Contacted LendMark corporate office for payoff on 06/21/2024 We were told the payoff $5110.30.I recorded this phone call with the customer service representative, which the State of Georgia is a one party consent State just like ******************************* rep, name withheld due to privacy reasons told us if we payoff with a cashiers check it will speed up the release of the lien and NCDMV would sent us the vehicle title.Cashiers check for $5110.30 was personally delivered to LendMark Financial location ******, **. I have a copy of the cashiers check if BBB needs proof.The Representative said if cashiers check is used it would take less than 10-days.We contacted NCDMV Today 07/03/2024 and we're told that LendMark still hasn't released the title. They encouraged me to file a complaint with the *************** bureau.I was also advised to file a complaint with the ***** and the licensing agency regulations division for finance companies doing business in ***** has been 12-days with no release of the title. I'm going to reach out to my bank who I purchased the cashier check from.Business response

Lendmark Financial Services, LLC (hereinafter referred to as Lendmark) is in receipt of your consumer complaint. We have had the opportunity to review the complaint and address your concerns as follows.
Thank you for bringing your concerns to our attention. After reviewing your account,we can confirm that we received your payoff payment on June 21, 2024. Lendmark has a minimum hold policy of 10 business days for this payment to ensure that it clears prior to releasing title and no later than 15 business days after payment has been received. The lien on your title was released on July 3, 2024, which is within Lendmarks policy. Once Lendmark notified North Carolina of Motor Vehicles the lien has been satisfied the State prints and mails a paper title to the vehicle owner, or a third party designated by the lienholder. If you dont receive your title by July 19, 2024,please contact the branch and they will provide you with a lien release so that you can request a duplicate title if needed.
Additionally, Lendmark submits a report to the CRAs monthly, please allow 30 to 45 days for the tradeline associated with your installment loan account to be updated.We trust that this resolves the complaint brought forth. You entered an unsecured consumer installment loan with Lendmark on November 24, 2023. As fully disclosed on the Disclosure Statement, Promissory Note, and Security Agreement, (the Loan Agreement) the original amount financed was $4,694.55 with an interest rate of *****% for a total of payments of $8,451.11 to be repaid over 48 months with a first odd payment of $232.69 due starting on January 8, 2024, and payments of $174.86, monthly thereafter.
This is a precomputed loan, the starting balance or the total of payments on the loan reflects both a principal and an interest component and each payment made on the loan is applied to reduce the total of payments. Further, the total amount of interest is computed at the inception of the loan and does not change.
The statement you received from Lendmark reflects the amount you owe if you were to pay off your loan to term (the contracted 48 months), currently $7,344.12.
The balance being reported by the credit reporting agencies reflects the amount you owe if you were to pay off your loan account by the end of the month, last reported at the end of May 2024, is accurately reported as $4,177.46
Lendmark can confirm the balance being reported is accurate as of the date of reporting to the credit reporting agencies.

As stated in our previous response, this is a precomputed loan, the starting balance or the "total of payments" on the loan reflects both a principal and an interest component and each payment made on the loan is applied to reduce the total of payments. Further, the total amount of interest is computed at the inception of the loan and does not change. The statement you received from Lendmark reflects the amount you owe if you were to pay off your loan to term (the contracted 48 months), currently $7,344.12. Should you want to pay off the loan off early, there is a potential you will pay less than the total of payments.
The balance being reported by the credit reporting agencies reflects the amount you owe if you were to pay off your loan account by the end of the month, last reported at the end of May 2024, was accurately reported as $4,177.46. The balance reported to the credit reporting agencies as of the end of June 2024 is accurately reported as $4158.01, please note that the CRAs are separate entities from Lendmark and Lendmark does not control the amount of time it may take for the CRAs to process the update.

The harassment the do everyday. They call all day long calling my job and my family. I give them what I can on my long but the still call an harass me. They try to make me set up payments when I give them a date on when I can make a payment. I may not make the fulling payment but I do put something on it. They ask why I can't make payments an give the an answer of money changed due to financial problems with my father falling sick and needing help. I talk to several people an day and they suppose to make notes on the account that we have talked but they still call. I work 10 hour a day an they start calling at 8 in the morning an do not stop til they close and get made when I tell them no I'm working g an can't talk.Business response

I am making a very disturbing complaint specifically against the Lendmark in *****************. When I returned a missed phone call to them I spoke to ***. He advised me I was half a payment late but confused as to how when I was told by another employee there way back in February 2024 when I made 3 months worth of payments that I was good till June. That was before I also made 3 more payments. I was confused on how I could possibly be a half payment late. I advised him what **** had told us back in February and asked him to call me. When **** called me he was extremely rude me to me and put me down. When I asked him why he said that to me back in February he began to yell at me and then hung up. I was so traumatized from it I didn't know what to do and being someone that already is legally disabled from mental health issues it really did a lot to me. My fiance advised me to call the main corporate office to make a complaint. I did make a complaint and got a complaint number and also fixed my online account so I wouldn't have to speak to **** again. I feel something should be done about this issue with **** as he as got violent with me before over the phone a year prior but I didn't do anything about that incident. I feel he has a very aggressive anger issue and being in customer service speaking to customers like that will never have them coming back. Definitely over something as little as a misunderstanding about less then a half missed payment. I did get my online account fixed when the very generous employee from corporate fixed it for me and was able to make that half of a missed payment.Business response

I have reviewed the response made by the business in reference to complaint ID ********, and find that this resolution is satisfactory to me as long as they are actually trying to do something about the incident and I feel further action should be taken as it comes to the employee ****. I already made a complaint with corporate and was supposed to be called by head of the branch but never received a call to handle the situation.

************ is 100% disabled due to hearing and has suffered a series of ischemic strokes from Jan 2023 resulting in apraxia and aphasia. As his POA, I have assumed his business matters. On 5/30/24 , I went to Lendmark Financial to pay off the amount shown on the statement $8234.71 before the due date. When I arrived, they cited an additional $1219.54 due, which I paid totaling $9454.25 and requested copies of all documents associated with the account and the paid in full statement. They denied the request even though I produced a POA. I filed a complaint on the corporate number and was told they had to validate my POA and in 10 to 14 days, I could get the documents. On,6/12/24 ,I arrived and repeated my request. After showing my ID and reminding them that they had copied my POA, a representative produced copies of the account documents. After, I looked for the signature sheet and the consent to **signature file form, she begins to explain how everything is done electronically behind a screen on a computer and how many ways they sent forms to him on his phone. Her statement, "We thought that he was capable" indicates that they knew something was not right about my husband's demeanor. My 73 yr old husband has never been capable of manipulating technology. Prior to the strokes he could only answer a cell phone. So going behind a screen, completing forms on a computer and understanding as well as giving consent to the **signature process is impossible. The documents they produced do not have any natural signature as I understand is a federal requirement. The signature shown on the document I sent is not how he signs his name and has never been his signature. He does not have the ability to understand and manipulate technology to complete forms. So who completed the promissory note and security agreement. for this transaction? Why isn't there a natural signature sheet showing that he gave consent? ************ has been a customer of ****************** since March 2022 and has had four loan accounts with us since this time. ************** most recent loan was opened on September 26, 2023; he was physically present in our *********, ** branch for the entirety of the loan transaction and was provided with a copy of the executed loan documents. ************ has made on-time payments on all previous accounts and only fell behind on the current account that was paid off on May 29, 2024.
When documents are executed using an electronic signature, they are emailed to the customers verified email address and ****************** has been confirmed as ************** email address on file at the time of all loan closings. Further, e-signatures can be drawn or generically populated by the signatory.

You entered an interest-bearing installment loan secured by consumer goods with Lendmark on September 30, 2016. As fully disclosed on the Disclosure Statement, Promissory Note, and Security Agreement, (the Loan Agreement) the original amount financed of $8,399.18,interest rate of *****%, a total payment of $14,859.60 to be repaid over 60 months in $ ****** monthly payments. You have made 71 payments on this account in which 55 were accessed a late fee.
The interest for this loan is calculated using the daily simple interest rate. Accordingly, interest accrues daily on the unpaid portion of the principal balance. All payments made on the account were applied in accordance with the terms of the loan agreement, which states each payment you make on this loan will be applied first to late charges (when applicable), then to interest that is due, then to principal that is due and then to any other charges due hereunder.
Additionally, as of June 28, 2024, your account has been restricted and you will no longer receive calls from Lendmark.
A copy of your payment history has been mailed to you for review.

On November 18, 2021, you entered into a loan agreement with Lendmark Financial Services. Your original balance was $4,766.47, which was financed for a term of 48 months, with a first odd payment of $254.35 due starting on January 2, 2022, and payments of $188.58 monthly thereafter.
Lendmark has mailed a copy of the Disclosure Statement, Promissory Note and Security Agreement ("Contract") with the customer's signature, along with a copy of the customer's payment history to provide the ledger of account payment activity, to the customer's address on file to provide proof of debt.
Additionally,the Lendmark account referenced in your complaint was charged off on April 26,2023, and subsequently sold to ****************** Lendmark is no longer attempting to collect this debt.
