  Language in Perfect Choice's (PCE) contract, states."“This contract may be purchased or sold for work or repairs to subcontractors. In that event the subcontractor is responsible for all permits, workmanship and any repairs and or complaints that may arise that may or may not need responded to. BBB complaints cannot be used against PCE if this contract is purchased or sold to a Subcontractor. Subcontractors that purchase work contracts are required to be fully licensed and insured governed under the laws of the state and the policies of PCE and take all responsibility for any BBB Complaints.”
  
  BBB has asked the company to review this section of their contract and does not have record of receiving a response as of January 29, 2019. 
  
  Businesses do not dictate how BBB applies our Complaint Acceptance Policy. The consumer’s initial contact with Perfect Choice Exteriors (PCE) constitutes a marketplace relationship, even if PCE later sells/assigns the contract to someone else. And the consumer can reasonably allege a problem with PCE’s services based on PCE selecting the other contractor involved. Despite this contract language, we will still accept the complaint and expect PCE to respond.
  This provision may violate the Federal Consumer Review Fairness Act if interpreted to prevent consumers from filing complaints with the BBB against PCE.The CRFA prohibits a contract provision that bars or restricts the ability of a consumer to review a company’s products, services, or conduct. This includes BBB complaints as well.
