    This consumer was notified via mail on 6/5/24 and we did not receive mail return on that notification. The consumer has made no attempt to contact or communicate with our company prior to filing this complaint. Since the consumer is stating she has no knowledge of it, our company will email all validation documents to her today and we encourage her to reach out to us directly at ###-###-#### so that we can assist her in a resolution. We do not want to attach the validation documents to this response due to privacy issues.

    requested on 5/2/2024 verification letter, lease agreement with signature and receipts of debt. CRI has not complied the request per Fair Credit Reporting Act. Company continues to cal when I requested not to call but to send notices via mail. After 30 days if information has not been received request to update my credit report.

    I am aware of this tradeline unlawfully reporting on my consumer report. And would like to conduct a further investigation. Please submit all documents that you have submitted to consumer reporting agencies. That you used to create this tradeline on my credit report. I have reason to believe that you unlawfully obtained my personal identification information. Without my prior consent; which, you have used to create this tradeline on my credit report. let me explain, if you have used my Name and any other personal identifiable information such as: a social security card, driver license, or my address. Without a signed agreement between me and your agency. That expresses mutual assent from both parties. Then you are facing some serious penalties under the UNITED STATES CODE. Pursuant 18 USC 1028A Aggravated identity theft. (See United States v. Kuc, 737 F.3d 129, 134) "Pursuant to 18 U.S.C. § 1028A(a)(1), a person is guilty of aggravated identity theft if, in relation to any crime listed in § 1028A(c), he "knowingly . . . uses, without lawful authority, a means of identification of another person." The statute defines the term "means of identification". To mean "any name or number that may is used alone, or in conjunction with any other information. To identify a specific individual, including any name, social security number, [or] date of birth." Meaning if you used 2 separate forms of identification without my consent. Then you committed aggravated identity theft under 18 USC 1028A. If you delete this tradeline then i will drop my claim.

    You signed a 2 year contract on ******* with our client, *****s *** *******. You checked into the *** and used their facilities ******* ******* ****** *** *******. When your payments began declining, the billing company reached out to you for 90 days in an attempt to get your account back on track. When they were unsuccessful, your account was forwarded here to CRI for 3rd party collections. Please see the attached document showing the many attempts the billing company reached out to you via phone, text and email informing you of your past due membership. Your signed contract, payment history and account notes are all attached to this response. We do not buy debt, we are contracted to collect for *****s *** ******* (now named *** ******* *******). This debt is now outside the statute of limitations. We cannot sue you for this debt. Any payment you make towards the debt will restart the statute of limitations.     I want all communications submitted through the BBB portal. So, we have a communication trail that proves compliance with the FDCPA. And to prevent me from suffering anymore from your deceptive tactics.

    I am rejecting this response because:

    You claim in your response that you have answered my request for debt verification in full. May i ask you this: Is the employee managing my complaint for your company outsourced over seas... or... is the employee managing my complaint ignorant of the law or flat out just playing stupid because, first of all, there was no documents you attached in your response (besides the letter i sent you). Second of all, you simply stated a contract, billing cycle and phone logs prove the debt is owed... my friend... you must be living under a rock because if you are aware of the verification definition of the FDCPA (found in court cases about 15 USC 1692g(b))... you will know that verification in debt collection can only be made once sworn under oath. This means that a contract, billing cycle and phone logs DO NOT VERIFY A DEBT. So even if you did attach those documents, you will still be liable for breaking the law under 15 USC 1692g because that does not verify or validate a debt. 

    Go ahead, you can continue to play stupid if you would like... once i involve the office of inspector general with my civil rights complaint for all the breaches of law i just proved against you, we will see how they address your agency (especially once they dig in your files and see all the other times you broke these exact same laws). I suggest a higher up reviews this complaint, scan it word for word and then see why you must delete this account right away... it would be the fastest and least expensive (for you) resolution to this complaint.

    I was originally seen in ********* 2022 by ******* ** ******** * ***** ******** *** *********   On that date I paid the amount they told me was due (after they had checked with my insurance company). We then did not hear from them until ****** *** 2023. At that time we were presented with a bill for an additional $412.57. We called them, and asked what this was about, and why we hadn't received a billing until one year after the exam. We then contacted the insurance company, who said that the total went towards deducible. We called back to ******* ** ******** ***** who told us that they had just made a mistake in not billing us, and they had just sent our bill to CRI collections (less than one month after we received the bill. We paid CRI the $412.57 that was owed on the bill - but they informed us that we would then also owe them (CRI) an additional $200 for their fee, as this should have never been sent to collections in the first place. We have placed numerous calls to ******* ** ******** * ***** ******* ** CRI - with no response other than CRI telling us we need to pay them the additional $200. As it was the mistake of ******* ** ******** * ***** to not have billed us until one year later, and we paid them the additional monies within 30 days, we would like the additional $200 fee to CRI removed, and any credit reporting on this matter corrected immediately.

We are unable to get Dr. ********'s office side of the story regarding the length of time you had to pay your bill with them as he is now retired and they are closed. Therefore, we have decided to go ahead and remove the $206.29 collection fees from your account. This account is now zero balanced and paid in full.     Hi! I closed my gym membership at ******* gym in *********, *** I was not supposed to receive anymore monthly charges at this point because I had canceled my membership. I received confirmation that my membership was canceled but then they tried to charge me. It was not paid and sent off to collections, but I had no idea because to my understanding, I had canceled my membership. I would like this to please be deleted off of my credit report. I am willing to talk about a settlement for less than what I owe, but I genuinely was not aware that I owed anything else to this gym. I also was receiving calls from someone from this office named maya but the voicemails did not say what agency she was with, and it seemed like a scam to me. Please help! I’d like to resolve this!

    I am rejecting this response because:
    I did close this account with ******* *********. I also never gave you my husbands phone number so I’m not sure how you got it and why you contacted him when this has nothing to do with him. The only calls I had received were from “Maya” saying “****** it’s Maya, call me back, it’s really important”. But that gives me no information that this was even a real company. There was no information on the voicemail who Maya was working with at all and it seemed like a scam.

    Ms. ****, I spoke directly with the manager of the gym who checked all the records relating to this membership and there were no notes at all regarding you even attempting to cancel your membership. Your payments just quit going through. The debt is fully validated. Our company name and phone number is listed next to the open account on a consumer's credit file so you could have reached out to us anytime to discuss the account. We also mailed you a letter about the debt on ****/22 that was not returned to us mail return. You put your husband's phone number on the gym contract as a reference number.     These ladies are incredibly RUDE. They definitely should not be in any sort of customer service role. They speak over you so that you cannot talk, they harass you at your place of business, I too was charged bogusly by a gym for personal training charges AND GYM CHARGES THAT CONTINOUSLY WENT UP EVEN WITH ME NOT ATTENDING THE GYM. THEY EVEN STARTED CALLING MY N LAWS, AND I ASKED THEM HOW THEY GOT THE NUMBER, AND THEY TOLD ME, THEY HAVE A RESEARCH DEPARTMENT TO CALL AND REACH ANYONE BY ANY MEANS. They put me in collections with these clowns. They are now illegally calling my workplace, harassing my family members and leaving messages with others. One look on ****** street view of their office tells you all you need to know. Apparently the personal trainer company that my gym used and later purchased, sold CRI false debts. And no matter what I told these people they refuse to remove my information. I even got proof from my gym, who now owns the trainer company that I owe them nothing and received no services. I still receive multiple calls on an almost daily basis from them demanding I pay them 2k for a fake debt. I do want an Apology, and I do not appreciate them calling my family members and harassing them. I DEFIENTLY WOULD LIKE SOME ASSIT WITH THIS ISSUE. THERE HAS BEEN so many calling me and harassing my family and myself I don't even remember their names.

    **************************************************************************************************************************************** to me This is what they sent me, and not sure if this is a whole new bill Business Response /* (4000, 16, 2022/07/18) */ This consumer signed a personal training contract ******* with our client. She defaulted on that contract and the account was sent to us for collections. She even set up a payment plan with our office ****** and then her first payment was returned for NSF. Her signed contract is attached. On the 4th pg it says that a member's failure to utilize the services does not relieve them from payment. Per her request, we will cease calling all phone numbers on her account, but this is a valid debt and will not be removed from her credit report by our office unless it is paid.
