On 8/17/2023, BBB contacted Sky Auto Protection regarding their mailers and requested they modify their advertisement to meet BBB Code of Advertising and be more transparent as complaints about deceptive practices continued to be received by the BBB.
The business advertised the following on their mailers:
Sky Auto Protection contacts consumers through mailers that contain the following claims in an effort to strongly urge consumers to purchase its products, which separately and together, create a false sense of urgency:
“Coverage ID: [number]
Coverage Status: Available”
“Call No Later Than: [date]”
“RESPONSE TO THIS NOTICE REQUESTED”
“Our records indicate that you have not contacted us to activate a vehicle service agreement for your VEHICLE.”
“Please Call: 1-877-351-1210 and have your VIN number available to activate coverage.”
“You are receiving this notice to ensure no lapse in vehicle protection. As you may be aware, warranty expiration is based on the mileage and age of your vehicle. Call now to activate your coverage.”
“By neglecting to activate extended vehicle protection, you will be at risk of being financially liable for any all repairs once your factory warranty expires. However, you still have time left to activate your service contract on your vehicle before it’s too late. No vehicle inspection will be required.”
“This may be our only attempt to contact you about your vehicle service contract.”Under Summary of Terms, it states:
"12 months/12K miles 12 months/24K miles 36 months/100K miles

1. Basic Principles of the Code
1.1 The primary responsibility for truthful and non-deceptive advertising rests with the advertiser. Advertisers should be prepared to substantiate any objective claims or offers made before publication or broadcast. Upon request, they should present such substantiation promptly to the advertising medium or BBB.
1.2 Advertisements which are untrue, misleading, deceptive, fraudulent, falsely disparaging of competitors, or insincere offers to sell, shall not be used.
1.3 An advertisement as a whole may be misleading by implication, although every sentence separately considered may be literally true.
1.4 Misrepresentation may result not only from direct statements, but by omitting or obscuring a material fact.21. Layout and Illustrations
21.1 The composition and layout of advertisements should be such as to minimize the possibility of misunderstanding by the reader.
21.1.1 For example, prices, illustrations or descriptions must not be so placed or displayed in an advertisement as to give the impression that the price or terms of featured products or services apply to other products or services in the advertisement, when such is not the case.As of 1/3/2024, business has not provided actions they are taking to resolve the issue or modified the mailers.
