    We contracted with ***************** of Exact Modern Construction to remodel our house at **********************. He was paid $116k in three installments thru a construction loan with ********************* in Feb / Mar 2022.He started work immediately and did just what was required to get the next two installments. By April ***************************************** addition he led us to believe that the delays were also supplier related. We were patient knowing that supplier issues are common at this time. We offered alternatives to improve availability and still no more work was completed. In Aug 2022 he did send two guys who fixed the hole in the roof but he has not answered messages by text or email for many months now. Initially the bank guy could get him to respond when we could not but that has stopped now as well. In Sept 2022 we heard that he had sold all his equipment and gone to work a regular job after not doing a job for someone else the bank knows.Since then we have had sub contractors come in just to quote to finish the job he started and nearly every one of them has stated that there were issues with the work he had already done that would need to be redone.The original contract was for $129k to fully complete the remodel of our house and barn. In addition we paid $15k for a pole barn that we were going to have him install for an additional fee after the remodel was completed. He dropped the siding off at our house but the rest of the pole barn is still MIA.Our construction loan was opened in Feb 2022 and he stated it would only take about 6 weeks to complete. Even allowing for supply issues we are way overdue. And now we are going to have to use any savings we have to even make the home habitable which it was before he started work on it and it is not now.I am very worried about even what we are allowed to do with regards to work on our own property. We would appreciate any guidance you could give us. We want to see our home finished.

    I paid this company in full as he said he had to order materials..its been 8 months and I still have a leaking holy roof that birds are flyin in, my ceiling tiles inside have fallen off all but 1 room in my house because of the prolonged leaking, I have to have buckets all over the house when it rains to catch all the water leaking in. The owner stopped returning my calls, texts and emails along with avoiding the claims adjuster trying to contact him. My deadline on insurance is in 10 days, which means I will lose 9k on the insurance payout. This is the worst business I&#**;ve ever dealt with, call anyone but this company.The company has since our last communication committed to completing the work by Aug 13th, which it hasnt even been started so it&#**;s not gonna be done by eod today lol. He also again has stopped communicating completely after the start date passed with no explanation whatsoever asto why it didn&#**;t start. I have asked multiple times for the materials, Ihave paid $10,800 for, to be delivered to my house so I can get another roofer to actually do the work. He refused. He knew of the deadline of 8/13/22 and the failure to meet that deadline has cost me another $ ***** of my money paid into the claim. He once again had promised to complete the job paid for beginning Aug 1st. He has yet to show up and no communication since Aug 13th. He stated he had blown his hip out but could be back to work the following tues. Which I thought was super shady for a hip replacement.

    Hello **** and *****,
    **** on Aug 13th you stated that jobs were 2 weeks behind due to injury. The injury you stated occured did not at all explain the materials not being delivered when you stated which was on the 1st of Aug. Also by 13th my job was already 2 weeks behind getting started with no reason as to why there was an initial delay. Its has been over a month now. I understand you were injured and could not work, but that does not excuse the materials not being here, complete lack of communication, updates, or any replies to any attempts to reach you, after many multiple attempts is shocking from someone running a business and trying to build that business.  Customers deserve communication, especially when they have paid 90% in full with absolutely nothing to show for it after 9 months. I have requested updates/communication multiple times over the last month with no response. I have given you more than enough opportunity to respond, finish this job, or drop the materials off so I can hire someone to finish. You have ignored, refused, whatever you want to call it, all options. I asked for a tarp job to keep the leaking under control until you could get here with no response. The extensive and prolonged exposure to water/leaking is continuing to cause more damage to my house, and without insurance coverage all that is going to be my responsibility unfortunately. You said you would take care of it, but you have shown me that you can/will not. This should definitely have been a priority of yours considering all the circumstances impacting me and my life since January. It is very disheartening to know that what I'm living in does not change your choice to ignore me and all options you have.
    With absolutely no communication AGAIN my options are limited, as I only have 1. 
    Today I will be sending a 2nd registered letter to you. You can refuse it like the first, as I don't need you to accept them, I just have to send them. I was again advised to take other actions. I am way beyond exhausted from begging you for responses, begging you to complete a job you committed to, and have been given money to do. I have stated that I would pay the out of pocket 1200$ reflected on an invoice that you mentioned in a previous message, so that should not be an issue. This situation you have put me in is ridiculous.  The extensive leaking, the birds flying inside, the falling ceilings, the lack of insurance coverage until the job is complete. I can't repair ceilings or put my laundry machines in the room until the roof replacement is complete. Which means I'm spending money at a laundry mat. These circumstances created by your prolonged, unexplained, and multiple delays have left me and my house in a very unsafe environment/ situation, that I can no longer tolerate as last month was the year anniversary of the incident.  ************* claim on this is closed since the deadline and extension of that deadline was not met, so there will be no more communication with ***** going forward.  He has advised me on the next steps I must take and therefore I will be taking his advice. If you would like to drop off all materials so I can hire someone that would be great. This should seem likely since you stated you were not making any money on this job in a previous message. Which I assume is the hold up. At this point that seems to be the best option to avoid prolonged exposure/damage. I have 2 guys ready to do it. Please respond if this is acceptable.
