      We hired Wheeling Construction to do renovation work on our property in January of 2022. They started demo in March. In June they said they had an underground plumbing inspection that had passed, I did not get a copy of the report. They said the city does not provide copies anymore and I had to wait and it would be posted online. We moved on with the build. Throughout the rest of June and July we had issues with these contractors. Twisted posts, misaligned **************** not the right windows and doors, just sloppy work. In August, after they had failed their rough plumbing inspection for what sounded like suspicious reasons and again had no report, our neighbor (a city water inspector) checked the building department for our inspection reports. He found no underground inspection had taken place and the rough had failed because of the unapproved materials they had used and the plumber failed to give the onsite architectural plans to the inspector. The ******* ******************* saw they had signed the back of the permit stating approval and advised us to get Wheeling Construction off of the property and start legal proceedings. After having a rough August with them, hearing the inspection news, and seeing the damage they had caused to the structural integrity of the house, we told them to get off the property because they were refusing to build to plan after being asked for several months. After about 6 months of looking, I was finally able to find someone to repair and complete the project. Our ****** found damages with the roof and the new balcony. The new ********* found most of the framework had to be redone, plumbing as well. We had to pay an additional $60,000+ to repair the damage Wheeling Construction had caused and have the framework and plumbing completed to the city approved architectural plans for the property. We are seeking not only a refund, but for them to pay for the damages caused & for the undue stress we endured throughout the last 12 months.

      We were hired by ****************** on February 8th, 2022 to do demo, framing, roof and gutters. ****************** never had us listed on her permit as she was the general contractor on this job. General contractors are responsible for all paperwork involved with the permits, including updating architectural drawings and preparing all required documents for inspections. This scope of work took an extended period of time due to the constant changes that ****************** requested. Unfortunately, the changes she requested were never updated in her architectural plans, and therefore the inspection partially passed on October 3rd, 2022. The notation on the inspection was structural changes. In regards to the plumbing the contract was signed on April 11, 2022 which included underground, rough and trim. The underground was completed and an inspection was scheduled on 6/14/2022. This inspection passed with the inspector #******** and we continued on with the remainder of the work. The rough in was completed for inspection on 08/29/2022. This inspection was a fail as the inspector requested additional insulation on pipes in the laundry room as well as to replace an additional pipe. Inspections are required in order to justify that the job was completed within the guidelines of the city. Failing an inspection is not something uncommon and allows us to make improvements to the job as a benefit to the customer. We tried to accommodate ****************** but the constant changes in materials and design led to a heated discussion. This discussion ended with ****************** no longer allowing us on the property to finish any of the remainder of the project or to make corrections for further inspection. As of October, no more has been done yet ****************** still has a substantial balance for materials purchased and labor completed. It is unfortunate that there is no resolution as ****************** resorts to personal attacks and threats.

      I am rejecting this response because:

      There were never changes made to the plan unless asked for by the contractors Wheeling Construction, and materials were NEVER changed. All changes made by ************************* were not approved by me (the general contractor) or the architect *************************. Any changes that were made by the architect because of a measurement mistake or something, were not followed by Wheeling Construction. Furthermore, Wheeling Construction never passed inspection because of their wrong materials and not building structurally to plan, the city inspector and building department told me this. There was a framework inspection in October that did not pass, not even partial, because of Wheeling Construction's poor work. I had to have inspection to be able to tell the new contractors what is wrong and get Wheeling Construction off of our permit as the builders. Fortunate for me at a 30 second glance by any of them, they could immediately see the horrible work they did and all of them told me it was done on purpose to s**** us. ************************* tried saying at termination in September that there was a change order however it is a lie. They also faked a rough underground plumbing inspection that supposedly took place on June 15, 2022, proof on the back of my permit is attached. I have too many images to upload and affidavits from other hired contractors (electrical, hvac, ****** and new carpenters) stating the terrible state of the home because of the poor work done by Wheeling Construction and *************************, and because of their refusal to follow the plan. Their plumber signed the permit, not the inspector, the city never received that initial underground inspection. All plumbing had to be removed to be redone with proper materials. The list on architectural plans never changed. All framework in ceilings and staircases had to be completely redone. Height was not correct on either staircase, wood was cracked and splitting from the way it was constructed, on all parts of the build they touched, not just the stairs and ceilings, and the wood was cracked everywhere from how the nails were driven through the wood. There was structural damage to the original existing support beam in the basement because weight was not properly distributed after they removed major support walls and did not install new support beams. We also have twisting posts on the front porch because of improper install and not following plan. We checked several times to see if they had the correct plan, they did however were not following it. By the way the workers had no idea where the doors went at install meant to me that she had never given some of them the plan to even look at. Plan was always on site! They were given August to correct their work. By September 1st I had enough because of their refusal to correct their work and build to plan, and the immense stress ************************* was causing my health. I saw more structural damage and I had caught her in so many lies at this point and she pretended she couldn't speak english anymore after 8months of speaking English just fine. That is when I had to get them off the property as instructed by the *************** ******************** or they would have caused more damage to our home. I had health issues, several asthma flare-*** due to the stress caused by ************************* and am unable to live in my home for an additional year because of the poor work done by her company. I will be suing for a full return, damages and stress caused by Wheeling Construction and **************************

      ****************** needs to justify her response because her accusations are false. ****************** states that she needed to get ********************** off of our permit as a builder, we were never on the permit please provide evidence that we were on the permit. Next ****************** stated that we didnt pass, not even partial on the inspection of the framing,please see below attachment that states new construction was a partial pass on October 3rd. This was due to structural changes made by ******************,the general contractor. I am attaching examples of the correspondence we had with ****************** regarding these changes. Again ****************** states that we faked a rough underground pluming inspection, please see attachment below. We are submitting receipt of inspection appointment from the *************** that in fact there was an inspection for underground work.  Also ****************** needs to justify the accusation of forgery. The evidence she submitted has no proof of where it is from or what it is in relation to, just a blank page with some writing.  ****************** also states the plumbing needed to be removed and redone with proper material please provide evidence that this in fact took place.  We have filed with the *************** a freedom of information request to disprove the remainder of her claims.  This unfortunately will require more time.  ********************** is a reputable and experienced company. We contract individuals with over 20 years of experience in new construction and remodeling of commercial/residential buildings. With over *********************************************, ********************** never was accused of falsifying any inspection documentation, which we consider slanderous. Once again ****************** resorts to personal attacks against myself and my crew. It is regrettable that this issue will need to be address in a court of law as we still have a substantial balance that is due to us for materials and labor.

      I am rejecting this response because:

      The building department wouldn't tell me to get Wheeling Construction off of the property and start legal proceedings if Wheeling was building to plan. Even our Hvac and Electrician were calling us to tell us what they were doing wrong. They started watching them for us! Why would they do that if it wasn't looking suspicious?

      She admits in her response that she was NOT working off of the city APPROVED plan that was sent to her 2 days after date of issuance on January 31, 2022. These are not personal attacks, these are the facts based on my experience with this company.

      They were initially hired in Ocotber 2021 we had signed a contract with Wheeling Construction on October 24, 2021, while waiting for the plans for the plans by the city. Our plans were denied and our architect was given changes by the city for him to make to the plan for resubmission. They also said Wheeling Construction could do the build, but could not do the masonry and concrete because they needed a type A ***** and did not have one. We spent a total of 183 days waiting for our plans to pass and to receive a permit. Of those 183 days, 96 were spent in waiting after the resubmission for the approval and permit copy. 

      Our architect finally heard back with the approval on January 28, 2022. I sent the new city approved plan to Wheeling Construction on January 31,2022, the day I received the permit in my email from our architect. 

      Materials were never a part of our original contract for framework. Since there were some changes to the plan forced by the city, some extra demo, material changes and some structural changes per city codes, and we had to wait so long for an approval, she said she had lost her workers and had to find new ones and the new ones were more expensive because they were more skilled. So ************************* said she had to requote us which she did. The old quote was signed on October 24, 2021 when we hired them while waiting for approval. The new quote was signed on February 8, 2022 and deposit paid on February 14, 2022. Anything before this contract is void because she is the one that said she had to requote us. 

      Against her claims, looking at the front of the original permit, you can see that her company is clearly on the permit from the get go since  the issuance date of January 28, 2022.See the permit image attached information circled in red reads as;

      Also attached image of the back of our permit that has been hanging in view the entire build with the inspection notes. Notice the first plumbing inspection that took place on June 15, 2022 reads as;

      "Underground plumbing approved." 

      The building department has no record of this inspection taking place.The plumbing inspection and notes for August ********** are not what was submitted to city building department and there is now a standing plumbing violation on the property because of Wheeling Construction's suspicious plumber and the unapproved materials he used but also his non existant documentation of the underground plumbing inspection from June15, 2022 that is written on the back of our permit by their plumber. Our new plumber **** and our neighbor (who is a water inspector for the city and works in the building department), have helped us sort out the issues with the plumbing. On the back of the permit you can see rough plumbing inspection notes highlighted in red reads as;

      "Rough denied

      Upgrade service

      Get approved plans"

      I provided multiple copies of the plan on site at the beginning of the build per instruction from our architect. We have an affidavit from our hvac guy who was working on hvac during the "plumbing inspection " that took place on August 29,2022, stating that the plumber did not give the inspector the plans. The city notes submitted said nothing about water service update, the building department and the water inspector said service is fine and if anything needed to be added we could just add a booster pump, which is on our approved plan. 

      The framing inspection notes highlighted in red from the inspection that took place on October 3, 2022 reads as;

      "Rough denied. 

      All structural rough framing is contrary to plans at all floors." 

      Doesn't sound like a partial pass to me. If you read the notes in the building department all things failed because Wheeling Construction failed to follow the plan and city approved materials and attach the wood to the frameqork properly. It says partial pass online, the inspector did us a solid there. It's a partial pass until we correct EVERYTHING Wheeling Construction did wrong. 

      Images attached to show incorrect pipe material, holes in the brand new balcony as well as wood rot that had formed  in just a few months because they did not do the drainage properly. Our ****** had to fix their mistakes. I have plenty more images that I will email the BBB.

      In regards to the post in the kitchen, she said it was temporary. It wasn't even a post, it was 2-2x4s put next to eachother without anything holding them together like in multiple other areas of the build as well. In her response, it sounds like she has forgotten we had this second contract because she thought it was more work than originally quoted while waiting for approval and she had to hire better workers. If we signed a second contract, why is she bringing up emails from before the new contract was signed on February 8th?

        We paid every invoice immediately up until August, because we grew very suspicious of her and the build was in slow motion. We had also already paid up almost the entire contract plus more because materials were not included. ****** is when she started arguments with me and I had to get very ***** about them getting their work done as it was supposed to be done already and we had paid them. Not only that but the corrections had not been made. We had posts twisted, splintered wood and they were arguing about everything when the **** was right there. We paid almost one hundred thousand dollars to Wheeling Construction for them to do this to our property and give us this undue stress. Then we had to pay an additional sixty thousand plus to repair what Wheeling Construction had done. Every time I paid her she told me she was going on vacation, workers would disappear. RED FLAG FOLKS! The new carpenters had to take out almost everything Wheeling touched and they said they screwed us on purpose based on how the work was done. All major structural support they put in had to be removed and since they left the home unsupported properly, the existing supports started twisting and splintering and therefore needed extra reinforcement and replacement when they were fine before. All new plumbing had to be removed because they used nonpressurized piping with cellulose core. We have been out of our home for additional year and were nearly homeless not knowing if we were going to be able to keep our home. I won't allow this woman to waste anymore of my time. I am tired of reliving this nightmare over and over and over again. She is such a stressful person to deal with and I pray she is never allowed to ever do this to anyone else ever again. If I don't receive a return I'll see her in court. I have to make sure she cannot do this to anyone else ever again.

      I have more than enough evidence of the damages, as well as affidavits from every other contractor and multiple city inspectors that say that Wheeling Construction was negligent on this job and should be held accountable in a court of law. You can't take payment and not deliver the contracted services to an approved plan, and then destroy everything that you were paid to fix. This is not only negligent but stealing. We will see ************************* in court.

      Contract for work signed on 03/30/23 for limited gutter replacement ($805.00) and siding repair ($300.00). Gutter replacement done on 03/30/23; siding repair on 04/04/23. I had paid contractor through **** ******************************** $550.00 on 03/30/23 and remaining $555.00 due on April 4. Before paying ****** by check on 04/04/23, I notified him that the replacement work had left fascia exposed. I noted my concern that the 2-man working crew had not notified me of the problem. ****** viewed exposed fascia area and agreed with the visual evidence. He indicated he would be able to have the problem fixed soon. I asked him about using aluminum wrap as protection. He indicated that this was a viable solution. I also asked him to provide a quote on wrapping door frames and installing door. He indicated that the fascia wrap could be done at the same time as the doors. My neighborhood experienced significant rainfall over the next week and I was concerned about fascia rot. On April 10, ****** emailed me a quote for the door wraps. On April 11, I emailed to ask when the fascia wrap could be done. No response was received. I hired another contractor to wrap the aluminum on April 14. That same day, I called the owner of Wheeling Construction, ********************************** who agreed to reimburse me for the cost of the wrap. She asked me to email the receipt for the work. I emailed the receipt to ****** on April 18. On April 24, having had no acknowledgement from Wheeling Construction, I contacted ********* by phone again. She claimed to have not received the receipt. When I told her I had paid $150.00, she balked at reimbursement. In response, I asked her to be reasonable. She asked me to email receipt again. Later that day, I sent a photo of the receipt to ****** via text and email. After receiving text acknowledgement from ******, I had no additional response and received no reimbursement.

      Wheeling Construction, **** strives to satisfy all our customers and complete our projects in a timely manner. According to our contract we were to replace and reroute an existing gutter and repair some siding. Unfortunately, the previous siding company never wrapped the fascia in its entirety, therefore leaving portion exposed from the initial installment. This was discovered when our crew removed and replaced the gutter. Fascia work was never part of our job. 

      The contracted job was completed in a timely and ******* like manner.

      I am rejecting this response because: The owner orally agreed to compensate me for the cost of having the repair work done timely by someone else. This offer was made in response to poor service provided by her company. As noted by the owner, the exposed fascia "was discovered when our crew removed and replaced the gutter." However, this problem was not proactively communicated to me. Furthermore, the owner's representative did not timely respond to repair requests.

      I am rejecting this response because: There was no preexisting problem with the fascia as the prior seating of the gutter provided fascia protection. When your crew reconfigured the slant of the gutter, a piece of fascia suddenly became exposed. Your crew had an affirmative duty to inform me of the problem and offer to fix it while they were on the job. They did not. Days later, the company's representative, ***********************, agreed that the problem had not been addressed by the crew. Later, the owner, *********************************, orally promised to compensate me for the poor service and asked me to send the invoice. After she failed to acknowledge receipt, I again contacted her and *********************************. Eventually, ********************************* confirmed receipt and ********************************* promised she would review. Since I did not receive a subsequent communication from her, I reached out to BBB. I am disappointed with her crew's poor customer service and her denial of an oral agreement.
