The Complainant initially contacted ARAG in May 2022 stating they sent via registered mail some documents to ARAG in March 2022. ARAG checked and informed the individual that we checked and did not receive any mail.
According to the Complainant, a postal worker signed for the mail. Even if a postal worker signed for the mail, it was not delivered to ARAG.
ARAG checked the tracking number the Complainant provided on the **** website, which indicated it had not been delivered to ARAG. Thus, we asked the individual to email us the documents, which they did in May 2022.
In checking the **** website almost two years later, see attachment, it still shows the item was not delivered.
In the Complainants BBB Complaint, they provide a different tracking number than what they provided to ARAG in 2022. In checking this number on the **** website, the attachment shows that the item was not delivered.

I had ARAG insurance through my employer. I decided to continue my coverage in 2022 after I left the employer. Last year in Dec, I received a letter from ARAG saying that they will be ending my coverage based on my request to terminate. I was shocked to read that letter as I never requested for coverage termination. On digging further, it turned out that ARAG had themselves decided to end my coverage. The reason given to me was "increased risk", whatever that means. First, ARAG failed to give me a 30 day notice period as required by the policy. Second, while they said that cases that were already created would be honored, they have done everything within their power to not cover my pre-existing issues. Even the cases that they explicitly confirmed coverage for, they are not assigning attorneys, even when I have an in-network attorney ready to take the case. It has reached a point where they have stopped responding to several messages I have sent. At this point, I have 4 cases that were confirmed to be covered that are pending attorney assignment.

ARAG offers a legal expense insurance plan. When a plan member has a legal need during the policy term, they are to contact ************* and, based upon the information provided by the plan member, coverage is either confirmed or denied if there is no coverage. A CaseAssist Confirmation is then sent to the plan member setting forth the nature of their confirmed coverage under the plan and it also states that coverage *** be affected if the facts change in any way or if additional information is obtained that *** trigger an exclusion under the plan.

The legal expense insurance policy provides plan members with access to network attorneys who have contracted with ARAG to provide covered legal services. Plan members also have the option of using a non-network attorney of their choice under an indemnity benefit. It is the members responsibility to contact and retain an attorney, whether it is a network attorney or a non-network attorney. If the plan member is having difficulty in locating and retaining a network attorney, they can contact ARAG for assistance.

The Complainant was enrolled in their employer-sponsored ARAG legal expense insurance plan. ARAG was informed by their employer that as of July 31,2022, they were no longer eligible to participate in the employer-sponsored plan. The Complainant then enrolled in a conversion legal expense insurance plan directly with ARAG. The term of a conversion plan is January 1 December 31 for the respective calendar year. The Complainant enrolled in a conversion plan effective August 1, 2022 December 31, 2022. The Complainants conversion plan was renewed for January 1, 2023 December 31, 2023.

On November 7, 2023, a Notice of Non-Renewal was mailed to the Complainant. The U.S. ************** provided ARAG with a Certificate of Mailing as evidence the notice was mailed by ARAG. The notice stated the Complainant was currently enrolled in a conversion legal plan effective January 1, 2023, through December 31, 2023, and that ARAG had elected not to renew the plan when it automatically expired on December 31, 2023. The notice also gave the reason the plan was not being renewed, stating the risk originally accepted has measurably increased.

Unfortunately, the system inadvertently sent a December 5, 2023,letter to the Complainant stating ARAG had received a notice they wanted to cancel their coverage and, if they did not intend to cancel their coverage, to contact ARAG. On December 20, 2023, the Complainant emailed ARAG stating they received a letter dated December 5, 2023, and they did not request their policy be canceled and wanted to continue coverage. ARAG sent a letter to the Complainant dated December 21, 2023, informing them of the inadvertent error and that their plan was not being renewed when it automatically expired on December 31, 2023, pursuant to the Notice of Non-Renewal mailed on November 7,2023.

On December 22, 2023, the Complainant emailed ARAG asking how their risk had increased and stated they were under the impression their legal plan was available for lifetime. ARAG responded on December 28, 2023, stating ARAG uses various tools in assessing a risk, analyzing the claim information provided by the insured, the number of claims submitted, the types of claims submitted, and claims paid. In addition, the Complainant was informed that since they enrolled in the conversion legal plan in August 2022, they have opened multiple cases, thereby increasing the risk to a level which is no longer sustainable by the premium. The Complainant was also informed that there are no ARAG legal plans available for lifetime and that ARAG is not required to renew an insureds legal plan when it automatically expires.

The Complainant emailed ARAG on December 29, 2023, referencing the various ARAG letters and that ARAG did not provide 30 days notice to cancel the legal plan. The email also listed the cases they needed an attorney to handle. ARAG responded on January 4, 2023, stating the 30 days notice referenced in the legal plan pertains to sending a notice of cancellation and their legal plan is not being canceled. Their plan was not being renewed when it expired on December 31, 2023, and they still had coverage for those insured events that occurred during the effective dates of the legal plan. ARAG reiterated that the December 5, 2023, letter was sent in error.

As previously stated, the Complainant was enrolled in a conversion legal plan effective August 1, 2022, through December 31, 2022, which was renewed for January 1, 2023, through December 2023. The legal plan was not renewed for 2024.

      The legal plan:
defines Insured Event - an event covered by this policy whose initiation date will be considered the earlier of the date (a) written notice of a legal dispute is sent or filed by you or received by you; or (b) a ticket or citation is issued; or (c) an attorney is hired.
states, You or your representative must submit a written notice of claim to us within one year after the insured event.
states, You must give us all information we request with respect to the circumstances of an insured event or service provided. We have the right to withhold benefits if the requested information is not provided to us.

The Complainant references four different cases in their complaint:
Case ******* the Complainant contacted ARAG on December 20, 2023, and, based upon the information provided, coverage was confirmed as a paid in full benefit of attorney fees when using a network attorney. A CaseAssist Confirmation was sent to the Complainant that same day providing them with the name of a network attorney who indicated they were interested in assisting the plan member. The Complainant contacted ARAG on January 8, 2024, stating they wanted to work with a non-network attorney. On January 26, 2024, The Complainant was informed they had the option of working with a network attorney or they could use their indemnity benefit if they wanted to use a non-network attorney. The Complainant was reminded that ARAG had sent them contact information on December 20, 2023, for a network attorney who was interested in handling their case. On January 29, 2024, the Complainant emailed ARAG stating they wanted to work with a non-network attorney. On February 7, 2024, the Complainant was informed they could retain a network attorney or use their non-network indemnity benefit. On May 2, 2024, the Complainant stated they found a network attorney to handle their case. On May 7, 2024, a CaseAssist Confirmation was sent to this network attorney and the Complainant.

Case ******* This case was opened on June 26, 2020, and coverage was confirmed based upon the information provided by the Complainant. The Complainant has worked with several different attorneys on this matter. The Complainant informed ARAG they are currently working with an attorney but now want to use this same network attorney who they also want to handle Case *******. Network Attorneys are required to list in their ARAG profile those areas of law in which they will accept a case on behalf of a plan member. A network attorney is not to accept a case if the legal matter is not listed in their profile. On May 7, 2024, ARAG informed the Complainant that we left a couple of messages with the network attorney they want to use to see if he is able to handle this type of case as he does not have this legal matter listed in his areas of law on file with ARAG. The network attorney agreed to handle this case and an updated CaseAssist Confirmation was sent to the network attorney and the Complainant on May 17, 2024.

Cases ******* and ******* - The Complainant contacted ARAG on December 22, 2023, regarding disputes with neighbors and giving a loss date of July 19, 2020, and stating there were both written and verbal communications with two different neighbors regarding the property line dispute. Even though a CaseAssist Confirmation was sent that same day confirming coverage on both matters, the confirmations state that if the information changes in any way it *** affect coverage. The legal plan states that the plan member must give ARAG all information requested to determine coverage. On January 10, 2024, The Complainant stated that, while the attorney they are currently working with on Case ******* (see bulleted case above) was visiting their property on December 5, 2023, they showed the attorney the other property issues they were having, and the attorney said he could handle these matters as well, so the plan member wanted these two cases assigned to this same attorney. On January 10, 2024, ARAG requested the Complainant provide documentation as to when the initial written communication occurred with these two neighbors. Regarding Case *******, a text dated August 18, 2022, between the plan member and one of the neighbors was produced. ARAG was waiting to receive any written communication between the plan member and the other neighbor regarding Case *******, but none was received. On January 25, 2024, the Complainant requested these two cases be assigned to the attorney who was handling Case *******. On January 26, 2024, the Complainant was informed coverage was being denied on both cases since the one-year time frame to submit a notice of claim has passed. On January 29, 2024, the Complainant stated they do not recall having provided a loss date of July 19, 2020, and that these matters did not become an issue requiring legal assistance until 2023 and their communications with their neighbors were verbal. On February 1, 2024, ARAG responded stating coverage is not determined when the matter needs legal assistance, but it is when the dispute began. The Complainant then responded stating the disputes began in the second half of 2023, and these were verbal disputes. On May 2, 2024, the Complainant requested these two cases be assigned to the same network attorney they wanted all of the other cases assigned to. ARAG contacted this same network attorney to see if he was willing to handle these two cases. The network attorney responded in the affirmative and on May 17, 2024, CaseAssist Confirmations were sent to both the network attorney and the Complainant. With respect to these two cases, ARAG has requested the network attorney review the matters and provide ARAG with information as to when these disputes began in order to determine if there is coverage under the legal plan.

The network attorney requested by the Complainant has now been associated with these four cases.

*************************************** 4054-2164-3004 **************************************** I began as an ARAG Legal subscriber while working as a contractor in a federal agency back in 2007; the subscription was offered as an employee benefit. When the contract ended and my employment ceased, I continued to pay the monthly fee to continue my subscription. For years, I continued to be enrolled without needing legal help. As I have retired and have received public benefits because of my reduced income as legal problems began to appear, when I have turned to ARAG, I am left feeling as if I am wearing the Emperor's clothes. The "help" that I receive continues to be worthless or nonexistent. Most recently, I approached with documentation of a legal problem and was given a list of attorneys to consult. When I contacted them one by one, either they said they did not handle cases such as mine or they never responded. The problems only increase as I age and I have contacted ARAG about them, but I need real help but receive none. I am not in a position to pay money for no help at all. Free legal services have been the ones who have helped when I would receive help; ARAG has never offered any real help. I cannot recommend them and would advise others in need to forget about turning to them. Why pay money and get nothing in return? Legal problems abound in today's *************, but the laws protect only the wealthy; everyone else can just die. I am wondering if I will be one to join their ranks because ARAG has had more than enought opportunity to make a positive difference but has shown no intentions of doing anything for me.

When the Customer contacted **********************, they described the current legal matter and ARAG confirmed the applicable services available in the legal plan as a personal injury contingency matter. I purchased the Will Builder tool when I submitted my taxes through TurboTax. I am completely unable to access the product for which I paid. The ARAG Legal websites have never loaded on any browser on any machine, despite adjustments to security permissions and firewalls. When I have contacted them to complain, they insist the websites are running without problem and that the issue must be on my end. However, that simply cannot be the case as I have sought help through my organization's IT team, and they were unable to access the website. Essentially I have donated $40 to a fraudulent company.

In reviewing our files, we discovered the Complainant has two accounts with **********************. This could have been the reason they were having difficulty logging into the system. The Complainant recently purchased the Will Builder tool through Intuit/Turbo Tax, but the Complainant also has an existing account through their life insurance provider which allows them access to the same Will Builder tool. ARAG contacted the Complainant, explained the situation, and indicated we are in the process of refunding the amount they paid to Intuit/Turbo Tax. ARAG also instructed the Complainant on how to log into their existing account.

I enrolled through my employer after reading arags plan stating that it was %100 covered and the service would contact lawyer. Then upon using the service I received an email stating only 25% covered and the rest of the costs associated with it not covered. Then waited and waited for a response. To then find out I need to contact and find my own lawyer at a discounted rate. I was never notified of my lawyer choice and in the meantime I have been doing my own leg work in the matter. I feel the information my work was given does not reflect the service I am receiving/ NOT receiving and when I asked to cancel they tell me I need to wait until open enrollment a year from now or Unless a major life event happens. No apologizes on bait and switch and false representation of services or lack of. No help trying to resolve the matter and then i read complaints that I am not the only one. I just want them to cancel my plan for 2023 & ****

The plan members employer (policyholder) offers a legal plan to its employees as a voluntary benefit. ARAG prepares materials for the employer to provide to its employees explaining the legal plan, how to use the plan, providing examples of legal matters that are covered under the plan, etc. The flyer that ARAG prepared for the plan members employer to use stated, network attorney fees are 100% paid-in-full for most covered matters. The flyer did not state that ARAG will contact an attorney for the plan member. The flyer did state, limitations and exclusions apply. The flyer stated that for a complete list of ************* matters and for more information about the companys plan to visit the website to review the legal plan and the flyer provide a website address and access code for the employees to use. The website contained the following info:
Here is a list of legal matters covered under your plan. There are a few exclusions, so we recommend reviewing What's Not Covered before enrolling in a plan.
The legal plan does not cover legal matters that are considered pre-existing. You may be eligible to receive reduced-fee services. Learn more here.

The employer allows eligible employees to enroll in the plan within 30 days of beginning employment or a qualified life status change as determined by the employer. The plan member enrolled in his employer-sponsored legal plan effective 11/6/2023. The legal plan defines:
CERTIFICATE YEAR twelve (12) month period as listed on the declarations page of the policy issued to the policyholder.
EFFECTIVE DATE the date on which the policyholder enrolls the named insured and from which date premium has been paid for you.
INSURED EVENT - an event covered by this policy whose initiation date will be considered the earlier of the date (a) written notice of a legal dispute is sent or filed by you or received by you; or (b) a ticket or citation is issued; or (c) an attorney is hired.

On 11/22/2023, the plan member contacted ARAG regarding coverage for a legal matter and stated he first received written notice of the matter on 1/15/2023. Since the member received written notice of the legal dispute prior to the effective date of his legal plan, the plan member was informed there was no coverage as the matter was pre-existing.

When a legal matter is not covered and not excluded under the plan, the plan member may be eligible to use the legal plans Reduced ********* Services benefit whereby a network attorney will bill the plan member at 25% off their normal rate. Access to a reduced fee network attorney is subject to availability. The plan member is responsible for locating and retaining a network attorney. Plan members have access to a directory of network attorneys.

The plan members plan in effect for 2023 automatically terminates effective 12/31/2023. It is the employers decision, not ARAGs decision, whether or not an employee enrolled in the employer-sponsored legal plan can cancel their participation during the term of a legal plan. If the plan member is enrolled to participate in the legal plan for the calendar year ****, we suggest the member contact their HR Department as it is not ARAGs decision whether the plan member can un-enroll for the **** plan.

I first purchased this legal plan through my employer. It was a terrible experience. These people refuse to help you. They are truly not concerned about making sure you get what you need to help with a legal situation. Most of the attorneys on ARAG's list are no longer affiliated or they no longer practice in areas. They continued to send me the same list with the same attorneys. I told them several times these attorneys are no longer with ARAG. Then they sent me a list with attorneys within a 100-mile radius. I could not believe that. I am not going through this list and call every attorney on that list. Then they told me there is nothing else they could do for me.As a matter of fact, I dropped them from my benefits from work. The next year around March they contacted me though email. They basically apologized for what happened the prior year and they will offer me a membership for the same amount I paid through my employer. I paid $9.70 a month. I reluctantly decided to give ARAG another chance. Big mistake! I auto pay all of my bills. I had no idea until now that ARAG has been charging my $29.95 a month until almost the end of this year. They also back dated the plan to January. I have it all on record. These people are rude. They are dishonest, disrespectful and unprofessional. Please don't purchase this legal plan. Read the many reviews saying the same things about ARAG here on the BBB. I gave ARAG the benefit of the doubt. Around $300.00 for nothing but grief from the company. I feel like I was robbed.

Plan Member has notified ARAG of difficulty finding a network attorney to provide services for matters covered by the conversion ARAG legal plan. Twice in 2023, Plan Member contacted ARAG to cancel their membership then contacted ARAG to reinstate the membership. At this time, ARAG can terminate the membership with a retroactive effective date of January 1, 2023 and refund Plan Member for the premium paid since January 1, 2023. If Plan Member agrees to release ARAG from any claims for insured events occurring on or after January 1, 2023, ARAG will refund Plan Member $329.45.

Had their policy for over 2 years. Wanted estate planning documents a fully covered service. They referred me to two attorneys: both tried to process me the same way - fill out a form, they return shoddy computer generated documents, neither did a review of the documents with me, either asked any questions to make sure the documents reflected my legal need, and one attorney was not even local (they advertise, even on their telephone hold message, that they refer you to a local attorney. In my opinion, this insurance and their network of lawyers is worth nothing. The latest issue with the last attorney referred occurred 5/16/2023. They are referring to attorneys that are not willing to actually provide legal services and represent and advertise they refer you to local attorney. They attorney they referred me to were not will to do any legal consult and were not willing to meet with me in person.

Plan member enrolled in an ARAG legal plan available through his employer, effective January 1, 2021. Plan member utilized the legal plan in February 2021 and November 2022, with ARAG paying claims for each use. ARAG has accepted the plan members cancellation request, effective June 30, 2023,however, is not permitted to refund premium paid into a group insurance policy when claims have been paid on behalf of the plan member.
ARAG customer care representatives advised the plan member to contact his human resources or benefits department regarding the possibility of a refund. Plan member should be aware that, depending on billing and payroll cycles, he may have additional premium deductions from his paycheck.
ARAG cannot require a network attorney to meet with a client in person. ARAG is not permitted to interfere in the attorney-client relationship.

      Complaint: 20067896

I am rejecting this response because:

      1) The insurer promised to refer me to local legal firms: in both referrals the firms refused to meet with me in person. I suspect one or both have only local mail drops or non-operating offices.

      2) I was promised legal services that were not delivered by either firm I was referred to.  I answered questions that were then carelessly put into standard template forms. I was provided no services by any lawyer.  I was not able to consult with a lawyer regrading my concerns as to how the legal documents worked.

      3) I was not given adequate instruction as to how to file the legal forms.

In fact, the insurance does not provide legal services as advertised and promised. If it is only a referral service this should be made clear in their marketing and promotion. If they promise to cover legal services they must also be responsible to assure that legal services are provided.  If, as in this case legal services are not provided, they should not pay the providing firms.  In short, the insurer is not performing and I again request a refund of my premium based not on the lack of performance by the legal firms, but on the basis that the insurer is not providing coverage as advertised.

      Sincerely,

      *****************************

Plan member had the option at any time to change attorneys to make sure to get a local attorney who would meet with him in person to review his estate planning documents. He used the plan in 2/2021, 3/30/2021 and 11/17/2022, paid a total of $315.89 in premium (31 months x $10.19/mo.) and we paid out $1250.00 in claims. Although PM is not satisfied with the services received, ARAG has paid out claims totaling nearly 4 times the amount PM paid in premium. Any refund request must be directed to by his HR/Benefits department.

I have been an ARAG member for over 20 years. When my wife passed coverage was passed on to me. As others below, it is impossible to get an attorney to honor ARAGs customer agreement due to the low reimbursement rates for issues. As others have shared, in trying to utilize my coverage I have had significant difficulty utilizing my coverage with ARAG because multiple attorneys listed as in-network that I've contacted have said the ARAG reimbursement was too low. ARAG finally found an attorney to handle the case, but the attorney does not follow up and basically does nothing, again this is due to low reimbursement rate that ARAG provides. We asked for an alternate attorney and ARAG agreed, however the alternate attorney does not respond and again, one can only assume this has to do with the rate being paid. This is not a complex case, its a nothing case, so I can only imagine the difficulty one would have with dealing with ARAG on a complex case. Anyway, the company advertises this a "Paid in full benefit" but the service provided by anyone who would accept the plan is basically non-existent as others below have attested to as well.i am seeking either a full reimbursement of all premiums paid for the last 20 years since my wife had the plan or to have the ARAG service provide the benefit and representation for which I am entitled under the beenfits as a plan member. I do not want to be treated as a fifth class citizen on a legal matter due to the legal plans reimbursement rate and contracts with attorneys, I demand ARAG to be accountable for the legal representation in a professional manner and or reimbursement and or payment to a competent attorney of my choosing as per the plan lists this a paid in full benefit. Thanks

ARAG has contacted the current attorney providing services to the plan member and asked the attorney to provide the plan member an update on the legal matter. The attorney contacted plan member to provide an update regarding drafting documents in preparation for the trial scheduled for April 10th. We are hopeful the member is now confident in the services they are receiving.

ARAG has a contract with my employer and advertises and sells their services as providing coverage for specific legal matters. However, in trying to utilize my coverage I have had significant difficulty utilizing my coverage with ARAG because multiple attorneys listed as in-network that I've contacted have said the ARAG reimbursement was too low. Also, one of the attorneys I contacted accepted my case then asked me to supplement ARAG's hourly rate.

Complainant is enrolled in an ARAG legal expense insurance plan offered by her employer as a voluntary employee benefit. The plan offers payment of legal services by a network attorney, in exchange for premium paid via payroll deduction.
Complainant contacted ARAG in January ******************************************************************************* a recently purchased residence. ARAG representatives verified coverage is available in the legal plan and provided contact information for network attorneys near the location.
ARAG has been working with Complainant to locate an attorney to provide service. We have put her in touch with an attorney and she is determining whether that attorney will be acceptable.
