Purchased a vehicle from Smart Honda of Davenport ****************************, Davenport, ** ***** for $46,493.45. After purchase, requested to inspect exhaust to see if street legal. There was no muffler on the vehicle at the time of sale. Inspection performed. Report states Exhaust is passing state emissions code, though no mention of requirement of having a muffler. Per IA Code Title VIII Transportation, Chapter 3 Motor Vehicles and Law of the Road Section ****** Mufflers, prevention of noise: *********** vehicle shall at all times be equipped with a muffler in good working order and in constant operation to prevent excessive or unusual noise and annoying smokeVehicle was sold without a muffler and did not follow State Law, and dealer did not correct or acknowledge issue.Owner installed muffler at own expense of $1,386.35.

We performed a pre-owned vehicle inspection on this vehicle on May 26, 2022.  During the inspection the exhaust system was inspected for leaks, damage and loose parts.  We also inspected the catalytic converter and heat *******.  All of these items passed our inspection.  A vehicle without a muffler would be extremely loud and could and would not be sold by us.  The inspection form is attached.  Three months later,On August 29th, the guest brought the vehicle in for a few items after taking the vehicle to *********.  One of the items from Green was a handwritten note with an estimate to replace the aftermarket exhaust system.  Note attached.  Replacement means that they verified it had an exhaust system.  We have done our best to accommodate our guest and as a goodwill gesture replaced numerous items at our expense after the sale including strut and taillamps.  The exhaust we denied because it had an exhaust system and passed inspection.  If you have any other questions please reach out.  Thank you

I am rejecting this response because: The dealer claims the exhaust system was atter-market, which is not the case. The exhaust system at the time of purchase was the original equipment, but the muffler had been cut out and a straight pipe was welded in its place. This should have been identified during the vehicle inspection. We had complaints by several neighbors regarding the noise. The dealer's inspection process also missed several items that they did address. The inspection form can't be trusted as a true representation of the state of the vehicle.

    Sincerely,

Again, selling a vehicle without a Muffler would be so load it would not be road legal to even drive. additionally, the muffler on the vehicle provides back pressure to the engine and with a strait pipe, the vehicle would barely run. The vehicle was a used car and it was traded to us with an Aftermarket Exhaust system which was operational and free from defects. The customer had an opportunity during the buying process to address this if the muffler was loud as she suggests, yet did not address it until months later. We have went above and beyond to address some of her issues as a goodwill gesture, but we are not willing to reimburse her for work done at a another location for something that was operational and present when she purchased the vehicle. Every customer has an opportunity to have vehicles inspected by a third party before purchase if there are concerns about the vehicle, but I can assure you that this vehicle was not and could not have been sold without a Muffler. Our Inspections are date and time stamped and we use *************** Technicians to inspect our vehicles... if the muffler would not have been present, it would have been noted on the inspection and replaced before being allowed on the lot for sale. I am sorry that this answer will not satisfy your concerns, but we have done nothing wrong and stand by our original statement.
