    Real estate Agent ********************* is not abiding by the fiduciary duty of a client that he is representing. He is refusing to present an offer to a client he is selling a home for because he wants to do dual agency.

    I had hired ***************************** to list and sell my property. From day one it was explained to ******* that in order to move we needed the funds from the sake sto we needed a 30 day stay after closing. To which he said that was best explained by the attorneys after everything was agreed upon. Two of his three offers fell apart because of this fact. I told him we should be upfront but due to his weakness he put it on the attorneys. I ended up going to to rehab for alcoholism soon after his third offer fell through. I had limited access to a phone. Squatters broke into my home. I had them removed. ******* offers to help clean my place. My cousin says you may do what you need to and clean the house to sell. ***************************** hires **** got junk who comes and removes everything personal effect I own with the exception of some big furniture. Everything I ever owned is gone. I immediately fire ***************** who ignores my request until I attach his boss to an email. He then takes my home off MLS listing and files a lien against the home preventing my new broker from selling the home. When I asked him why he did such a thing his response was you have equity. I guess ***************************** determines that instead of a new home with my equity I can just replace everything I lost because of his wrongful action

    It is a flat out lie that Iie that I requested a 90 day stay and have back up from my real-estate lawyers office to acknowledge that up. It's a ********************* have two witnesses from the firming emails to back that up. Originally on the first offer we asked for thirty days and dropped it later to 10 days because we needed the funds from closing to hire movers. The 90 days is a ******************** by ***************************** period. I can send the emails if you prefer requesting 30 days maximum. ***************************** was never asked to negotiate anything over 30 days and I can prove it with emails and 2 other witnesses. I can also prove that ***************************** was too afraid to even mention the 30 day request he said it would be better for the lawyers to handle during closing.

    As we have already responded to the initial complaint, we thought that it was important to highlight the fact that the basis of Mr.******* desired settlement was to Take lein off my current property and release me from listing agreement free of charge. This has now occurred. **************** has been released from the listing agreement and the lien has been removed. As this was what **************** was seeking, we would assume that this matter can now be dismissed. Please reach out should you need anything additional from us.

    I am rejecting this response because:as per usual the communication ability of this company is very poor. I received an email from their attorney that the lein removal process was started. To which I thanked them hoping I would get an email verification once it was completed.  I have never heard another word from them. Their employee filed this lein and should prove its been released.
