    FTC Takes Action Against Multistate Auto Dealer Napleton for Sneaking Illegal Junk Fees onto Bills and Discriminating Against Black Consumers

    The following describes a government action that has been resolved by either a settlement or decision by a court or administrative agency. If the matter is being appealed, it will be noted below.

    On 4/1/2022, the business entered into a settlement with the Federal Trade Commission and the Illinois Attorney General. The business will pay $10 million to settle the lawsuit alleging that the business' eight dealerships and the general manager of two Illinois dealerships illegally tacked on junk fees for unwanted "add-on" products such as payment insurance and paint protection.     On 11/14/2022, the Federal Trade Commission is sending payments totaling more than $9.8 million to consumers who were harmed by Illinois-based Napleton Automotive Group's junk fees and discriminatory practices. According to the press release, the agency is sending 66,355 checks, averaging $147 each. Recipients should cash checks within 90 days. Consumers who have questions about their refund should call the refund admistrator, Epiq, at 888-691-6050.       Below is the email I sent and havent heard back after multiple phone calls and promises that someone would get in touch with me. We hope this message finds you well. We wanted to bring to your attention some concerns regarding the recent purchase of the 2015 Black Jeep from your dealership. On June 29th, our son acquired the vehicle, and during the test drive, we noticed some issues with shakiness. We were informed that it might be due to water or rust, and were assured it would be addressed if it persisted.Unfortunately, despite our return visit on July 3rd, the problem still persists. My husband even took it upon himself to replace the front brakes and rotors, which improved the shaking but did not resolve it completely. Our mechanic, currently on vacation, suggested replacing the rear brakes next, which my husband will be taking care of.In addition to the ongoing shaking issue, we have encountered other concerns such as severe jerking when accelerating quickly and high idling when at a stop. Furthermore, we were charged for window tinting that we later discovered was not recently done as indicated and although we were informed that the car had been serviced, it appears that there is only 3% oil life remaining, indicating that the service did not take place as expected.This purchase was particularly significant for our son as his first major investment, and it has been a disappointing experience so far. We understand the purchase was made "As-Is," but we would appreciate your assistance in addressing these issues and ensuring the car's overall condition.

      I Dropped my car off May 1st of this year and just received it today July 12th for transmission work something that should have taken no longer than 2-3 weeks thats with the warranty people checking and receiving a new transmission . I received my car and my camera (*******) I use for my ride share I do part time it was on my seat my wires for it was hanging down I informed ***** about it and he said he didnt know what happened, I told him I would bring my car back Monday because at this point I was upset and past disappointed with the whole experience.the only decent thing about this situation is that they put me in a loaner vehicle which I had to wait 3 weeks for as well as missing over a month and a half almost of work for something that takes honestly about a week I mentioned 2-3 weeks due to paperwork and getting the transmission.Honestly the only reason I take my vehicle there is because its close to my home and I can get a loaner to get back and forth to work and I hoped that things would have gotten better with my experience there because its not my first bad experience with them.
