it and they did an inspection the first time! The third time I went they actually did an inspection and realized the rotors were almost dust cause the vehicle to have a horrific shake the entire time I was driving after leaving 10 miles from the dealership, the a/c broke after that same almost 10 miles down the road. I did sign an as is paper. When I went in the third time, the bank had not cleared the purchase & the manager came in and says I dont want to have to be mean but, if you dont agree to everything the finance company says youll get your car taken, no bank will finance you, & no down payment back as a threat. At the time I did not understand why he was saying this until the finance company called me for a welcome call to go over the features, and they said it had multiple things it did not have to up the price. This has been a disaster from start to finish & I just want to be compensated for the amount of times Ive driven there, ************ I want money off of the vehicle, compensate for hours I missed from work due to not having a working vehicle, I want them to send it to another shop and pay for other things that need to be fixed & possibly pay for any ticket I get for still not getting a new tag to me after 30 days and me calling every day for the past week.So far, I was told the price was *****, but *** spent much more traveling there ( gas wise, missing work)

Nobody ay Victory Auto Mall made any type of threats or threatened anyone or tried to intimidate anyone over a car purchase if there was a repair needed. What was said is contact us before anyone and give us the chance to make it right. I apologize for the misunderstanding because that is not our intent.

I have been trading texts with you pretty much since you made the purchase and just yesterday we traded texts messages. No where after August 18th,2023 does out text message conversation say anything about the vehicle needing repairs or wanting compensated for anything.

There is hear say and then there is the truth and there is no denying our conversations over text.

As I have texted you, your tag is in and I have given you the persons name, number, and extension to get your tag.

I have nothing else to say about this matter.

I was unable to contact ANYONE after multiple texts and phone calls which I can attach if need be. Not the sales woman, not ***.  Noone could give me an exact answer until my tag was expired.

All I am saying is that when you spoke to me things were handled and you never spoke to me about any mechanical issues with the car after we talked on the phone about the air conditioning not working around August 18th*  We both have the same text message thread and all you had to do is contact me and you know that. I see where I apologized to you for not responding to you in regards of your tag because we were closed over the hurricane. It took me reminding you again on this complaint that your tag was here at the dealership before you came in and picked it up.

I personally sent the lender proof that the Escape does in fact have a powerlift gate. The proof is a picture of the button to operate the power liftgate and a video of it in use. I still have the picture and video on my phone.

All of this could have been avoided if you had contacted me, you know I am the general manager.

You have spread false accusations to The BBB and you have stated that you have contacted a lawyer.

There will be no further response from Victory Auto Mall LLC

Before I even reached out to the BBB I picked up my tag? There was no reminding needed from you. I had to call multiple times, text multiple people , just to not receive a response until EVENTUALLY the tag woman called my fianc.

I wasnt talking about the lift gate because I personally called my finance company & assured the lift gate was apart of the vehicle after you texted me while my vehicle was still in your shop which if your the general manager, Im sure you should of had knowledge of that. Im glad you still have a video of the only thing you didnt lie about the vehicle having. So lets address - heated seats? Oh right, the vehicle doesnt have that so thats definitely not something you have proof of. I can call the finance company and ask for a list of the rest that I denied because it wasnt apart of the vehicle.

No false accusations were submitted to the BBB, I do find it interesting after I said lets pull the tape & ask your service department desk person ***** from when you came to speak with me about lying to the finance company and you have no further comment on that? Right. Not an honest company , just looking to scam the next.

I have no further comment on the situation. *** said my piece.

    Sincerely,

I paid a $500 deposit to get a vehicle got the vehicle. The vehicle is unsafe to drive. The steering wheel does not turn properly. It throws a steering error. Every warning light on the dash is on and the car is a complete death trap. I reached out to victory Automall they were extremely rude, unhelpful, unsympathetic, and unwilling to help in any way shape or fashion the owner ****** is a complete *****. The finance manager *** is a complete ConMan and I suggest anybody that does business with this please to turn around and run as fast as you can. If you look at any of the complaints for this place, they are known for taking your money and not giving it back, please save your hard earned money and go to a reputable business that cares about you as a customer and wants to see you in a dependable good vehicle. This place does not do any of those things they have refused to refund my $500 ACC, which was the lender told me to take the car back to them for dealer compliance because the car was unsafe to drive and they would void out my contract. Even after the contract has been voided They refused to give me my $500 back for a car that I dont have dont use cant drive is unsafe. Theyre flat out theives. I did a little research and found out my car was bought at an auction and sat on the lot for roughly 3 years. Thats why they were so desperate to sell it to me. I shouldve followed my gut and never even done business with this place but I thought they were trust worthy at the time, which is a hard ****** that I learned was not true so again to wrap this up, do not do business with this place you will live to regret it. The reviews you see saying that they are good and the place is trustworthy. Are all fake reviews dont believe anything positive you read about this place theyre a total nightmare to deal with.

I received a call from the customer telling me that he is bringing back the car and he has called the lender to cancel the loan while demanding his down payment be refunded that he paid (I uploaded a copy of the non-refundable receipt that he signed). I never once was given the opportunity to have the vehicle repaired. The customer had the car in his possession for three weeks prior to this happening on Monday August 6th 2023. On Tuesday August 7th, 2023  the customer came to the store tapping the keys of the car on the window's of the building several times then proceeding to come into the dealership speaking to our customers telling them not to do business with us, shouting and saying all kinds of things, just being flat out rude to everyone in the store, telling me personally that I am lucky he is keeping his cool and not taking it to the next level. All of this took place under audio and video surveillance, and there is no denying what happened or what was said.  Now today I am being called a "CONMAN" I have done anything personally to the customer, I have offered him a service and we agreed on terms, and I have offered to fix the car free of charge and even tow his car to the dealership free of charge to him. We were never given the opportunity to repair the car that he had been driving for three weeks.

Even with the name calling and other advents that have happened like this compliant, a negative ****** Review, we would gladly repair the car free of charge to him.

Early diagnosis is a speed sensor needs replaced which isn't a major repair, actually rather easy to repair. Used vehicles break down it's a fact of life. Service was offered but we weren't given the chance to serve.

The service manager informed you of the repairs that were needed to your vehicle, without your signature we can't proceed with any repairs. The service manager also informed you that it would take several visit's for the work to be completed on your vehicle because you were unable to pay for all of the service all at once. The service manager also offered you a financing option. The financing option was 90 days 0 interest after the 90 days the interest would be according to your credit worthiness, since you did not have the money to pay the repair bill in full at the time of service. However you made the decision not to proceed with that option.

We made every attempt to help you repair your vehicle and offered a financing option for the vehicle to be repaired while working with you and your budget.
