I am a victim of identity- theft, I am writing to request that you block all accounts disputed as fraudulent on my credit reports with Transunion, Equifax, and Experian. This information does not relate to any transactions I have made. I did not give anyone authorization or consent to use my personal information. I hereby exercise my legal rights enacted by Congress and The Federal Trade Commission, which explicitly states when a victim of identity-theft dispute a fraudulent account on his/her credit report it shall be honored by all credit bureaus and all fraudulent information should be blocked within 4 days and proper notification shall be given to all data furnishers pursuant to section 605b of The Federal Fair Credit Reporting Act. 1. Business Response /* (1000, 5, 2021/10/04) */ I have reviewed the complaint and offer the following explanation. We previously received an online dispute from Mr. ******** on April 18, 2018. At that time, we sent him an Affidavit of Fraud to complete, which we never received back. We will mail Mr. ******** an additional Affidavit of Fraud which he will need to have notarized. He will also need to provide a police report and picture ID so we can further investigate his claim. I trust this resolves the complaint brought forth.

On 9/23/21, Lendmark Financial Services made an unauthorized hard inquiry on my Equifax credit report. I have never applied for any type of loan or credit with this company and want this hard inquiry removed from my credit report immediately.

      Business response

      10/13/2021

Business Response /* (1000, 5, 2021/10/04) */ LENDMARK RECEIVED AN APPLICATION FROM MS. ****** VIA INTERNET ON SEPTEMBER 23, 2021. THE REQUEST WAS FOR $3000 FOR BILL CONSOLIDATION. THE CREDIT IS AUTOMATICALLY PULLED BEFORE THE APPLICATION REACHES LENDMARK. IF MS. ****** THINKS SHE IS A VICTIM OF IDENTITY THEFT, SHE WILL NEED TO FILL OUT AN AFFIDAVIT OF FRAUD AND HAVE IT SIGNED AND NOTARIZED ALONG WITH A COPY OF A POLICE REPORT AND A PICTURE ID SO WE CAN FURTHER INVESTIGATE. Consumer Response /* (3000, 7, 2021/10/04) */ (The consumer indicated he/she DID NOT accept the response from the business.) I most definitely did not submit an online application and don't understand why the onus is on me to prove that as opposed to Lendmark proactively investigating who fraudulently submitted an application using my identity. This should simply be a good faith business practice on their part and one that does not require the filing of a police report. I have already reported this incident to my various identity theft service providers and to all three credit reporting agencies for further investigation. Business Response /* (4000, 9, 2021/10/07) */ In order for Lendmark to investigate any claim of Identity Theft, we require a signed, notarized Affidavit of Fraud, police report and a copy of a picture ID. We will mail Ms. ****** an Affidavit of Fraud to the address on the complaint. If she will return it along with a police report and picture ID, we will be able to further investigate her claim. I hope this resolves the complaint brought forth. Consumer Response /* (4200, 11, 2021/10/08) */ (The consumer indicated he/she DID NOT accept the response from the business.) I accept that this is what Lendmark is requiring of me, but I don't believe that it's reasonable or necessary for me to file a police report in order for the company to investigate my fraud complaint. Because of this requirement, I don't accept the proposed resolution.

Business Response /* (1000, 5, 2021/10/07) */ We have reviewed the complaint brought forth and offer the following explanation. We have attempted to contact Pinjo, the owner of Daily Driven Motors multiple times, concerning Mr. *******'s title. We have not received a response. We have now contacted the Idaho Motor Vehicle Investigation Department to request their aid. If Mr. ******* will contact Mr. Tangermann at the Meridian ID branch, at XXX-XXX-XXXX, he will be glad to give him the contact name and number for the person working on the investigation. She also has other options that she can discuss with Mr. ******* to try to get this situation resolved. We apologize for any inconvenience this has caused Mr. *******. I hope this resolves the complaint brought forth. Consumer Response /* (3000, 7, 2021/10/08) */ (The consumer indicated he/she DID NOT accept the response from the business.) I was the one who was calling and driving to the dealership looking for responses while Lendmark would verbally say we have been trying to contact them but no response from them. In September when I last spoke to a person at lendmark he said the above, when I asked about the Idaho Dept of Transportation he did not respond saying we have contacted them. so on Sept 16, 2021 I sent in a paper of the complaint and investigation for after filing the BBB complaint as well. I did not hear back so on Sept 21, 2021 we emailed the form again, and no response. Then on monday Oct.6th 2021 I called and emailed IDT for the 3rd time and finally recieved a response of there was nothing be done on the title and they were still waiting for the title and correct paperwork. They also said they had no recieved a form and to resend it so for the 4th time I sent it in. On Oct 7, 2021 I recieved a email with kendras name and number before Jeff Heath called and spoke to my wife. If my wife hadnt been calling and doing what she needs to do to help me, we would still be sitting here with no response and nothing be done. Business Response /* (4000, 9, 2021/10/20) */ Our AVP, Mr. Heath, had a conversation with Pinjo at Daily Driven Motors concerning a resolution for Mr. *******. Pinjo has agreed to let Mr. ******* return the vehicle and upon receipt, we will close the loan with a zero balance and clear any discrepancies on Mr. *******'s credit reports. Mr. Heath also had a conversation with Mr. ******* on 10/15/21 and at that time, Mr. ******* agreed to the terms. Mr. Heath has attempted to call Mr. ******* to set up a meeting at the Meridian branch so all of this can be taken care of at one time. Once Mr. ******* contacts Mr. Heath, we will be glad to take care of the situation. I hope this resolves the complaint brought forth. Consumer Response /* (2000, 13, 2021/10/20) */ (The consumer indicated he/she ACCEPTED the response from the business.) I am willing to return the vehicle and delete all credit information like this purchase did not happened but I do need some of my money back to be able to get into another vehicle since this was the vehicle I used to work. Due do all this time of not being able to drive it, I have had to put a little more than 15,000 of mileage into my personal truck which at the time had 49,000 miles and now has 65,000. Since I do have to travel a lot for work. But if we can not make an agreement I can just decline the proposal and proceed with the legal plans I was about to start, before the proposal.

Between March 2021 and to the present, Lendmark loaned me about $2500 for a personal loan. They only presented me a check and told me to pay them back with the app. Their app doesn't work. So they kept on harassing me, my family, and my work to them back. I had to pay them cash at the door every single time as they won't accept a check. They are still harassing me, my family, and work as well as sending me advertising to take out another loan. They won't tell me what my payoff amount is suppose to be because they keep on harassing everyone. They are now on the blocked on my cell phone and marked as spam. This organization should be unlawful to do business.

Business Response /* (1000, 5, 2021/09/28) */ I have reviewed the complaint brought forth and offer the following explanation. Mr. Rosenows' account was set up on recurring ACH payments. His first payment was drafted on April 12, 2021 and returned on April 15, 2021. His second payment was drafted on May 12, 2021 and was returned on May 15, 2021. Per our policy, after two returned items, the ACH payment method is restricted for three months. This is the reason why we couldn't accept a payment by check at the time. This restriction has since been lifted. He may also call the branch and pay with his debit card. Mr. ******* is still responsible for making his contractual payments each month. If he would like a payoff, he can call his local branch and they will be happy to assist him. Per Mr. *******'s request, we have noted his account, "no contact." I trust this resolves the complaint brought forth.

Took out a car loan with Lendmark and was told GAP insurance was included. My car was stolen and was deemed a total loss by the insurance company. The insurance company paid Lendmark the value of the car and I was left with a balance of $6200. I thought the GAP insurance I was told I had would cover the remaining balance, but this is when Lendmark informed me they are not authorized to sell GAP insurance. How can they make car loans and not sell GAP insurance? Please investigate this company for unfair practices.

Business Response /* (1000, 5, 2021/09/20) */ I have reviewed the complaint brought forth and offer the following explanation. Lendmark is not licensed to sell GAP insurance in the state of VA so we cannot offer this product to our customers. We tried to reach out to both owners on the account several times to try to refinance and lower their monthly payment. If Mr. ******* has any questions regarding his account, he needs to contact the Farmville, VA branch so they may assist him. I trust this resolves the complaint brought forth.

In December 2018 I borrowed $3000 from Lendmark Financial in Frederick, MD. The loan was for 36 months at a monthly payment of $117.68. Subsequently, I did fall behind at one point in 2019 and was assessed fees of $437.11 and $74 by the court. Payments resumed as agreed and the judgment was vacated with the assessed fees. In June 2021, I received a deferment and in that email was a letter stating that my majurity date was now extended to April 20, 2022. As of today, I have 8 payments remaining which at $117.68/ month equals $941.44 however when I called to get the pay off amount I was given a payoff of $3,394.54 ... this is broken down by the attorneys fees and court costs of $437.11 and $74 respectively, over $700 in accrued interest and $2068 as the principal balance. How is it that I have made 28 payments of at least $117.68 (many months I paid more), have only 8 payments remaining and I owe more than I borrowed? This is a scam and they're holding my credit hostage.

Business Response /* (1000, 5, 2021/09/13) */ I have reviewed the complaint brought forth and offer the following explanation. Our AVP, Natalie Bridge, reached out to Ms. ******* concerning her payoff amount. Ms. Bridge waived $767.28 in back interest to help Ms. ******* catch up and pay off the loan. Ms. ******* did pay it off on September 2/2021. We have mailed Ms. ******* a copy of her pay history to her new address. I trust this resolves the complaint brought forth.
