    An issue involving *************************** and Hawkeye Chiropractic (Forza Chiropractic), which warrants your consideration due to potential violations of ethical standards. On 12/4 and 12/5, 2023, I attended appointments with *************************** at Hawkeye Chiropractic. During these appointments, the Dr. provided me with a diagnosis that he claimed required immediate treatment to prevent surgery. This diagnosis was communicated to me in a manner that induced significant fear and confusion. Following this, ****************** proceeded to pressure me into signing a financial agreement for future treatments. Feeling pressured, I signed the financial agreement without fully understanding its terms. However, less than an hour later, upon reflection and realizing my lack of comprehension and a need for a second opinion, I contacted the office to cancel the agreement and request a refund. I canceled all future appointments. Despite my request, they refused to refund the money, citing a clause in the financial agreement declaring it as final. Furthermore, it is pertinent to note that my ********** Blue Shield PPO insurance fully covered the two visits to Hawkeye Chiropractic. They could not have known my insurance status for the following year, thus had no basis to determine any out-of-pocket expenses I may have. To exacerbate matters, I was charged $2665.13, contrary to the $2587.50 stated in the financial agreement. When I sought recourse through my bank, initially, they issued a refund for services not rendered. However, the chiropractor's office pointed out a clause in the contract, resulting in the money being returned to them. I approached the ************************* for assistance. During my interaction with the *************************, a representative of the chiropractor suggested that my efforts to obtain a refund tarnish ********************** reputation, which seem as a veiled threat if I continued pursuing restitution or chose to disclose the details of their behavior.

    To Whom It May ********************************** was seen in my office for a treatment on 12/4/2023 and 12/5/2023. Attached you will find signed receipts for payment being disputed,signed agreement for services rendered, treatment calendar, appointment receipts, AG case closure, negative review and reversal from claimants bank in favor of us. As well you will find her signed financial agreement with our complete and itemized policies that was explained in detail (i.e. 3% credit card fee, cancelation fee, no show/no call policy, etc) to and signed off/initialed by Ms. ********************** documents attached are signed by *************** and services have been rendered. If not resolved properly I will be sending all claims to collections and filing a legal lawsuit for fraud and defamation against Ms. *********** Myself and attorney (*******************************, **************) have tried our best working with ****. At this point now we will be seeking legal action against her. He has been handling all the issues related to this.

    I am rejecting this response because:

    Firstly, as a consumer I have the right to seek help from Better Business Bureau or any other sources. I believe was entrapped and rushed to sign that agreement. I have the right to speak up about my situation, as you can see Dr. Voelsch is threatening me if I continue to seek help or speak up. What kind of doctor does that ? 

    Secondly, I do not have a partner, I have no connection that ****** review written and do not know the person that wrote that.  The only review I have ever left for this establishment said  along the lines of " I do not recommend" on ******** in a private group. Referring to the email that was attached by the business  " The negative feedback is constantly being posted on social media with them tagging our business"  I have not been posting negative reviews about them nor tagging their business on social media. Is every negative review they receive getting tied to me, other people can't be happy with the services they received?  As a matter of fact I can also say that this is a defamation of my character.  There are many reviews across the internet for this establishment some are positive some are negative, its scary to think that a doctor will threaten people with a lawsuit for simply giving their opinion. 

    Thirdly, they have not once reached out to me to try to make the situation better since the beginning, I have called them multiple times , but every time I call its answered  by someone who is not at the office and tell me I cant speak to the Doctor. That leads me to think that when I call from my cell number its automatically re-directed somewhere else.  When I emailed them originally theu said they will get back to me with a possible solution for the situation they never did. 

    As 20 year old student I worked vey hard for that money, this was my first experience with signing contracts and they rushed me through it. This situation would have been resolved much faster and easier if the business would of simply refund since I acted fasted to let them know I signed that without understanding the agreement. No actual services outside of the 2 consolation were done, so I do not understand why Dr. ************* is clinging onto the money that he received for the service that was never done. 

    I hope the Better Business Bureau will continue to support consumers and prevent unethical practices in business.
